HomeMy WebLinkAboutResolution No. 2015-C01RESOLUTION NO. 2015-C1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, UPHOLDING DESIGN REVIEW NO. DR -2014-31 FOR THE DESIGN OF THE WORLD GYM LOCATED AT 485 E. GLADSTONE STREET WHEREAS, on September 24, 2014, World Gym filed with the City of Azusa ("City") an application for Design Review (DR -2014-31) to allow a non -retail fitness center to occupy approximately 35,000 square feet of an existing shopping center ("Proposed Project"), located within the Edgewood District zone at 485 E. Gladstone Street in Azusa ("Project Site"); and WHEREAS, in conjunction with its application, MCS Edgewood Center LLC ("Owner'), the owner of the Project Site, requested and applied to enter into a development agreement with the City governing the Proposed Project; and WHEREAS, a development agreement between the City and Owner is required for World Gym to locate at the Project Site because World Gym's use would exceed the 15 percent limit on non - retail uses in a shopping center, as provided in the Azusa Development Code; and WHEREAS, on December t 0, 2014, the Planning Commission of the City of Azusa held a duly noticed public hearing on the application of MCS Edgewood Center LLC with respect to the requested Design Review DR -2014-31 with respect to the requested World Gym Development Agreement, located at 485 E. Gladstone Street; and WHEREAS, the Planning Commission, after having carefully considered the staff report offered in the case as presented at the public hearing and all pertinent testimony, adopted Resolution 2014-25 approving Design Review DR -2014-31 with conditions of approval, including Condition E.9 & E.10, requiring World Gym, to submit a security plan and to post name and number of management company in visible locations; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: Pursuant to, and in compliance with, the California Environmental Quality Act ("CEQA") (Public Resources Code section 21000 et seq.), the Proposed Project is considered categorically exempt from environmental review under CEQA pursuant to Section 15301, Class 1— Existing Facilities, which includes the operation, repair, maintenance, pennitting, leasing, licensing, or minor alteration of existing public or private structures, and facilities. The Proposed Project is consistent with the General Plan and Zoning Code, and the Proposed Project would not result in any significant effects relating to traffic, noise, air quality or water quality. Moreover, the Project Site has no value as habitat for endangered, rare, or threatened species, and the Project Site can be adequately served by all required utilities and public services. SECTION 2: Based on the entire record before the City Council, all written and oral evidence presented to the Planning Commission and City Council, and the findings set forth in this Resolution, the City Council upholds the Planning Commission's decision to approve Design Review DR -2014-31, subject to the conditions of approval attached hereto. SECTION 3: In accordance with Section 88.51.032 of the Azusa Development Code, based on the entire record before the City Council, and all written and oral evidence presented to the Planning Commission and City Council, the City Council finds as follows: A. The project provides architectural design, building massing and scale appropriate to and compatible with the site surroundings and the community. The architectural design, building massing and scale of the proposed World Gym is compatible with the site surroundings and the community, since the Edgewood District zone is comprised of a wide variety of architectural styles, building heights, and uses. In addition, the project has been conditioned to require an additional tower to provide a symmetrical view of the building. B. The project provides attractive and desirable site layout and design, including but not limited to, building arrangement, exterior appearance and setbacks, drainage, fences and walls, grading, landscaping, lighting, signs, etc. The site layout and design of the proposed World Gym will provide design elements that are consistent with the shopping center located within District zones. The proposed project features a ground floor entrance with an arcade frontage design. This type of building frontage is consistent with the shopping center and achieves the forward design concept that is encouraged by the Development Code in order to achieve more walkable and pedestrian friendly districts. The building massing provides a well -articulated structure and meets the elevation for the zone. The architectural design of the project is a Spanish style with building design elements. Building lighting will further contribute to a project that will enhance the pedestrian walkways. C. Provide efficient and safe public access, circulation and parking. The project meets all of the applicable provisions of the Azusa Municipal Code to accommodate the use and it provides efficient and safe public access, circulation and parking. The Edgewood Shopping Center occupies 155,448 square feet of multi -tenant space with 594 parking spaces. Under Chapter 88.36.050 - Number of Parking Space Required - a multi -tenant center requires I parking space for each 350 ground square feet of floor area. The total required spaces are 444.14 parking spaces. As such, the parking lot provides sufficient amount of parking and circulation. Pedestrian walkways also provide safe pedestrian access from the sidewalk into the shopping center. Page 2 of 4 D. The project provides appropriate open space and landscaping, including the use of water efficient landscaping. The project includes landscaping of all open areas that are not utilized for walkways, driveways, or parking. These landscaped areas are provided along the perimeters of the site. A condition of approval was addressed to ensure that the City's water efficient landscaping requirements are adhered to. The condition of approval requires the landscaping to be brought into conformance with original Landscape plan. E. The project is consistent with the General Plan, any applicable specific plan, development agreement, and/or any previously approved planning permit. Chapter 4 of the Azusa General Plan, titled, "Economy and Community," sets out goals and policies for the City's Corridor zones. Goal I provides, "build and maintain a strong, diverse economy in Azusa." Policy No. 1.5 states that the City provides high-quality, flexible commercial spaces at a competitive price. Goal 10 states the City desires to, "strengthen the retail and commercial base." Policy No. 10.1 supports that goal by providing that the City endeavors to address key gaps in retail and commercial services, and Goal 11 states, "create a unique place with high quality of life for all its residents." The proposed development will utilize a tenant space in the Edgewood shopping center, which has stood vacant since 2012, as the City's building permit records show. The proposed World Gym will provide a small section of commercial space, while providing an alternative, non -retail use to strengthen the commercial shopping center for residents of Azusa. There is no specific plan or previous planning permit for this project or project site. There is a development agreement associated with this project. F. The project complies with all applicable requirements of the Development Code, and any other adopted City design standards, guidelines, and policies. The proposed development meets all of the applicable standards of the Edgewood District zone in which it is located. As proposed, the World Gym complies with the required setbacks, design, and parking, as shown in the Development Code Compliance Table, included above. In addition, the proposed structures are consistent with the massing and scale guidelines of the Development Code. SECTION 4: In accordance with City of Azusa Municipal Code Section 88.50.080 and based on the staff report and other such written and oral evidence, as presented to the City Council regarding the Design Review, the City Council finds and determines that the Design Review shall not be effective unless and until the effective date of Code Amendment No. 236 and World Gym Development Agreement. SECTION 5: The City Clerk shall certify to the adoption of this resolution.
