HomeMy WebLinkAboutMinutes - November 4, 1946 - CCCITY HALL, AZUSA, CALIFORNIA, MONDAY, NOVEMBER 4, 1946 7:30 P.M45 The City Council of the City of Azusa met in regular session at the above time and place. Present at roll call: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm, City Attorneys Miller ROLL CALL and Tscharner, and City Clerk. Absent: None. Each member present acknowledged receipt of a written copy of the minutes of October 21, 1946. The Mayor asked if there were any objections or corrections to said minutes. There being none, the minutes of October 21, 1946, were approved as written. Mr. Bowers, representing the Assets Reconstruction Corporation, addressed Council relative to the re- dmlption of all the delinquent lots in Tract No. 6507. Mayor Lamm suggested to Mr. Bowers that he meetwith City Attorneys Tscharner and Miller and Special Attorney John F. Bender, to discuss this matter further. The Clerk announced that she had received two bids in answer to Notice calling for bids on the sale of property described as a portion of Lot 68 of Subdivision No. 2, Azusa Land and Water Company. Moved by Councilman Memmesheimer, seconded by Councilman Malone, the bids be now opened,. examined and publicly declared: MINUTES APPROVED MR. BOWERS, REP- RESENTING ASSETS RECONSTRUCTION CORPORATION BIDS ON PORTION OF LOT 68 OF SUB NO. 2 AZUSA LAND & WATER CO. JACK BURTON AND GIE NN CALLAHAN "We the undersigned propose to bid the sum of $10,000 for the City property advertized.--" LORETTA E. DELANEY "I make a bid on Lot 68, No. 2, Book 43 Page 94, Book 180 39, Page 310 of $1,367.60, Thirteen Hundred Sixty-seven Dollars and Sixty Cents. Enclose cashiers check for 136.76." Moved by Councilman Malone, seconded by Councilman Memmesheimer,'Council reject all written bids and the City Clerk be instructed to return the check of. $136.76 submitted with Mrs. Delaney's bid. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. City Attorney Tscharner then asked for oral bids from any person desiring to bid on this parcel of land and improvement. Said bids either oral or written were considered by the Council and the following described offer for City owned property was duly and regularly accepted pursuant to the following resolution: RESOLUTION OF THE CITY COUNCIL, CITY OF AZUSA, CALIFORNIA, ACCEPTING BID, QUITCLAIM DEED ONLY, TO CITY OWNED REAL PROPERTY. RESOLUTION NO. 2045 ADOPTED THAT WHEREAS, the City of Azusa is desirous of.selling certain 'parcels of real property heretofore acquired by the City by virtue of tax deeds, in order that the said properties be restored to the tax rolls, and WHEREAS, the City's notice of intention to sell said properties, designated as "Notice No. One of Intention to Sell City of Azusa Owned Real Property and Inviting Bids or Offers Therefor.", has heretofore been duly published, and WHEREAS, did heretofore, pursuant to said published ndtice of Intention to sell, file his written bid with the City Clerk of the City of Azusa to purchase, by quitclaim deed and on a cash basis, the real property hereinafter described, which bid was by the City Council at its meeting held on the 6th day of November, 1946, public- ly opened and declared, and �V CITY HALL, AZUSA, CALIFORNIA, MONDAY, NOVEMBER 4, 1946 WHEREAS, said offer to purchase being made upon the following terms.and conditions: CASH NOW, THEREFORE, IT IS HEREBY RESOLVED, AS FOLLOWS: Section 1: That the offer of John M. Pon to purchase from City of Azusa, upon the terms and conditions as set out in said offer and as above set forth, that certain real property situated within the City and described as follows: That portion of Lot 68 of Azusa Land and Water Company Subdivision No. 2 as per map recorded in Book 43 Page 94 of Miscellaneous Records, in the office of the County Recorder, of said County described as follows: Beginning at the intersection of the northerly line of Foothill Boulevard 100 feet wide with the west line of Sunset Avenue 80 feet wide; thence westerly along said northerly line of said Foothill Boulevard to and along the northerly line of that cer- tain strip described in deed to State of California recorded in Book 18039 Page 310 of Official Records to a point in the southeasterly line of the right of way of the Atchison, Topeka and Santa Fe Railway (A.T.&S.F.) 100 feet wide; thence north- easterly along said southeasterly right of way line to said westerly line of Sunset Avenue; thence southerly along said west line to the point of beginning. be and the same is hereby accepted. Section 2: That the Mayor and City Clerk are hereby authorized and instructed to execute, attest, seal and deliver to said purchaser a quitclaim deed of said parcels of real property. It was unanimously agreed by Council at' -the time of this sale relating to property described as a portion of Lot 68 of Subdivision # 2 Azusa Land and Water Company, sold to Mr. John M. Pon that if a policy of Title Insurance showing Merchantible Title was not obtained he would not be bound by his offer. 7:30 P.M. CC s The Clerk announced that one bid had been received in ONE BID RECEIVED answer to Notice calling for bids on the erection of a ON STEEL BUILDING building suitable to house civic groups. Li Moved by Councilman Memmesheimer, seconded by Councilman Jumper, this bid be now opened, examined and publicly declared. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. ALUMISTEEL COMPANY ' "I/we hereby agree to furnish all labor, materials and equipment for the completion, in a good workmanlike manner, of the work described below: Concrete and erection of one 301 x 601 type # 4 Building as per attached blue print. all for the sum of $5200.00 payable as follows, One third on completion of concrete work; one third on completion of framing and balance on com- pletion of building." CITY HALL, AZUSA, CALIFORNIA, MONDAY, NOVEMBER 4, 1946. 7:30 P.hi"7" Moved by Councilman Memmesheimer, seconded by Council- man Jumper, Council accept the bid of Alumisteel Company for the concrete and erection of one 301 x 601 type No. 4 Building as per attached blue print, and the Mayor RID AWARDED be authorized to execute the contract. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. City Engineer Kressly reported on the bids submitted Mrs. Blatchley asked permission to erect a trailer in answer to Notice calling for bids on an elevated ' steel water tank and tower. REQUEST -TO-ERECT Moved by Councilman Malone, seconded by Councilman Block 14, also on property described as Lot 23 in Memmesheimer, Council accept the recommendation of the City Engineer and award the bid to the Chicago CITY ENGINEER'S Bridge and Iron Works and Fairbanks Morse Company; RECOMMENDATION the City Engineer to draw the form of contract or ON BID FOR WATER exchange letters; the City Clerk to be instructed to TANK ACCEPTED return the check of the unsuccessful bidder. Noes: None. Absent: None. Mr. George Rodecker and Mr. McCauslin came before Council on tax matters. Mr. Earl Halberg discussed the operation of pin ball machines. No action taken in the above mentioned matters. A recommendation, by the Planning Commission, that Council grant the Edison -Company permission to re- EDISON COMPANY move a palm tree located on the north side of Sierra GRANTED PERMISSIOI Madre Avenue, was read. TO REMOVE TREE Moved by Councilman Malone, seconded by Councilman Jumper, Council offer no objection to the removal of this tree if it is inside the city limits. If it is outside the city limits, Council have no jurisdiction in the matter. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. Moved by Councilman Memmesheimer, seconded by Councilman Malone and duly carried, the City Engineer be instructed to take up with Mr. Cooley, Los Angeles -County Road Superintendent, the matter of the County taking over the CITY ENGINEER TO control of Sierra Madre Avenue from the present west CONTACT COUNTY ON boundry line to the east boundry line. SIERRA MADRE AVE. The Planning Commission recommended that George C. Bowman and Ora C. Bowman be granted a zone variance on a portion of Lot 2 Block 12, in the City of Azusa. Councilman Memmesheimer offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AUTHORIZING AN EXCEPTION AND VARIANCE UNDER SECTION 16 OF ORDINANCE NO. 342 AND RESOLUTION NO. APPLICABLE TO THE WEST 55 FEET OF LOT 2 IN BLOCK 12 OF 2046 ADOPTED AZUSA. Mrs. Blatchley asked permission to erect a trailer court on property described as Lots 21-22-23-34 in REQUEST -TO-ERECT Block 14, also on property described as Lot 23 in TRAILER COURT Block 28. It was unanimously agreed the City Clerk REFERRED TO advise Mrs. Blatchley to take this matter up with PLANNING COMMIS - the Planning Commission. ISION. ' Mr. Klauschie, Agent for the Santa Fe -Railroad Com- pany, requested permission to park a trailer on the REQUEST TO PARK right-of-way near the Depot. A communication from the Planning Commission recommending that B. 51. Luckenbill be granted a zone variance from an R-1 to an R-2 zone for the purpose of reestablishing living quarters in the dwelling located at the southwest corner of First Street and Azusa Avenue, was read. Councilman Malone offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AUTHORIZING AN EXCEPTION AND VARIANCE UNDER SECTION 16 OF ORDI- NANCE NO. 342 AND APPLICABLE TO THE RESIDENCE LOCATED ON THE SOUTHWEST CORNER OF AZUSA AVENUE AND FIRST STREET. Moved by Councilman Jumper, seconded by Councilman Nasser, this resolution be adopted as read and numbered Resolution No. 2047. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. Mr. M. K. Spaulding requested permission to build a house and combination garage and guest-house on Lot 20 Block E, Azusa Heights Tract, located in an R-1 zone. The Planning Commission recommended the request for a zone variance be granted provided Mr. Spaulding comply with the boundry lines as set forth in Ordi- nance No. 342. It was resolved by Councilman Nasser, seconded by Councilman Malone, that a variance be granted Mr. M. K. Spaulding for the improvement of Lot 20 Block E, Azusa Heights Tract, in accordance with the blue ptint and recommendation of the Planning Commission. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. Councilman Malone offered an Ordinance entitled: AN ORDIANANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AUTHORIZING AND PROVIDING FOR THE SALE OF THAT CERTAIN PARCEL OF THE CITY OVYNED REAL PROPERTY LOCATED IN BLOCK 29 OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIF- ORNIA, AS PER MAP RECORDED IN BOOK 15 PAGE 93 OF MISCELLANEOUS RECORDS OF SAID COUNTY. be placed upon its second reading. Moved by Councilman Memmesheimer, seconded by Council- man Jumper, Council waive the further reading of this ordinance. SPAULDING GRANTED VARIANCE ORDINANCE NO. 387 ADOPTED I 1 1 CITY HALL, AZUSA, CALIFORNIA, MONDAY, NOVEMBER 4, 1946. A communication from the Omart Investment Company, Ltd. advising Council they are active in the City of Azusa as an Insurance Agency, representing some of the leading insurance companies and requesting they be given con- sideration on the new and renewal business for the City, was read. It was unanimously agreed the City Clerk be instructed to write the Omart Investment Com- pany -advising them Council will be glad to consider their application when policies come up for renewal. A communication from the Bank of America, Azusa Branch, requesting the City to paint angle park- ing strips on Alameda Avenue, south of Foothill Boulevard, was read. Moved and carried this matter be referred to the Street Superintendent with power to act. A communication from the Citrus Union High School requesting permission to hold a dance at the Azusa Woman's Club, was read. Moved and carried this matter be referred to Councilman Memmesheimer. Councilman Memmesheimer offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, DEFINING DUTIES AND FIXING SALARIES OF CERTAIN CITY EM- PLOYEES. Moved by Councilman Malone, seconded by Council- man Jumper, this resolution be adopted as read and numbered Resolution No. 2048.
