HomeMy WebLinkAboutResolution No. 02-C0600 RESOLUTION NO. 02-C60 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING PRECISE PLAN OF DESIGN NO. P- 2002-84 FOR THE CITY OF AZUSA PUBLIC LIBRARY AT 708-728 N. DALTON AVENUE AND 303-325 E. FOOTHILL BOULEVARD (APN NOS. 8608-029-003, 005, 006, 007, 008, and 904). WHEREAS, the City Council of the City of Azusa, has given notice thereof as required by law, held a public hearing on a City initiated request, with respect to the requested Precise Plan of Design No. P-2002-84, for a new public library at 708-728 N. Dalton Avenue and 303- 325 E. Foothill Boulevard (APN Nos. 8608-029-003, 005, 006, 007, 008, and 904); and WHEREAS, the City Council has carefully considered all pertinent testimony and the staff report offered in the case as presented at the public hearing. WHEREAS, the City Council's proceedings for a Major Precise Plan of Design were in compliance with City Code Section 88-575. NOW, THEREFORE, the City Council of the City Of Azusa does hereby resolve as follows: SECTION 1: Pursuant to the City of Azusa Local Guidelines for implementing CEQA and the State CEQA guidelines, a Mitigated Negative Declaration has been prepared and reviewed, finding that the proposed project could not have a significant effect on the environment. The City Council hereby certifies said Mitigated Negative Declaration, with the provision that the mitigation measures recommended in the initial study be implemented. SECTION 2: That in accordance with Section 88-575 of the Azusa Municipal Code, the City Council hereby approves said Major Precise Plan of Design based on the following findings: A. That the proposed precise plan of design is consistent with the General Plan. LAND USE ELEMENT: The current General Plan Land Use designations for the Subject Property are Medium Density Residential and Central Business District. General Plan Amendment and zone change applications are being processed in conjunction with this precise plan of design to change said designations to Community Facilities to assure that the proposed library will be consistent with the Land Use Element Map and Zoning Map designations. COMMUNITY DESIGN ELEMENT GOALS: Promote community identity through the upgrading of existing landscaping, redesign of existing buildings and design treatments for new buildings which are in keeping with community character. City Council Resolution No. Precise Plan of Design No. P-2002-84 Page 2 of 4 The design of the proposed building was the developed through an extensive public outreach process. The process resulted in a proposal for two-story building designed in a traditional Spanish -Mediterranean architectural style. The proposed architecture compliments the existing buildings in the civic center, as well as many of the commercial buildings along Foothill Boulevard. The building's forward street- orientation allows for sidewalk uses such as outdoor seating, and encourages pedestrian street activity. In all, the project's exceptional design qualities are expected to help transform the image of the City and promote community identity and pride. B. That the nature, condition, and development of the adjacent uses, buildings, and structures have been considered, and the use will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures. Adjacent and nearby uses include the City Hall facility and existing library building to the west, the senior center to the north, a restaurant and residences to the east, and a service station and retail buildings to the south. The proposed library facility has been designed to respect the adjacent land uses — especially the residential uses to the east - and protect those uses from any potential adverse impacts. The building walls facing east are setback approximately 24 — 31 feet where openings (windows or doors) occur so that noise levels associated with the development of the proposed library will not exceed the current City of Azusa noise ordinance, and to preserve the privacy of the adjacent properties. As such, the proposed library will not adversely affect the adjacent properties C. That the site is of adequate size and shape to accommodate the use, buildings, yards, fences and walls, parking, landscaping, and other development features proposed. The Subject Property consists of six contiguous parcels that make-up a 150 foot wide by 400 foot deep site that totals 1.37 acres. With the exception of the setback, parking and building height variances being processed in conjunction with this application, the project meets all other applicable provisions of the Azusa Municipal Code, and the site accommodates the proposed 60, 000 square foot building. D. That the proposed project complies with all of the applicable development standards of the zone district. Zone change and variance applications are being processed concurrently with the requested general plan amendment to assure that the zoning of the Subject Property is consistent with the General Plan. The proposed library facility has been designed to meet all of the applicable provisions of the Zoning Code except for the building height, parking and setbacks for which variances are being sought. Because of the unique 0 0 City Council Resolution No. Precise Plan of Design No. P-2002-84 Page 3 of 4 qualities of the Subject Property, variance findings will be adopted to support the approval of the deviations from the zoning standards. E. That the site is adequately served by highways or streets of sufficient width and improved as necessary to accommodate the type of traffic associated with the proposed use. A Traffic Study prepared for the project concluded that the site is adequately served by Foothill Boulevard and Dalton Avenue, both of which have sufficient width to accommodate the type of traffic associated with the proposed use. The Study identified one significant impact at the intersection of Dalton Avenue and Foothill Boulevard, but concluded that said impact could be mitigated by installing a traffic signal. The Study also recommended restriping the southbound approach of Dalton Avenue at Foothill Boulevard from a single lane to two lanes. F. That the proposed project observes the spirit and intent of the Zoning Ordinance. A zone change (to Community Facilities) is being processed in conjunction with this precise plan of design application. The intent of the Community Facilities District is to accommodate major public and quasi public facilities at appropriate locations throughout the City. The proposed project - the construction of a new public library — meets the spirit and intend of the Community Facilities District. The overall intent of the Zoning Ordinance is to promote the public health, safety, and general welfare by accommodating appropriate land uses, and assuring that future uses and buildings are designed to address all relevant issues pertaining to uses within the immediate vicinity. Findings to support the associated variances from setbacks, parking, and building height (case no. V-2002-04) conclude that the project observes the spirit and intent of the Zoning Ordinance. SECTION 3: Based on the aforementioned findings, the City Council does hereby approve Precise Plan of Design No. P-2002-84 and adopt the Mitigated Negative Declaration for the property located at: at 708-728 N. Dalton Avenue and 303-325 E. Foothill Boulevard (APN Nos. 8608-029-003, 005, 006, 007, 008, and 904) subject to the conditions of approval attached hereto as Exhibit A, and incorporated herein by reference, as though set out in full and at length. SECTION 4: The City Clerk shall certify to the adoption of this resolution. 3`d day of June, 2002.
