SUBJECT: AWARD A CONTRACT FOR THE FOOTHILL BOULEVARD AND DALTON
AVENUE TRAFFIC SIGNAL INSTALLATION PROJECT – CIP 66117A & B
SUMMARY:
On April 3, 2017, the City Council approved plans and specifications to install a new traffic signal at the
intersection of Foothill Boulevard and Dalton Avenue and authorized Staff to solicit bids. Sealed bids
were received on May 16, 2017. The proposed action awards a contract to Elecnor Belco Electric, Inc.
as the lowest and responsible bidder for the Foothill Boulevard and Dalton Avenue Traffic Signal
Installation Project.
RECOMMENDATION:
Staff recommends that the City Council take the following actions:
1) Award a contract for a total not-to-exceed amount of $387,495.90, which includes a 10%
contingency for potential change orders as needed to Elecnor Belco Electric, Inc. for the Foothill
Boulevard and Dalton Avenue Traffic Signal Installation Project; and
2) Authorize the City Manager to execute a contract with Elecnor Belco Electric, Inc., in a form
acceptable to the City Attorney, on behalf of the City.
DISCUSSION:
Foothill Boulevard and Dalton Avenue is a 4-legged intersection that currently operates as a 2-way stop
control for north and southbound traffic on Dalton Avenue. The proposed project will remove the
existing stop control and convert the intersection into a fully signalized intersection. The traffic signal
will be interconnected with the nearby traffic signals to optimize traffic efficiency.

The lowest, responsive bid was submitted by Elecnor Belco Engineering Inc., a corporation which has
been in business for over 20 years and has recently completed projects of similar scope in several
Southern California cities.
ENVIRONMENTAL CLEARANCE:
This action is categorically exempt from the requirements of the California Environmentally Quality Act
(CEQA) pursuant to Section 15301(f), addition of safety devices.
FISCAL IMPACT:
The recommended action awards a contract to Elecnor Belco Electric, Inc. in the amount of $352,269.00
and further authorizes Staff to increase the contract by 10%, or $35,226.90, for a total not-to-exceed
amount of $387,495.90. The project will be funded with $290,621.92 in Utility Mitigation Funds and
$96,873.98 in proceeds from the 25% developer’s share. The developer of the new commercial building
at the northeast corner of the intersection was conditioned to fund 25% of the intersection
improvements.
The FY2016-17 project budget was originally funded with $132,500 of Utility Mitigation Funds, 25% of
the project costs to be funded with the developer’s share, and $130,000 of Federal STPL Funds. Due to
the extensive process and schedule involved with programming Federal STPL Funds, this funding
source will not be utilized. The proposed recommendations include the elimination of $130,000 in
STPL Funds for this project, and increase the Utility Mitigation budget from $132,500 to $290,621.92.
Staff will process a budget amendment upon Council’s approval.

CONTRACT
THIS CONTRACT is made this day of , 2017, in the County of Los
Angeles, State of California, by and between the City of Azusa, hereinafter called City, and
Elecnor Belco Electric Inc., hereinafter called Contractor. The City and the Contractor for the
considerations stated herein agree as follows:
ARTICLE 1. SCOPE OF WORK. The Contractor shall perform all Work within the time
stipulated in the Contract and shall provide all labor, materials, equipment, tools, utility services,
and transportation to complete all of the Work required in strict compliance with the Contract
Documents as specified in Article 5 below for the following Project:

The Contractor and its surety shall be liable to the City for any damages arising as a result of the
Contractor’s failure to comply with this obligation.
ARTICLE 2. TIME FOR COMPLETION. The Work shall be commenced on the date stated
in the City’s Notice to Proceed. The Contractor shall complete all Work required by the
Contract Documents within 100 working days from the commencement date stated in the Notice
to Proceed. By its signature hereunder, Contractor agrees the time for completion set forth above
is adequate and reasonable to complete the Work.
ARTICLE 3. CONTRACT PRICE. The City shall pay to the Contractor as full compensation
for the performance of the Contract, subject to any additions or deductions as provided in the
Contract Documents, and including all applicable taxes and costs, the sum of
Three Hundred Fifty-Two Thousand Two Hundred Sixty-Nine Dollars ($ 352,269.00). Payment
shall be made as set forth in the General Conditions.
ARTICLE 4. LIQUIDATED DAMAGES. In accordance with Government Code section
53069.85, it is agreed that the Contractor will pay the City the sum of $500 for each and every
working day of delay beyond the time prescribed in the Contract Documents for finishing the
Work, as Liquidated Damages and not as a penalty or forfeiture. In the event this is not paid, the
Contractor agrees the City may deduct that amount from any money due or that may become due
the Contractor under the Contract. This Article does not exclude recovery of other damages
specified in the Contract Documents.
ARTICLE 5. COMPONENT PARTS OF THE CONTRACT. The “Contract Documents”

The Contactor shall complete the Work in strict accordance with all of the Contract Documents.
All of the Contract Documents are intended to be complementary. Work required by one of the
Contract Documents and not by others shall be done as if required by all. This Contract shall
supersede any prior agreement of the parties.
ARTICLE 6. PROVISIONS REQUIRED BY LAW. Each and every provision of law
required to be included in these Contract Documents shall be deemed to be included in these
Contract Documents. The Contractor shall comply with all requirements of the California Labor
Code applicable to this Project.
ARTICLE 7. INDEMNIFICATION. Contractor shall provide indemnification as set forth in
the General Conditions.
ARTICLE 8. PREVAILING WAGES. Contractor shall be required to pay the prevailing rate
of wages in accordance with the Labor Code which such rates shall be made available at Azusa
City Hall or may be obtained online at http//www.dir.ca.gov/dlsr and which must be posted at the
job site.
ARTICLE 9. DECLARATION OF POLITICAL CONTRIBUTIONS. Consultant shall,
throughout the term of this Agreement, submit to City an annual statement in writing declaring
any political contributions of money, in-kind services, or loan made to any member of the city
council within the previous twelve-month period by the Consultant and all of Consultant's
employees, including any employee(s) that Consultant intends to assign to perform the Services
described in this Agreement.
