A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
APPROVING GENERAL PLAN AMENDMENT NO. GPA -3013-01, TO
ADOPT THE 2014-2021 HOUSING ELEMENT UPDATE AND
AMENDMENTS TO THE INFRASTRUCTURE, CITY DESIGN,
GEOLOGICAL HAZARDS, AND OPEN SPACE AND BIOLOGICAL
RESOURCES ELEMENTS OF THE CITY OF AZUSA GENERAL PLAN
WHEREAS, State law requires all city and county general plans to include a housing
element, and further requires that the housing element be updated regularly to reflect current
conditions and legal requirements; and
WHEREAS, the City of Azusa has an adopted General Plan which includes a certified
Housing Element adopted by the City Council on December 6, 2010; and
WHEREAS, cities and counties within the Southern California Association of
Governments region are required to have an updated housing element covering the 2014-2021
planning period; and
WHEREAS, the Draft 2014-2021 Housing Element has been reviewed by the State
Department of Housing and Community Development and found to be in compliance with State
Law: and
WHEREAS, State law requires all city and county general plans to include information
pertaining to the infrastructure needs of unincorporated disadvantaged communities, and further
requires that the General Plan be updated to address this information upon the next adoption of
the housing element; and
WHEREAS, State law requires all city and county general plans to include information
pertaining to the flooding hazards, and further requires that the General Plan be updated to
address this information upon the next adoption of the housing element; and
WHEREAS, the Planning Commission of the City of Azusa, has given notice thereof as
required by law, held a public hearing on September 25, 2013, for a City initiated amendment to
the General Plan, General Plan Amendment No. GPA -2013-01, to adopt the 2014-2021
Housing Element Update and amendments to the Infrastructure, City Design, Geological
Hazards, and Open Space and Biological Resources Elements to comply with SB 244 and AB
162 requirements, which are triggered by the Housing Element adoption; and
WHEREAS, the Planning Commission has carefully considered all pertinent testimony
and the staff report offered in the case as presented at the public hearing; and
WHEREAS, the City Council of the City of Azusa, has given notice thereof as required
by law, held a public hearing on October 21, 2013, for a City initiated amendment to the
General Plan, General Plan Amendment No. GPA -2013-01, to adopt the 2014-2021 Housing
Element Update and related amendments to the Infrastructure, City Design, Geological Hazards,
and Open Space and Biological Resources Elements; and
WHEREAS, the City Council has carefully considered all pertinent testimony and the
staff report offered in the case as presented at the public hearing.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. CEQA: The City of Azusa City Council hereby finds, based on
consideration of the whole record before it, including the City's local CEQA Guidelines and
Thresholds of Significance, the Initial Study and documents incorporated therein, the proposed
Negative Declaration, comments received thereon, and testimony heard at the public hearing, as
follows:
1. Review Period: the City provided a public review period for the Negative Declaration that
was not less than 30 days, commencing on August 23, 2013 and ending on September 23,
2013. During the public review period, the City received three written comments
concerning the Negative Declaration from government agencies. The comment letters did
not identify any new information that was not previously considered in the Initial Study;
and
2. Compliance with Law: That the Initial Study and Negative Declaration were prepared,
processed, and noticed in accordance with the California Environmental Quality Act
(Public Resources Code Section 21000 et seg.), the CEQA Guidelines (14 California
Code of Regulations Section 15000 et seg.) and the Local CEQA Guidelines and
Thresholds of Significance adopted by the City of Azusa; and
3. Independent Judgment: That the Negative Declaration reflects the independent judgment
and analysis of the City; and
4. No Significant Effect: There is no substantial evidence that the proposed project will
have a significant effect on the environment.
5. The City Council hereby approves said Negative Declaration.
SECTION 2. GENERAL PLAN: The City Council hereby finds that the General Plan
Amendment is compatible with the objectives, policies, and general plan land use programs
specified in the General Plan for the City of Azusa in that:
1. The City of Azusa has officially adopted a General Plan.
2. The goals, policies, and programs in the Draft 2014-2021 Housing Element are
compatible with the objectives, policies, general land uses, and programs specified in the
General Plan. No new policy changes are proposed as part of the amendments to the
Infrastructure, City Design, Geological Hazards, and Open Space and Biological
Resources Elements; which are provided for informational purposes and to comply with
State law.
3. The draft 2014-2021 Housing Element and amendments to the Infrastructure, City
Design, Geological Hazards, and Open Space and Biological Resources Elements are
internally consistent and are consistent with the other elements of the General Plan
because the information provided, as well as the goals, policies, and programs are
interrelated and are intended to work together.
4. The General Plan Amendment will not adversely affect the public health, safety, and
welfare in that the goals, policies, and programs in the Draft 2014-2021 Housing Element
are consistent with the other elements of the General Plan, including but not limited to the
Land Use Element.
SECTION 3. DEVELOPMENT CODE: That in accordance with Section 88.51.080 of
the Azusa Municipal Code, the City Council hereby approves and adopts said General Plan
Amendment based on the following findings:
A. That the proposed amendment is in the public interest, and there will be a
community benefit resulting from the amendment;
The proposed Housing Element Update is in the public interest and
will benefit the community by encouraging the City's participation
in programs that provide home ownership opportunities for
families; facilitating the development of housing for all income
levels, including very low-, low-, moderate-, and above moderate -
income levels for the 2014-2021 planning period The Housing
Element Update identifies housing goals and policies to address
the city's fair share of the regional housing needs, while
encouraging improvement and enhancement of existing residential
neighborhoods throughout the city. The proposed amendments to
the Infrastructure Element provide data on unincorporated areas
for planning and informational purposes. The proposed
amendments to the City Design, Geological Hazards, and Open
Space and Biological Resources Elements provide up -to -dale
information on _/food hazards in the City, and further community
benefit based on this knowledge for better planning efforts.
B. That the proposed amendment is consistent with the other goals, policies, and
objectives of the General Plan:
The proposed Housing Element Update is consistent with the
goals,, policies, and objectives of the current General Plan in that
it encourages a balanced approach to meeting housing needs that
include both owners and renters and emphasizes maintaining and
enhancing the quality of existing housing and residential
neighborhoods in the city. The Housing Element is internally
consistent with other land use goals and policies of the General
Plan, and maintains specific goals and policies that are aimed at
maintaining and improvingAzusa's established neighborhood. The
proposed amendments to the Infrastructure Element are consistent
with other sections of the General Plan and provide additional
information on unincorporated areas. The proposed amendments
to the City Design, Geological Hazards, and Open Space and
Biological Resources Elements are consistent with each other and
existing sections of the General Plan, the General Plan was
reviewed as part of the amendment drafting to ensure consistency.
C. That the proposed amendment will not conflict with the provisions of the
Development Code, subdivision regulations, or any applicable specific plan;
The proposed Housing Element Update contains goals, policies, and
implementation programs related to the development and rehabilitation of
housing throughout the City, that are consistent with the current
Development Code ordinance, subdivision regulations, and existing
specific plans. The proposed amendments to the Infrastructure, City
Design, Geological Hazards, and Open Space and Biological Resources
Elements would not conflict with development regulations, as they are
intended to be for informational purposes and do not propose any land use
or policy changes.
D. In the event that the proposed amendment is a change to the Land Use policy
map, that the amendment will not adversely affect surrounding properties:
The proposed General Plan Amendment does not include a change
to the Land Use policy map.
SECTION 4: Based on the aforementioned findings, the City Council does hereby
approve the 2014-2021 Housing Element and proposed amendments to the Infrastructure,
City Design, Geological Hazards, and Open Space and Biological Resources Elements
(General Plan Amendment No. GPA -2013-01).
SECTION 5: The City Clerk shall certify to the adoption of this resolution.
