Present at roll call: Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm, City Attorney Tscharner and City Clerk. Absent: None. Each member present acknowledged receipt of a written copy of the minutes of October 2, 1944. The Mayor asked if there were any objections or corrections to said minutes. 1 Mr. John Kerns Bennett beim present offered the following objection to the minutes: 1st. Mr. Bennett urged that the langua,;e of the min- utes to the effect that the "Building permit issued to the Azusa Rock_ and Sand Company be denied, be correct- ed by substituting the word "revoked" instead of "denied". 2nd. That the minutes be corrected by inserting there- in the full request which had been presented to Council in writing, as follows: 1. That its resolution number 1840, dated Sept- ember 18, 1944, reference to which is hereby made for full particulars, be, and it is hereby, res- cinded. 2. That the building permit heretofore issued by the City of Azusa on September 26, 1944, to the Azusa Rock and Sand Company, be, and it is hereby revoked. 3. That the City Planning Commission of the City of Azusa be directed to make a full and complete ' investigation concerning the legality of the operations of Azusa Hock and Sand Company in the City of Azusa and report to this Council and make public its findings. 4. That said commission have the benefit of legal advice by qualified counsel who do not have an interest in said company, directly or indirect- ly, and who do not represent and have not re- presented said company, directly or indirectly. 3rd. That the language of the minutes to the effect ' that the "City Clerk be instructed to write the Azusa Rock and Sand Company notifying them that an invest- igation as to the legality of the building permit issued them, and the legality of their acts under Resolution No. 1840 are in progress." be changed to read "That the City Clerk be instructed to write the Azusa Rock and Sand Company notifying them that an investigation as to legality of the building permit issued them, and the legality of their acts under Resolution No. 1840 are in progress and that any action they take in the :natter would be on their own, responsibility." ' After hearing Mr. Bennett it was moved by Councilman D4emmeshei.mer, seconded by Councilman Morden that the minutes of October 2, 1944 be approved with the following corrections: That paragraph of the minutes describing the matter on which John Kerns Bennett addressed Council, be corrected so as to show that Itir. Bennett had urged that the building permit theretofore issued to the Azusa Rock and Sand Company be "revoked", rather than "denied" and further that the minutes be correct- ed by inserting therein the full request which had been made in writing as follows: 7:30 P.t% 133 ROLL CALL MR. Councilman Morden offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA REPEALING ORDINANCE NUMBER 372 OF SAID CITY OF AZUSA. to be placed upon its second reading. Moved by Councilman 14errmesheimer, seconded by Council- man Jumper, Council waive the further reading of this Ordinance. ' Carried by the following vote of the Council: Ayes: Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm. Noes: None. Absent: None. Moved by Councilman Morden, seconded by Councilman Memmesheimer this Ordinance be adopted as read and numbered Ordinance No. 378. Carried by the following vote of the Council: Ayes: Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm. Noes: None. Absent: None. Councilman Jumper offered an Ordinance entitled: AN ORDINANCE RELATING TO UNSAFE BUILDINGS, SOAKING UNSAFE BUILDINGS A NUISANCE, PROVIDING FOR THE REPW AL AND DEMOLITION OF SUCH BUILDINGS ARID THE ABATEMENT OF NUISANCES AND PROVIDING PENALTIES FOR VIOLATIONS OF THE TERMS AND CONDITIONS CF TUTS ORDINANCE. to be placed upon its second reading. Moved by Councilman Owens, seconded by Councilman Jumper, Council waive the further reading of this ordinance. Councilman Morden offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF 1/4 CENT GAS `PAX ALLOCATED FOR STREETS OF MAJOR IIAPORTANCF. 7:30 P.M. 135 ORDINANCE NO. 378 ADOPTED. ORDINANCE NO. 379 ADOPTED. 136 Councilman 1,4orden offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING RESOLU11ON N0. 1828 OF SAID CITY COUNCIL SO FAR AS ZI:E SAME RELATES TO THE SALARY OF J. B. ALEXANDER. RESOLUTION NO. 1844 ADOPTED. Moved by Councilman P-lemmesheimer, seconded by Council- man Jumper this Resolution be adopted as read and numbered Resolution No. 1844. OF THE CITY OF AZUSA AND FIXING HIS SALARY OR COMPENSA- 1845 ADOPTED. TION. Moved by Councilman Morden, seconded by Councilman Jumper this Resolution be adopted as read and number- ed Resolution No. 1845. Council was advised of the death of Mr. Crowley, who was employed as Project Engineer, during the con- struction of the Disposal Plant. CITY CLERK IN - Moved and carried the City Clerk be instructed to write STRUCTED TO WRITE Mrs. Crowley expressing Councils' deep sympathy. MRS CRAWLEY. Moved by Councilman Morden, seconded by Councilman Jumper the City Engineer and members of the Public Works Committee be instructed to check the advis- ability of remodeling and making the necessary add- itions to the Fire Hall and to ascertain the approx- MATTER OF RE- imate cost; and they be authorized to employ such MODELING FIRE technical assistance as they may deem necessary to HALL REFERRED TO enable them to make full report. FUND OF $125.00 This matter was referred to the City Attorney to report back.
