BUTZLAFF, ICMA-CM, CITY MANAGER FROM: DANIEL BOBADILLA, P.E., DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE: JUNE 5, 2017 SUBJECT: AWARD A CONTRACT FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) SIDEWALK AND ADA IMPROVEMENTS PROJECT NO. 601804-16 SUMMARY: On April 17, 2017, the City Council authorized Staff to solicit a Notice of Inviting Bids for the CDBG- funded Sidewalk and ADA Improvements Project. Sealed bids were received on May 17, 2017. The proposed action awards a contract to Martinez Concrete, Inc. as the lowest responsible, responsive bidder for the Sidewalk and ADA Improvements Project No. 601804-16. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1) Reject the low bid from All Cities Engineering for submitting an incomplete bid package and being non-responsive; and 2) Award a contract for a total not-to-exceed amount of $165,374, which includes a 10% contingency for potential change orders as needed, to Martinez Concrete, Inc. for the Sidewalk and ADA Improvements Project No. 601804-16; and 3) Authorize the City Manager to execute a contract, in a form acceptable to the City Attorney, on behalf of the City. DISCUSSION: The proposed sidewalk improvements will improve pedestrian safety by repairing approximately 3,680 square feet of existing sidewalks that may inhibit pedestrian access or do not comply with the latest Americans with Disabilities Act (ADA) guidelines. In addition, this project will upgrade 46 existing curb ramps to comply with the latest ADA guidelines. The project will focus on areas of greatest need within the boundaries qualified for CDBG funds. The areas to be addressed are bounded by Foothill Boulevard on th e north, First Street on the south, Azusa Avenue on the west, and Rockvale Avenue on the east (a map is attached for reference). However, the bid was non-responsive as it did not include the required United States Department of Housing and Urban Development (HUD) Section 3 documents, in accordance with the Instructions to Bidders Section of the Contract Documents. The lowest responsible, responsive bid was submitted by Martinez Concrete, Inc., a general engineering construction company which has been in business for over 39 years and has recently completed projects of similar scope in the cities of Arcadia, Grand Terrace, and San Bernardino. ENVIRONMENTAL CLEARANCE: This action is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Sections 15301 (Existing Structures) and 15302 (Replacement or Reconstruction) of the State of California CEQA Guidelines. FISCAL IMPACT: The City has participated in the CDBG Program since its inception in 1974, utilizing these federal funds for various community development projects. In Fiscal Year 2016 -17, CDBG funds totaling $129,675 were allocated to improve sidewalks and curb ramps throughout the City. Additionally, $52,200 in unspent CDBG funds from a cancelled CDBG project increased the project budget from $129,675 to a new total of $181,875. The recommended action awards a contract to Martinez Concrete, Inc. in the amount of $150,340 and further authorizes Staff to amend the contract by 10% for potential change orders for a total not -to-exceed contract amount of $165,374.
