HUNT, CHIEF OF POLICE DATE: MAY 15, 2017 SUBJECT: APPROVE PURCHASE OF THIRTY SEVEN (37), CONDUCTED ENERGY DEVICES (TASER) SUMMARY: As part of the ongoing Conducted Energy Device (CED) management program (commonly referred to as TASER Program) at the Azusa Police Department, CED’s are retired out of the inventory when appropriate and deemed necessary. The Police Department is currently in need of retiring thirty seven (37) CED’s. The Police Department needs to purchase thirty seven (37), Model X26P, CED’s to replace the older Model X26. The purchase will be made from Axon Enterprise, Inc.. The purchase of these replacement devices will occur through the participation in the TASER 60 purchase plan which disperses payment over five (5) years. The proposed action, approves the purchase of thirty seven CED’s from Axon Enterprise, Inc. through the TASER 60 purchase plan in an amount not to exceed $49,602.15 RECOMMENDATION: Staff recommends that the City Council take the following actions: 1) Waive the competitive bidding process due to sole source as authorized under Azusa Municipal Code Section 2-520(b); and 2)Approve the purchase of thirty seven CED’s from Axon Enterprise, Inc. through the TASER 60 purchase plan in an amount not to exceed $49,602.15; and 3) Authorize the City Manager to execute the TASER 60 purchase plan, in a form acceptable to the City Attorney, on behalf of the City. APPROVED CITY COUNCIL 5/15/2017 Purchase of CED May 15, 2017 Page 2 DISCUSSION: Each year, the Police Department budgets to replace aging CED’s. This year’s replacement needs involves replacing thirty seven (37) CED’s from the inventory. The CED’s to be removed from the inventory are beyond the warranty, no longer manufactured or supported and/or in need of retirement from field deployment. The replacement of these aged devices will provide safe, reliable and up-to-date equipment for patrol officers and other public safety personnel. Under Section 2-520(b) in the Azusa Municipal Code, when the City determines that only one vendor “with singular characteristics or performances capabilities” can provide “unique commodities or services” to the City, the purchase of those commodities is deemed a “sole source” purchase and is exempt from the City’s competitive bidding requirements. Axon Enterprise, Inc. (formerly known as TASER International, Inc.) is a sole authorized distributor for TASER Brand CED's (Attachment 2). The TASER 60 purchase plan will allow the Police Department to replace the thirty seven (37) aged CED’s within its inventory, take receipt of the new and updated devices at the time of purchase, and spread the payment over five (5) years. The TASER 60 purchase plan agreement has been reviewed and approved as to form by the City Attorney. FISCAL IMPACT: Payment for this purchase will be dispersed across five (5) fiscal cycles. During fiscal year 2016/2017, the cost will be $10,530.15. The following four (4) fiscal years payments will be $9,768.00 per year for a total not to exceed $49,602.15 for all payments. The final payment will fall in FY 2020/2021. There are adequate funds available to initiate this purchase using the fiscal year 2016/2017, Police Lease Payments (TASER), account #10-20-310-000-6850.
