Present at roll call: -Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm, City Attorney and City ROLL CA!,L Clerk. Absent: None. Each member present acknowledged receipt of a written copy of the minutes of November 19, 1945. The Mayor asked if there were any objections or corrections to said minutes. There being none, the minutes of MTNUTES APPROVED November 19, 1945 were approved as written. ' A request, for the establishment of an alley from 11th to 12th Streets in rear of lots facing east on Orange Avenue, offered by A. L. Meier, Paul H. Brecht and REQUEST FOR THE Rollin E. Peirce, was read. EST"BLISHMEN'T OF AN Moved,by Councilman Jumper, seconded by Councilman ALLEY Morden this matter be referred to the City Engineer with instructions to contact as many of the Interest- ed property owners as possible in order to determine where the alley should be established. Councilman Owens offered a Resolution entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, - ACCEPTING TAX DEED EXECUTED BY H. L. BYRAM, TAX COLLECTOR, COUNTY OF LOS ANGELES, PURSUANT TO THE RESOLUTION NO. 1923 PROVISIONS OF CHAPTER 8, PART 6, DIVISION 1 OF THE ADOPTED REVENUE AND TAXATION CODE, CALIFORNIA. Moved by Councilman Jumper, seconded by Councilman Memmesheimer this Resolution be adopted as read and numbered Resolution Number 1923. Carried by the following vote of the Council: Ayes: Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm. Noes: None. Absent: None. Notice No. Two of Intention to Sell City of Azusa own- ed Real Property and Inviting Bids or Offers Therefor was presented. Councilman Owens offered the following Resolution: Dr. Hankins submitted a bid to purchase Parcels B and C being a portion of Lot 66_Sub. #2 Azusa Land and Water Company, also a Bid to purchase Lots 16 and 17 Block A Azusa Heights Tract. DR. HANKIN'S RIDS Council advised Dr. Hankins to withdraw the bids and REJECTED re -bid at a later date. Moved by Councilman Morden, seconded by Councilman Memmesheimer and duly carried the City Clerk be instructed to return the checks submitted with Dr. Hankins Bids. Dr. Hankins being present the Clerk returned checks in amount of $143.00 and 487.50. 'the Councilman Morden offered a Resolution entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ACCEPTING TAX DEEDS EXECUTED BY H. L. BYRAM, TAX COLLECTOR, COUNTY OF LOS ANGELES, PURSUANT TO THE PROVISIONS OF CHAPTER.8, PART 6, DIVISION 1 OF THE RESOLUTION NO.1922 REVENUE AND TAXATION, CODE, CALIFORNIA. ADOPTED Moved by Councilman Owens, seconded by Councilman Jumper this Resolution be adopted as read and number- ed Resolution Number 1922. Councilman Owens offered a Resolution entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, - ACCEPTING TAX DEED EXECUTED BY H. L. Notice No. Two of Intention to Sell City of Azusa own- ed Real Property and Inviting Bids or Offers Therefor was presented. Councilman Owens offered the following Resolution: Q:* CITY HALL, AZUSA, CALIFORNIA, MONDAY, DECEMBER 3, 1945 7:30 P.M. 289 RESOLUTION NO. 1924 RESOLVED, that a copy of that certain Notice entitled "Notice No. Two of Intention to Sell City of Azusa Owned Real Property and Inviting Bids or Offers Therefor.", dated the 3rd day of December, 1945, be placed on file in the Office of the City Clerk of said City for the purpose of identification and reference; and BE IT FURTHER RESOLVED, that the City Council hereby approves said form of notice and does hereby invite bids or offers from the real properties therein described, as therein contemplated; and 'BE IT FURTHER RESOLVED, that the City Council hereby elects to sell said properties as described in said notice by private sale and on the terms and conditions as set forth in said notice; and BE IT FURTHER RESOLVED, that the City Clerk be and she is hereby authorized to instruct to cause.said notice to be published in the official newspaper of said City, to -wit: Azusa Herald and Pomotropic, in the time, form and manner required by law; and BE IT FURTHER RESOLVED, that the said "Notice No. Two of Intention to Sell City of Azusa Owned Real Property and Inviting Bids or Offers Therefor.", which is on file as aforementioned and open to public inspection is hereby referred to and by this reference expressly incorporated herein and made a part hereof. Councilman Morden offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY'* CALIFORNIA AUTHORIZING AN EXCEPTION AND VARIANCE UNDER ORDINANCE #342 AND APPLICABLE TO THAT PART OF LOT 55 SUB. #2 AZUSA LAND AND WATER COMPANY LYINTG NORTH OF PACIFIC ELECTRIC RAILWAY. Moved by Councilman Jumper, seconded by Councilman Memmesheimer this Resolution be adopted as read and numbered Resolution Number 1925. Carried by the following vote of the Council: Ayes: Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm. Noes: None. Absent: None. The Planning Commission offered a map of proposed Tract 13736. Moved by Councilman Jumper, seconded by Councilman Owens this map be referred to the City Engineer to estimate the cost of sewage disposal mains to connect with main laterals and to break down unit costs in each case. The City Engineer to be prepared to report on this matter Monday December 10th at 7:30 p.m. A letter from the Planning Commission recommending Council grant Mrs. Kneiling permission to complete addition to garage at #615 Orange Avenue, was read. Moved by Councilman Morden, seconded by Councilman Jumper the Building Inspector be requested to issue a building permit to Mrs. Barbara Kneiling for alterations to garage building. Carried by the following vote of the Council: Ayes: Councilmen: Owens, Jumper, Memmesheimer, Morden, Lamm. Noes: None. Absent: None. A communication from the Planning Commission relative to Mr. Camirets request to change Lots 46-47-48-49 Block 53 from 4-251 x 1501 lots to 2 lots 50t x 100f and 1 lot 401 x 1001, was read. Moved by Councilman Memmesheimer, seconded -by Council- man Morden this matter be referred to the Planning Commission with the recommendation Mr. Camire be instructed to follow the prescribed procedure in mak- ing such a request. Absent: None. Mr. Bud Latta's request was presented by the Planning Commission with a recommendation that it be granted. Moved by Councilman Morden, seconded by Councilman Memmesheimer Bud Latta of 626 Dalton Avenue be grant- ed permission to operate a welding shop on the southwest corner of Sunset Avenue and Foothill Boulevard in a Zone C-3. Suman, to construct a second story on the present brick store building known as the Arcade Building,was read. Moved by Councilman Memmesheimer, seconded by Council- man Morden and duly carried the City Clerk be authorized and instructed to advise Mr. Suman the City Council feel it would be unwise to build a second story of any material except that specified for a No. 1 Fire Zone. A'request, signed by John A. Armstrong, for permission to install a fruit tree distributing yard on the northwest corner of 5th Street and Cerritos Avenue, was read. Councilman Morden offered p Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, REQIESTING THE STATE LEGISLATURE TO APPROPRIATE $90,0009000 OF STATE SURPLUS FUNDS TO AID CITIES AND COUNTIES IN THE CONSTRUCTION OF ESSENTIAL PUBLIC WORKS. WOOLERY TO THE POSITION OF PATROLMAN AND FIXING HIS SALARY. Moved by Councilman Owens, seconded by Councilman Memmesheimer this Resolution be adopted as read and numbered Resolution Number 1927. Robinson, City Auditor, relative to the Police and Fire Department Budget, was read and ordered placed on file. Moved by Councilman Memmesheimer, seconded by Council- man Jumper the Auditor be authorized to correct the 1945-46 Budget to meet the requirements of the Police and Fire Departments. CLAP? #508052 filed December 3, 1945. The document handed ADDRESSED City Attorney Miller was not intended as service and COUNCIL that no releif is sought or would be taken against 216.25 the City of Azusa or any of its claims in or to the 10022 property involved.
