The City Council of the City of Azusa met in regular session at the above time and place._ Present at roll call: Councilmen: Owens, Lamm, Bradshaw, Morden, Malone, City Attorney Tscharner, ROLL CALL and City Clerk. Each member present acknowledged receipt of a written copy of the minutes ofthe regular meeting of August 16, 1943. The Mayor asked if there were any objections or corrections of said minutes. There being none, the minutes of August ' 16, 1943, were approved as written.. The members of the Comision Honorifica Mexicana requested permission to have a dance ..n the Parroquial Hall on September 16th, 1943. It wad unanimously agreed the matter be referred to the Chief of Police with power to act. Carried by the followig vote of the Couijcil: Ayes: Councilmen: Owens',, Lamm, Bradshaw, Morden, Malone. Noes: None. Absent: None. A communication signed by 0. T. Cooley, Road Commissioner for Los Angeles County, relative to post war construction projects, was read. Moved by Councilman 1dorden, seconded by Council- man Lamm, this matter be referred to the City Engineer to report back at the next regular meeting.of Council. Carried by the following vote of the Council: Ayes: Councilmen: Owens, Lamm, Bradshaw, Morden, Malone. Noes: None. Absent: None. A petition requesting the improvement of the alley ' between Azusa and Alameda, and north of 10th Street, was offered. This matter was referred to the Street Superintendent. A letter from Don H. Hartwell, Southern California Representative for Ninth Civilian Defense Region stating that Chief Williams is bonded as Local Property Officer for the Community of Azusa; and bond is still in effect, was read. Moved and carried same be -:placed on file. Councilman Morden offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, LEVYING TAXES AND FIXING THE RATE OF ALL PROPERTY IN SAID CITY FOR ALL MUNICIPAL PURPOSES, AND TO PAY THE BONDED INDEBTEDNESS AND INTEREST ON SAME FOR THE FISCAL YEAR 1943-1944. Moved by Councilman Lamm, seconded by.Council- man Owens, this Resolution be adopted as read:and numbered R solution No. 1805. Carried by°the following vote of the Council: Ayes: Councilmen: Owens, Lamm, Bradshaw, Morden, Malone. Noes: None. Absent: None. City Attorney Tscharner reported that in his opinion the City should refund to the Azusa Rock and Sand Company $118.20 representing the 1942 tax collected on concrete mixers mounted on trucks which are subject to the State Vehicle License Tax, and not a Personal Property Tax. the authority for this opinion given by the District Court of Appeals, Second Appelate District, California Court Case # 13775. Moved by Councilman Bradshaw, seconded by Council- man Lamm, the Clerk be authorized and instructed to refund $118.20 to the Azusa Rock and Sand Company. REFUND TO AZUSA ROCK AND SAND CO. 500 Carried by the following vote of'the Council: Ayes: Councilmen: Owens, Lamm, Bradshaw, Morden, Malone. Noes: None. Absent: None. Moved'by Councilman Bradshaw, seconded by Council- man Lamm the following requisitions be allowed: • 1644-1645-1646-1647-1648-1649-1650-1701-1710-1711. Carried by the following vote of the Council: Ayes: Councilmen: Owens, Lamm, Bradshaw, Morden, Malone. Noes: None. Absent: None.
