The City Council of the City of Azusa met in regular session at the above time and place. Present at roll call: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm, City Attorney Tacharner, Special Attorney Bender ROLL CALL and City Clerk. Absent: None. Each member present acknowledged receipt of a written copy of the minutes of October 20, 1947, The Mayor asked if there were any objections or ' corrections to said minutes. There being none, MINUTES the minutes of October 20, 1947 were approved APPROVED as written. Mayor Lamm asked if anyone present wished to be heard in the matter of the sale of tax deeded property located in Tract 8507. Mr. J. F. Bender reported that a meeting was not JOHN F. BENDS held by the attorneys and Mr. Clapp and therefor REPORT he did not have the terms of escrow to present to Council as he was instructed to do at the last regular meeting of Council. Mr. R. E. Clapp, Mrs. Clapp, Mr. John F. Bender, DISCUSSION Mr. Roscoff, Mr. Albert Miller and Mr. Bower ON TRACT NO. all addressed Council relative to the matter. 8507 After some discussion Mr. Bender made the follow- ing Progress Report: Special City Attorney, John F. Bender, as and for a progress report only, stated the Supreme Court had denied the petition of Assets Recon- PROGRESS struction Corporation, Ltd., a corporation, Vs. REPORT ' Thomas L. Munson, et al., Superior Court No. 509102, which means that the case is final, the Supreme Court upholding the Appelate Court and the Lower Court in its determination that the ordinances of the City of Azusa in respect to terminating right of redemption were, in all respects, valid, and the City had the right to terminate the right of redemption as to the properties involved in said action. Special City Attorney Bender read an offer Re: Tax Deeded properties in Tract 8507, offered by the Azusa Rock and Sand Company, dated November 3, 1947, Councilman Malone offered a resolution as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA ORDERING_A CERTAIN COMMUNICATION DATED NOVEMBER 3, 1947 RESOLUTION SIGNED BY H. E. BENDER, PRESIDENT OF,THE AZUSA NO. 2148 ROCK AND SAND COMPANY PLACED ON FILE. ADOPTED RESOLVED, that that certain communication dated O-M�v-4 Ao the 3rd day of November, 1947, signed by H. E. Bender, President, and directed to the City ' Council in reference to the purchase and sale of tax deeded properties in Tract 8507, be placed on file in the office of the City Clerk for identification and reference and incorporated herein as fully as though set forth at length; and BE IT FURTHER RESOLVED, that the terms and conditions as set forth therein are hereby approved by the City Council and accepted by this Council on behalf of the City; and BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and instructed to deposit the certified check in the sum of $300356.66 accompanying said communication, in the SPECIAL TAX DEEDED FUND. 7SGE? _ _ _ CITY HALL, AZUSA, CALIFORNIA. Councilman'Memmesheimer offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AUTHORIZING THE PURCHASE OF TAXDEEDS FROM THE COUNTY TAX COLLECTOR, COUNTY OFLOSANGELES, AS DESCRIBED IN AGREEMENT 384, AND AUTHORIZING THE ISSUANCE OF A WARRANT FOR THE PAYMENT THEREOF. Moved by Councilman Jumper, seconded by Council- man Malone this resolution be adopted as read and numbered Resolution No. 2149. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. Moved by Councilman Jumper, seconded by Council- man Nasser the following bills be allowed and warrants ordered drawn upon the Treasury for the same. (Bills on last page.) Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm, Noes: None. Absent: None. Moved by Councilman Jumper, seconded by Council- man Nasser and duly carried the following ' requisitions be allowed: 856-866 LW,2507-2518. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm, Noes: None, Absent: None. Houston A. Snidow presented a copy of an ordi- nance granting to Revel Fanara and John Licause, a franchise to establish and conduct a bus line upon and along certain streets and avenues in the City of Azusa. It was unanimously agreed that this matter be brought up at a later date. Mr. Rufus Ogilvie of the Bank of America addressed Council relative to the parking prob- lem near the bank on the west side of Alameda Avenue. Mr. Suman of the Suman Incorporated located at 528 Alameda Avenue addressed Council relative to a zone variance and further information relative to the sale of pottery seconds at the ' above mentioned address. No action taken in this matter. The matter of storm water damage to property located on south San Gabriel and Angeleno Avenues was presented by Mr. Dvorak; Mr. Thomas and Mr. De Carufel. Moved by Councilman Memmesheimer, seconded by Councilman Jumper this:matter be referred to Councilman Malone, City Engineer Kressly and Street Superintendent Wolfe. RESOLUTION NO. 2149 ADOPTED BILLS REQUEST FOR A FRANCHISE TO BE BROUGHT UP LATER PARKING PROBLEM REFERRED TO STREET SUPERINTENDENT MR. SUMAN RECUEST- ED A BUSINESS LICENSE STORM WATER DAMAGE 7SdEZ INV 10 155; CITY BALL, AZUSA, CALIFORNIA. MONDAY, NOVEMBER 30 1947. 7:30 P.M. Mr. J. M. Borevitz, Manager of the Tip Top Hotel addressed Council relative to the collection of rubbish. REPORT ON COLLECTION Moved and carried same be referred to OF RUBBISH City Attorney. Councilman_ Jumper offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REQUESTING PERMISSION OF THE COUNTY SANITATION DISTRICTS OF LOS ANGELES COUNTY, ' CALIFORNIA TO DISCHARGE SANITARY AND BREWERY RESOLUTION NO. 2150 WASTES FROM THE PROPOSED PLANT OF THE GENERAL ADOPTED BREWING CORPORATION WITHIN THE CITY OF AZUSA INTO THE SYSTEM OF TRUCK SEWERS OF SAID SANITATION DISTRICTS. Moved by Councilman Malone, seconded by Council- man Memmesheimer this resolution be adopted as read and numbered Resolution No. 2150. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamm. Noes: None. Absent: None. A letter of appreciation from Bob Bensinger, Sponsor and Howard Brady, Chairman of the COMMUNICATION ORDERED Industrial Committee, was read and ordered PLACED ON FILE placed on file. A petition for zone variance from an R-3 to an R-4 zone, was presented by E. L. Osborn with a recommendation from the Planning Commission that same be granted. Moved by Councilman Memmesheimer, seconded by ' Councilman Nasser this petition be referred back to the Planning Commission for further study due to the fact that a sketch of the pro- posed improvement did not accompany the petition. Councilman Jumper offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA AMENDING SECTION 13 OF ORDINANCE N0. 392 OF SAID CITY OF AZUSA, ENTITIZ D,."AN ORDINANCE OF THE CITY COUN- CIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA IMPOSING A LICENSE TAX FOR THE PRIVILEGE OF SELLING TANGIBLE PERSONAL PROPERTY AT RETAIL, PROVIDING FOR PERMITS TO RETAILERS AND FOR THE COMPUTATION, COLLECTION AND PAYMENT OF SUCH TAX, AND PRESCRIBING PENALTIES.FOR VIOLATIONS HEREOF," PASSED THE 17th DAY OF FEBRUARY, 1947. _ to be placed upon its second reading. OSBORN'S REQUEST FOR ZONE VARIANC REFFRRED TO PLANNI14G COM- MISSION ORDINANCE NO. 394 ADOPTED 7SaEZ w UM 157 CITY HALL, AZUSA, CALIFORNIA. MONDAY, NOVEMBER 3, 1947. 7:30 P.M. A Notification of Alcoholic Beverage License Application from the State Board of Equaliza- tion for Off Sale Beer and Wine by Royce, Arthur F. at 777 N. Vernon Ave., was read. APPLICATION FOR Moved and carried this matter be referred to LIQUOR LICENSE the Chief of Police. REFERRED TO CHIEF OF POLICE Moved by Councilman Memmesheimer, seconded by Councilman Jumper the Chief of Police be authorized and directed to attend the Gover- ' norts Conference on Crime and Juvenile Justice at Sacramento on November 17-189 1947. The City to pay the necessary expenses and the Chief to make the trip to Sacramento in City equip - men t. Councilman Malone reported that the large eucalyptus trees on West First Street had been destroyed and should be removed. Moved and carried that this matter be referred to Councilman Malone and Street Superintendent Wolfe. Councilman Malone offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA EMPLOYING J. A. FITZGIBBONS AS.WELDER IN THE WATER DEPARTMENT OF THE CITY OF AZUSA AND FIXING HIS SALARY. Moved by Councilman Jumper, seconded by Council- man Memmesheimer this resolution be adopted as read and numbered Resolution No. 2051. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Jumper, Memmesheimer, Malone, Lamin. Noes: None. Absent: None. Moved by Councilman Jumper, seconded by Council- man Memmesheimer the matter of purchase of venetian blinds for the auditorium be referred to Councilman Nasser and Malone, with power to act. Carried by the following vote of the Council: Ayes: Councilmen: Jumper, Memmesheimer, Lamm. Noes: Councilmen: Nasser and Malone. Absent: None. Councilman Memmesheimer offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, a PROVING AGREEMENT BETWEEN THE CITY OF AZUSA AND STRUCTU- RAL ENGINEERING COMPANY AND AUTHORIZING THE MAYOR TO SIGN THE SAME AND THE CITY CLERK TO ATTEST IT. ' Moved by Councilman Nasser, seconded -by Council- man Jumper this resolution be adopted as read and numbered Resolution No. 2052. Moved by Councilman Jumper, seconded by Council- man Memmesheimer the City Clerk be authorized and instructed to advertise for bids on 1000 meters; the bids to be opened November 17, 1947.
