A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
DECLARING ITS INTENTION TO VACATE A DRAINAGE EASEMENT
AND RECORD A NEW DRAINAGE EASEMENT ACROSS PROPERTY
LOCATED AT 705 W. 9' STREET IN THE CITY OF AZUSA
WHEREAS, the entire property located at 705 W. 9' Street, in the City of Azusa as
described in Exhibit "A" attached hereto and made a part hereof, is not required for drainage
purposes; and
WHEREAS, the public interests, necessity, and convenience require the City Council to
vacate said easement; and -
WHEREAS, there is an adequate drainage pipe traversing the property, a new cleanout
manhole, and a catch basin to be constructed on the Railroad property north of the property wall
for area drainage collection; and
WHEREAS, that portion of the property located at 705 W. 9t' Street, in the City of
Azusa as described in Exhibit "B" attached hereto and made a part hereof, is required for
drainage purposes; and
WHEREAS, the public interest, necessity and convenience require the City Council to
record said new easement; and
WHEREAS, the City Council elects to proceed in said action.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES
RESOLVE AS FOLLOWS:
Section 1. That the City Clerk of the City of Azusa is directed to give
and post as required by law a notice that the City Council passed this Resolution of Intention,
and give the legal description of said property, the easement to be vacated and the new easement
to be recorded, and specify the time and place of this Resolution of Intention, which is hereby
fixed as follows:
The hearing to be before the City Council of the City of Azusa at 213 E. Foothill Boulevard in
the City Council Chambers of the City of Azusa at the hour of 7:30 p.m. on December 3, 2007,
at which time all persons interested may appear and object, protest or provide support to the
proposed vacation of easement and recording of new easement. If the City Council finds from
the evidence submitted that existing easement may be replaced by the new easement, it may so
make its order.

Section 2, This resolution shall take effect immediately upon its
adoption.
PASSED, APPROVED AND ADOPTED this 3`d day of December, 2007.

That certain real property lying within the City of Azusa, County of Los Angeles, State of
California, described as follows:
That certain easement or right of way to lay, construct, maintain, operate, repair, renew from time
to time and change the size of a pipe line for the conveyance of drainage water in, under and
along certain portions of the westerly part of Lot 4 of Tract No. 3231, as per map thereof recorded
in Map Book 34, Pages 45 and 46 records of Los Angeles County California and extending from
the northerly line of said Lot 4 to the Southerly line of said Lot 4.
