HomeMy WebLinkAboutResolution No. 13-C43RESOLUTION NO. 13-C43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE USE PERMIT (UP 2013-02) APPLICATION FOR THE INTERMODAL PARKING FACILITY PROJECT WHEREAS, on June 14, 2010, the City Council held a study session to provide direction to staff on a parking structure to be located between Alameda Avenue and Dalton Avenue, north of Foothill Boulevard and south of the railroad tracks. At that meeting, the Council directed staff to work with Foothill Transit on the design of the parking structure in that location; and WHEREAS, on October 4, 2010, the City Council authorized the City Manager to enter into a Memorandum of Understanding between the City of Azusa and Foothill Transit to provide direction for the development of a park and ride facility between Alameda Avenue and Dalton Avenue, north of Foothill Boulevard and south of 91h Street; and WHEREAS, the proposed Azusa Intermodal Parking Facility Project is a parking structure that would provide parking spaces for the METRO Gold Line Foothill Extension Alameda Station, Foothill Transit park and ride, and Azusa Civic Center; and WHEREAS, the City of Azusa submitted a Use Permit application (UP 2013-02) to permit the construction and use of a 38 -foot high, three story parking structure with rooftop parking, containing 550 parking spaces, for use by the public and government agencies; and WHEREAS, the Planning Commission held a public hearing on the Proposed Project and associated entitlements, and took public testimony on April 24, 2013. That hearing was continued until May 15, 2013; and WHEREAS, at the close of the May 15, 2013 Planning Commission hearing, the Planning Commission recommended, among other things, that the City Council of the City of Azusa (i) approve a Design Review Application (DR 2012-01); (ii) approve the Use Permit Application (UP 2013-02); (iii) certify the Environmental Impact Report; and (iv) approve Alternative 2 for the Intermodal Parking Facility Project; and WHEREAS, on July 1, 2013, the City Council of the City of Azusa held a public hearing to discuss the Planning Commission's recommendations and to consider the Project and related approvals, and at such hearing the City Council heard all persons interested in or opposed to the EIR and/or the Project; and WHEREAS, as contained herein, the City has endeavored in good faith to set forth the basis for its decision on the Proposed Project; and WHEREAS, all of the findings and conclusions made by the City Council pursuant to this Resolution are based upon the oral and written evidence presented to it as a whole and not based solely on the information provided in this Resolution; and 45635.18200\8044458.1 Resolution No. 13-C43 Intermodal Parking Facility July 15, 2013 WHEREAS, prior to taking action, the City Council has heard, been presented with, reviewed and considered the Use Permit application, the accompanying staff report, and all oral and written evidence presented to it during all meetings and hearings; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: In accordance with Section 88.51.0401 of the Azusa Development Code, the City Council approves said Use Permit No. UP 2013-02 based on the following findings: 1. The proposed use is allowed within the applicable zoning district and complies with all other applicable provisions of this Development Code and the Municipal Code; The Development Code divides the City into districts that are specialized around a predominant activity or have an identifiable focus that encourage orientation and identity of that district. These districts include: Downtown, the University District, the Edgewood District, and the West End Industrial Districts. The Downtown District is divided into three smaller districts: the Downtown - Civic Center (DCC), Downtown -Town Center (DTC), and Downtown -Transit Village (DTV). The Project site is located in the central portion of the DCC and DTV zones. The areas to the west and south are zoned DTC, and the areas to the east and southeast are zoned Medium (Med) Density Residential and Foothill Boulevard Corridor (CFB). The DCC zone includes the City Library, City Hall, Azusa Police Department (APD), Senior Center, and Veterans Freedom Park, and is located directly adjacent to the south of the Downtown Transit Village (DTV). The DTV is intended for transit -oriented development adjacent to the planned Metro Gold Line Foothill Extension Azusa - Alameda Station. Providing a park -once facility for public -transit patrons is consistent with the City's transit -oriented goals for the area surrounding the project site. The structure would also coincide with the increased density that would occur near a transit village. The Proposed Project would contribute to the functionality of the designated transit area by providing improved access to public transit, as well as enhance the transit and pedestrian oriented goals of the Downtown District by providing a park -once opportunity for patrons of the Civic Center, park areas, and transit. Therefore, the Project would be consistent with the zoning and complies with applicable provisions of the Development Code and the Municipal Code as to siting and compatibility. 2. The proposed use is consistent with the General Plan and any applicable specific plan; The Project site is not within a specific plan area. The Proposed Project is consistent with the applicable General Plan polices. Among other policies, the Proposed Project would provide transit infrastructure and would achieve the following policies designated under the Azusa General Plan. Land Use Policies: Policy 4.3: Encourage the development of shared parking or "park once" parking concepts. o The Proposed Project would include the construction of a shared parking facility that Page 2 of 7 45635.1820018044458.1 Resolution No. 13-C43 Intermodal Parking Facility July 15, 2013 would consolidate parking for multiple uses and destinations in the overall Downtown District. The facility would allow patrons to park once, while gaining pedestrian access to multiple uses in the vicinity, including Civic Center, park areas, Target, and Metro Gold Line Azusa -Alameda Station and Foothill Transit buses. Urban Form and Vision Policy 6.2: Encourage Foothill Transit to enhance regional transit connections to/from Azusa, by providing transit routes to Azusa transit centers or stations. o By providing a parking facility and bus bays for Foothill Transit use near the proposed Metro Gold Line Station, the Proposed Project will encourage and facilitate the use of transit by increasing accessibility to the Metro Gold Line Azusa -Alameda Station and Foothill Transit buses. Policy 6.4: Provide park-and-ride lots to encourage and facilitate use of transit. o The Proposed Project would include a parking facility near the planned Metro Gold Line Azusa -Alameda Station as well as bus bays for Foothill Transit bus use. Policy 8.1: Plan for an adequate amount, not an oversupply, of parking for autos, carpool vans, and bicycles for each land use. o The parking structure would provide at least 550 parking spaces to serve patrons of the Metro Gold Line Station, commuter bus patrons, and park, museum, and Civic Center visitors. It is anticipated that daily estimated parking trips within the structure would be approximately 1,313, with approximately 50 percent of the parking facility usage coming from Foothill Transit patrons. Metro Gold Line patrons would utilize 25 percent of the spaces, and the remaining 25 percent would be utilized by those visiting the Civic Center and Downtown. Policy 8.2: Allow and encourage shared use parking in order to gain the maximum efficiency from the parking supply and to minimize the overall amount of parking provided in the city. o The Proposed Project would include one parking structure that would provide parking for patrons of the Metro Green Line Azusa -Alameda Station, Foothill Transit buses, Civic Center, park, and downtown uses. It would be located in an area within the Downtown District of Azusa that would provide convenient access to many uses from one central parking location. Emergency Services • Policy 2.1: The Project developer will work, and has worked, with Los Angeles County Fire Department (LACoFD) to locate fire stations in a manner that will enable emergency fire response times to meet a five-minute or less standard. • Policy 2.4: The Project developer will work, and has worked, with LACoFD to ensure adequate facilities and personnel by evaluating population growth, response times, and fire hazards. • Policy 2.6: All site plans and structures are designed with fire and emergency access and safety in mind. Page 3 of 7 45635.18200\8044458.1 Resolution No. 13-C43 Intermodal Parking Facility July 15, 2013 Public Services • Policy 2.1: The Project will maintain the current park per capita ration of 1.14 per 1,000 persons. • Policy 3.6: The Project will develop park and recreation sites in ways that maximize efficiency, minimize maintenance costs, and balance community needs. The Project would also comply with the following hydrology and water quality policies: Water • Minimize water consumption through site design, use of efficient systems, and other techniques (W2.6); • Continue the City's water conservation efforts; review programs periodically and modify and/or expand them as appropriate and feasible (W2.7); • Continue to require the incorporation of water conservation features in the design of all new construction and site development (W2.8); and • Require the use of reclaimed water for landscaped irrigation, grading, and other non -contact uses in new developments, where available or expected to be available (W2.10). Storm Drainage • Maintain existing public storm drains and flood control facilities, upgrade and expand storm drain and flood control facilities (SD4.1); Coordinate with County agencies to improve the County's facilities (SD4.3); and Monitor the demands and manage development to mitigate impacts and/or facilitate improvements to the storm drainage system (SD4.4). 3. The design, location, size and operating characteristics of the proposed activity are compatible with the existing and future land uses in the vicinity; and the site is physically suitable for the type, density and intensity of use being proposed, including access, utilities and the absence of physical constraints; The Project site is located in the central portion of the DCC and DTV zones. The areas to the west and south are zoned DTC, and the areas to the east and southeast are zoned Medium (Med) Density Residential and Foothill Boulevard Corridor (CFB). The DCC zone includes the City Library, City Hall, Azusa Police Department (APD), Senior Center, and Veterans Freedom Park, and is located directly adjacent to the south of the Downtown Transit Village (DTV). The DTV is intended for transit -oriented development adjacent to the planned Metro Gold Line Foothill Extension Azusa - Alameda Station. The surrounding area is developed with one- and two-story buildings, including an approximately 40- to 47 -foot tall Target store commercial building. The proposed parking structure would be shorter in height to the Target building, but taller than the existing development immediately surrounding the project site. The proposed structure, at 38 feet tall and 47,588 square feet, would be larger in mass than the existing development. However, the proposed structure would not be completely enclosed on all sides, but instead would include arches that would allow for visibility into and through the structure, thereby decreasing the perceived mass of the structure. The proposed parking structure would also be consistent with existing uses in the project area, as it would Page 4 of 7 45635.18200\804445 8.1 Resolution No. 13-C43 Intermodal Parking Facility July 15, 2013 be intensifying an existing parking use. Implementation of the proposed project would add 550 new parking spaces to the project site. Providing a park -once facility for public -transit patrons is consistent with the City's transit -oriented goals for the area surrounding the project site. The structure would also coincide with the increased density that would occur near a transit village. The Proposed Project would contribute to the functionality of the designated transit area by providing improved access to public transit, as well as enhance the transit and pedestrian oriented goals of the Downtown District by providing a park -once opportunity for patrons of the Civic Center, park areas, and transit. 4. Granting the permit would not be detrimental to the public interest, health, safety, convenience or welfare or materially injurious to persons, property or improvements in the vicinity and zoning district in which the property is located; The provision of a park -once facility for public -transit patrons is consistent with the City's transit - oriented goals for the area surrounding the Project site. The structure would also coincide with the increased density that would occur near a transit village. The Proposed Project would contribute to the functionality of the designated transit area by providing improved access to public transit, as well as enhance the transit and pedestrian oriented goals of the Downtown District by providing a park - once opportunity for patrons of the Civic Center, park areas, and transit. The Project is beneficial to the convenience and welfare of the City's residents and visitors, and would improve accessibility to regional transit and local business establishments. As demonstrated in the EIR's analysis, the Project would not cause impacts that are detrimental to the health and/or welfare. SECTION 2: The City hereby approves the Use Permit (UP 2013-02) Application for the Proj ect. SECTION 3: The documents and materials that constitute the records of proceedings on which this Resolution has been based are located at the Community Development Department, City of Azusa City Hall, 213 East Foothill Boulevard, Azusa, California. A REQUEST TO CERTIFY AN ENVIRONMENTAL IMPACT REPORT (EIR) AND APPROVE USE PERMIT AND DESIGN REVIEW APPLICATIONS TO PERMIT THE CONSTRUCTION AND USE OF A 38 -FOOT HIGH, THREE-STORY PARKING STRUCTURE (INTERMODAL PARKING FACILITY) WITH ROOFTOP PARKING, CONTAINING 550 PARKING SPACES, FOR USE BY THE PUBLIC AND GOVERNMENT AGENCIES ('PROJECT'). THE PROJECT IS GENERALLY LOCATED ON PROPERTIES NORTH OF 213 E. FOOTHILL BOULEVARD, EAST OF AZUSA AVENUE, WEST OF ALAMEDA AVENUE AND APPROXIMATELY 100 FEET SOUTH OF 9T" STREET. The Parties, Foothill Transit, METRO, and City of Azusa, shall negotiate an agreement to share equally, on a per parking space basis, in the expenses for normal maintenance of the parking structure. Such consent shall be in writing in a formal maintenance or shared use agreement and presented to the City Council for approval prior to issuance of the certificate of occupancy. 2. Foothill Transit buses shall not make right hand turns on 9th street from Alameda Avenue, 3. Prior to issuance of final building plans, a construction site plan will be presented to the City Council which includes signage listing a 24-hour contact number for complaints. 4.
