A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ORDERING
THE SUMMARY VACATION OF THAT CERTAIN PUBLIC RIGHT-OF-WAY
KNOWN AS SIERRA MADRE AVENUE
WHEREAS, the City of Azusa has approved the Rosedale project, a subdivision of the
Monrovia Nursery property within the City of Azusa; and
WHEREAS, The City Council has approved said project with the realignment of Sierra
Madre Avenue through the project; and
WHEREAS, The plans for the realigned Sierra Madre Avenue have been approved by
the City Engineer and construction has begun to reroute this roadway; and
WHEREAS, With the realignment of Sierra Madre Avenue portions of the existing right-
of-way are no longer necessary and will be come excess right-of-way; and
WHEREAS, the Subdivider, Azusa Land Partners, has requested the vacation of those
portions of the existing right-of-way that will not remain within the new improvements for
Sierra Madre Avenue; and
WHEREAS, the vacation of the public right of way is undertaken pursuant to the
provisions of the Califomia Streets and Highways Code, commencing with Section 8300 et
sec, which authorizes the City to summarily vacate right-of-way that has been replaced by a
newly aligned improvements; and
WHEREAS, the San Gabriel Valley Water District has requested that easements be
reserved through the right-of-way to be vacated to allow for the reconnection of their water
system through the vacated right-of-way to connect to water distribution line services that will
be installed within the new right-of-way of Sierra Madre Avenue, described in Exhibit B and
shown on Exhibit C, and Southern California Gas Company has facilities for Gas distribution
facilities within the easement herein considered for vacation, as described on exhibit D and
shown on Exhibit E, it is necessary for the City Council to reserve easements and rights-of-way
to alter, use, operate, inspect, maintain, repair, and remove with the right of ingress and
egress, across, along, over, under, through, and within that certain real property in the City of
Azusa, County of Los Angeles, State of California, as described; and
WHEREAS, the easement for Sierra Madre Avenue between Nobhill Drive and Barranca
Avenue as described in Exhibit A attached is the easement intended to be vacated by this
resolution: and
WHEREAS, as required by section 8333 of the Streets and Highways Code, the City
Council finds that the easements identified above are being replaced by new improvements,
which make the old right-of-way unnecessary,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES HEREBY
RESOLVES AS FOLLOWS:

SECTION 1. That the public easements described in Exhibit "A" is hereby vacated
subject to the easements described in Exhibits B and D herein.
SECTION 2. That the easement shall be vacated subject to the acceptance of the
improvements for the new Sierra Madre Avenue. When the street improvements for the
realigned Sierra Madre Avenue are accepted by the City Council this vacation shall be
complete.
SECTION 3. That the City Clerk is authorized to record a certified copy of this
resolution with the Los Angeles County Recorder's Office.
SECTION 4. That the City Clerk shall send a copy of the recorded vacation resolution
to each utility for which easements were reserved.
SECTION 5. Effective Date. This Resolution shall become effective immediately
upon its adoption.

That certain parcel of land situated in the City of Azusa, County of Los Angeles, State of
California, being that portion of Lot "H" of Tract No. 062150 as shown on a map thereof filed in
Book 1311, Pages 28 through 50 of Maps, in the Office of the County Recorder of said Los
Angeles County, included within a strip of land 20.00 feet wide, lying 10.00 feet of each side of
