RESOLUTION NO. 06-C65
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
APPROVING A REVISED GRADING PLAN AND A HAULING PERMIT TO
EXPORT 130,000 CUBIC YARDS OF SOIL FOR THE ROSEDALE PROJECT
WHEREAS, the City Council of the City of Azusa on February 3, 2003, approved the
Monrovia Nursery Specific Plan and project, which comprised a General Plan Amendment, Zone
Change, Specific Plan, Annexation, Development Agreement, and Vesting Tentative Map; and
WHEREAS, these entitlements allowed the construction of a planned community
comprised of up to 1,250 homes, up to 50,000 sq. ft. of commercial, a K8 School, a new fire
station, and an extensive system of parks and open space; and
WHEREAS, an Environmental Impact Report (EIR) pursuant to the California Environmental
Quality Act Guidelines, was prepared in connection with said entitlements, and was certified on
February 3, 2003 (SCH# 2002071046); and
WHEREAS, the Rosedale project is currently under construction pursuant to the
entitlements, and has encountered 450,000 cubic yards (CY) of surplus soil during ongoing
grading operations, which will require a combination of onsite reuse and off site exportation; and
WHEREAS, a revised grading plan ("Grading Plan Modification") has been prepared for City
approval, which will incorporate 320,000 CY of excess soil onsite, and which will increase certain
building pad elevations 5-18 ft. in areas of the Promenade District of Rosedale; and
WHEREAS, the balance of the excess soil, 130,000 CY, needs to be exported; and
WHEREAS, the environmental impacts associated with the Grading Plan Modification have
been analyzed and it has been determined that the Grading Plan Modification is exempt from
further review under Section 15183 of the State Guidelines for the California Environmental
Quality Act; and
WHEREAS, even if the Grading Plan Modification were not exempt from further CEQA, the
City has determined that an Addendum to the Certified EIR is appropriate because no significant
adverse impact's would be created by the proposed grading plan revision and soil exportation; and
WHEREAS, the City Council has directed staff to file a Notice of Exemption and Adoption of
Addendum to the Environmental Impact Report prepared for the Monrovia Nursery Specific Plan
Project;
NOW THEREFORE, the City Council of the City of Azusa does hereby resolve as follows:
SECTION 1: The City Council makes the following findings in support of the proposed
Revised Grading Plan and soil exportation (the Grading Plan Modification):
A. The Grading Plan Modification is consistent with the intent and provisions of the
City's General Plan, applicable portions of the Zoning Ordinance, including findings
for Development Review/Precise Plan.

The Grading Plan Modification is not subject to Design Review, but will comply with
all Municipal Code and Zoning Code requirements for truck haulinggrading The
Grading Plan Modification is the implementation phase of the Monrovia Nursery
Specific Plan, which is consistent with the City's General Plan and Zoning
Ordinance.
B. The Grading Plan Modification is in substantial conformance with the Specific Plan.
The Grading Plan Modification is consistent with the Specific Plan's Desi
Principle of providing street character elements with high qua/icy landscape,
because rich /andscapingmateria/s are possible with both 2:1 slopes and plantable
"Loffe/ walls-, using a variety ofgroundcovers. The u/timate appearance of the
landscaping of the slopes in combination with the landscaped parkways and large
canopy street trees "#// maintain the high quality landscape street character that
the Specific Plan requires.
The street edges of the GreatParkNeighborhoods and Transit I Neighborhood will,
bynecessity, be characterized bylandscaped slopes along the east, west and south
sides, due to the topography. The exception is the Promenade frontage, which "I
generally be leve/ with the street. Therefore, the site planning and interna/ design
of these neighborhoods must focus on the design guidelines that willprovidegreat
neighborhood charm as set forth in the Specific Plan. The achievement of the
Specific Plan's objectives of creatinggreat neighborhood charm "and "orienting
dwellings onto streets" will not be inhibited by the steepness of the perimeter
landscaped -slopes of these neighborhoods. Whether the slopes are 2:1 or steeper
with the use of the Loffe/ wall system, as long as the landscape design is similar,
the slopes will complement the neighborhoods' landscaped open space areas.
The pad design of the Great Park 2 Neighborhood fronting the Promenade would
transition from level to approximately 6 ft. above the elevation of the Promenade.
The proposed 30"high `seating wall"with a 3:1 landscape slope leading up to the
residentia/building pad is determined to be consistent with the Specific Plan in that
the 6 ft. height with seating wall and 3.1 slope will provide a street scene that will
continue to al/ow for the orientation of the residential units to the street.
C. The Grading Plan Modification does not unreasonably interfere with the use or
enjoyment of property in the vicinity.
The Grading Plan Modification w111 constitute a revised approach to the
construction phase of the Rosedale project already in progress. This revised
approach has been found not to adverselyaffect the use or enjoyment ofproperty
in the vicinity beyond that already identified in the Certified HR.
D. The Grading Plan Modification does not adversely affect the public peace, health,
or general welfare.
Construction of the Rosedale project pursuant to the Specific Plan is currently in
progress and property /n the vicinity /s currently experiencing short-term
construction activity. The Grading Plan Modification will not exacerbate these
activities. The potentia/ environmental impacts of the Grading Plan Modification,
including aesthetics, air quality, noise, traffic, and hydro%gy, have been carefully
examined, and no significant adverse impacts were found.

SECTION 2: The Grading Plan Modification is hereby approved, subject to the Conditions
of Approval attached as Exhibit A hereto and incorporated herein by reference.
SECTION 3: The Truck Hauling Permit to export 130,000 CY of excess soil is hereby
approved, subject to the Conditions of Approval attached as Exhibit A hereto and incorporated
herein by reference.

Exhibit "A"
Conditions of Approval
City Council, August 7, 2006
AAI requirements of the Planning Division shall be met, including but not limited to the
following:
A. All Mitigation Measures adopted as part of the Certified Monrovia Nursery EIR with
respect to air quality, noise and dust control shall apply.
B. All conditions of approval adopted as part of the Monrovia Nursery project shall
apply.
C. The future development of the Rosedale neighborhoods along Ninth Street shall
use plantable walls to provide softer landscaped slopes with more enhanced
landscaping opportunities where feasible. For the Great Park 3 Neighborhood, one
method of providing softer landscaped slopes to be investigated is providing
greater separation between of the plantable walls, featuring intervening 2:1 slopes
to promote varied landscaping.
2. All requirements of the Public Works Department shall be met, including but not limited to
the following:
A. Truck hauling shall be subject to, but not limited to the following conditions:
1. Applicant shall provide a detailed haul route map to scale.
2. Operating hours are Monday through Friday as follows:
- No truck staging prior to 8:00 a.m.
- Loading and Hauling between 8 a.m. and 4:00 p.m.
3. For all soil hauling, including return trips, the designated haul route shall be
Route "A": from the project site westerly on Sierra Madre Ave., to Todd Ave.,
south on Todd Ave. to Foothill Blvd., west on Foothill to Irwindale Ave., south
on Irwindale Ave. to the 210 Fwy. east on the 210 Fwy to Ontario.
4. No truck traffic shall be allowed during the peak hours of 7-8 a.m. and 4-5 p.m.
5. Truck speeds along the Sierra Madre Ave. shall not exceed 25 mph.
6. In lieu of covering loads, all loaded trucks shall have tops of loads wetted -down
with water containing a tackifier or similar stabilizer to control generation of
particulates.
7. Applicant shall provide acceptable insurance policy naming the City of Azusa as
additionally insured. '
8. All dirt and mud deposited on City streets by trucks shall be removed promptly.
9. The Applicant shall provide dirt and mud removal devices to scrape mud from
the tires of vehicles exiting the construction site.
10. Workers shall scrape and brush dirt and mud from trucks prior to exiting the
construction site.
11. If water is used to clean City streets the Applicant shall provide sand bags and
appropriate devices at catch basins to keep mud and dirt from the storm drain
system.
12. Applicant shall pay any fines from other agencies resulting from the transport
of material including those resulting from notifications of the State and/or
Regional Water Quality Control Board.
13. Sierra Madre Ave. shall be posted for "Construction Zone" 25 MPH from
Alameda Ave. west bound.
14. Applicant shall control multiple trucks departing from the site at the same time
to minimize impacts on traffic. Spacing of trucks shall be no less than 5
minutes.
15. Applicant shall utilize a street sweeper to constantly, on a daily basis, clean the
roadway along the haul route.

16. Applica*all apply for a Haul Permit, whicholl include mitigation for
roadway wear and tear.
17. Detailed records of the number of trips done per day shall be kept and
provided to the City upon request.
