A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
DECLARING ITS INTENTION TO GRANT AN EASEMENT TO
TARGET CORPORATION FOR BUILDING CONSTRUCTION
PURPOSES ALONG SAN GABRIEL AVENUE, NINTH STREET, AND
AZUSA AVENUE IN THE CITY OF AZUSA
WHEREAS, the City of Azusa is the owner of certain real property legally described as
set forth in Exhibit A, attached hereto and incorporated herein by reference (the "Property"); and
WHEREAS, on July 23, 2008, the City of Azusa Planning Commission approved Use
Permit UP -2008-08, for the proposed Target Store; and
WHEREAS, the proposed Target Store structure will extend into the City's right of way;
and
WHEREAS, the, proposed easement will accommodate the construction, use,
maintenance, operation, alteration, .addition, repair, replacement, inspection, and/or removal of
the Target Store on, over,.in, under, across, along that certain real property described in Exhibit
A; and
WHEREAS, the City Council elects to proceed with the Grant of Easement to Target
Corporation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES
RESOLVE AS FOLLOWS:
Section 1. That the Grant of Easement, attached hereto and incorporated herein
by reference, Legal Description, attached hereto as Exhibit A and incorporated herein by
reference, and Plat, attached hereto as Exhibit B and incorporated herein by reference, are hereby
approved.
Section 2. The City Clerk is hereby authorized and directed to cause the Grant of
Easement, Legal Description, and Plat to be filed for record in the office of the County Recorder
of the County of Los Angeles.
Section 3. This resolution shall take effect immediately upon its adoption.

GRANT OF EASEMENT

The CITY OF AZUSA, a municipal corporation duly organized and existing under and by virtue of the
laws of the State of California, does hereby grant to TARGET CORPORATION an easement for the
purpose of constructing, using, maintaining, operating, altering, adding to, repairing, replacing,
inspecting, and/or removing its facilities consisting of structural footings for the Target Store on, over, in,
under, across, along that certain real property situated in the City of Azusa, County of Los Angeles, State
of Califomia,,lescribed as follows:
An easement four (4) feet in width within that portion of San Gabriel Avenue, Ninth Street,
and Azusa Avenue as shown on Tract No. 70189, as per map recorded in Book 1355, Pages
42 and 43 of Maps, in the office of the Recorder of said Los Angeles County, as described
in Exhibit "A" and shown in Exhibit `B", attached hereto and made a part hereof.
Target Corporation, its successors and assigns and their respective agents and employees, shall have the
right of ingress and egress from said easement and every part thereof, at all times, for the purpose of
exercising the rights herein granted. Such rights shall be reasonably exercised and Target Corporation
shall be liable for any damages negligently done by it to the above-described property.
