A RESOLUTION OF THE CITY COUNCIL OF THE CITY OFAZUSA,
CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE
LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE
OF CALIFORNIA TO ACCEPT, ON BEHALF OF SAID DISTRICT, THE
TRANSFER AND CONVEYANCE OF THE STORM DRAIN
IMPROVEMENTS KNOWN AS MISCELLANEOUS TRANSFER DRAIN
NO. 1761 IN THE CITY OF AZUSA FOR FUTURE OPERATION,
MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE
TRANSFER AND CONVEYANCE THEREOF
WHEREAS, on May 27, 2004 the City of Azusa approved the entitlements for a planned
community named Rosedale, for which new storm drain facilities were subsequently constructed,
and
WHEREAS, a portion of said new storm drain facilities comprises a new storm drain known
as L.A. County Miscellaneous Transfer Drain (MTD) No. 1761 situated within the rights of way of
Monrovia Drive and Citrus Avenue in the City of Azusa; and
WHEREAS, the design and improvements of said storm drain extension have been approved
and inspected by the Los Angeles County Department of Public Works, which plans are on file with
the Director of Public Works for the County Los Angeles; and
WHEREAS, the City is authorized and empowered to transfer and convey to the Los
Angeles County Flood Control District (hereinafter referred to as District) any storm drain
improvements and drainage systems for future operation, maintenance, repair, and improvement;
and,
WHEREAS, the best public interest will be served by transfer and conveyance of said storm
drain improvements and drainage system from the City to the District for future operation,
maintenance, repair, and improvement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1: The City does hereby request that the District accept the transfer and
conveyance of the storm drain improvements and drainage system known as Miscellaneous Transfer
Drain (MTD) No. 1761 in the City of Azusa.
SECTION 2: Subject to the acceptance thereof of the Board of Supervisors, the City
Engineer is directed and ordered to prepare all necessary instruments and documents to effectuate
the transfer and conveyance
SECTION 3: The Mayor is authorized and instructed to execute said documents and
other instruments.
SECTION 4: The City Clerk shall certify to the adoption of this resolution.
