HomeMy WebLinkAboutResolution No. 05-C0510 0 RESOLUTION NO. 05-051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA URGING CALIFORNIA LEGISLATURE TO PASS AB 1125 HOUSEHOLD BATTERY RECYCLING ACT WHEREAS, The Environmental Protection Agency estimates that three billion batteries are sold in the United States annually; and WHEREAS, Virtually all household batteries contain hazardous materials, mainly heavy material which, if not disposed properly, leak into the ground contaminating our water and food supply; and WHEREAS, Currently less than 5 percent of rechargeable batteries and less than one percent of one-time use batteries are recycled; and WHEREAS, The California Department of Toxic Substance Control has recently determined that all discarded batteries are toxic and must be disposed of as hazardous waste; and WHEREAS, California's Universal Waste Rule prohibits the disposal of all household batteries in landfills and granted a temporary exemption form this landfill ban which expires on February 8, 2006; and WHEREAS, AB 1 125 would require every retailer of household batteries sold in California to have in place a system convenient to the public for the acceptance and collection of used household batteries for reuse, recycling, or proper disposal by February 1, 2006; and WHEREAS, AB 1 125 would also require every retailer of household batteries to make information available to consumers about household battery recycling opportunities by posting signage, providing written materials, or communicating directly with the consumer at the time of purchase; and WHEREAS, exempt participators include all retailers who primarily sell food and are listed in the Progressive Grocers Guide, or those retailers who have less than $1 million annually in gross sales; and WHEREAS, AB 1 125 would require the cost of the program to be internalized by battery producers and consumers at or before point of purchase and that the costs associated with the program shall not be borne by the local government or taxpayers. NOW, THEREFORE, BE IT RESOLVED, that City Council of the City of Azusa hereby urges the California Legislature to pass AB 1125. 0 0 FURTHER RESOVED, that the City Council of the City of Azusa send a copy of the final signed resolution to Assembly Member Fran Pavley, PO Box 942849, Sacramento, CA 94249-0041.
