P.M.
The City Council of the City of Azusa met
in regular session at the above time and place.
Present at roll call: Councilmen: Nasser,
Ortuno, Memmesheimer, Malone, Jumper, City ROLL CALL
Attorney Tscharner and Deputy City Clerk.
Absent: City Clerk.
Each member present acknowledged receipt
of a written copy of the minutes of
September 19th, 1949. Mayor Jumper asked
' if there were any objections or corrections
to said minutes. There being none, the
minutes of September 19th, 1949, were approv-
ed as written.
A letter from Cornelius Smith, Secretary of
the Azusa City Planning Commission was read
regarding a zoning variance requested by
the Lutheran Church.
Councilman Malone offered a resolution en-
titled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA,
AUTHORIZING AN EXCEPTION AND VARIANCE UNDER
ARTICLE 19 OF ORDINANCE NO. 409 OF THE CITY
OF AZUSA, AND APPLICABLE TO A PORTION OF
LOT 2 IN TRACT NO. 5115.
Moved by Councilman Malone, seconded by
Councilman Memmesheimer that resolution be
adopted as read and numbered Resolution
No. 2348 and that the City Clerk be in-
structed to write a letter to the Lutheran
' Church explaining the flood conditions of
that locality.
Carried by the following vote of Council:

Malone, Jumper.

Mr. Ray Petracek made final report on the
activities of the Slauson Memorial Swimming
Pool, requesting that the pool be closed
because of cool weather. A statement of
receipts and disbursements was then given
Council and a balance of $33.60 turned in
for deposit. 1\
Mr. Petracek also asked Council for per-
mission for a parade throuZh town during the
Scout Roundup on November 6th and 7th. The
matter of traffic control to make the parade
possible was referred to Chief Kendrick with
the request that he contact the State High-
way Department.
Mr. Petracek sale d Council to clarify the
use of the "Scout Hall" and was advised that
it was for the us? of everyone, as far as
possible.
Moved by Mayor Jumper, seconded by Council-
man Memmesheimer that City Clerk be instruct-
ed to write letters of appreciation to Mr.
Ray Petracek as Manager of the Slauson
Memorial Pool and to Mr. Farley Beckett and
associates for their part in making the pool
usable this season.
Council was advised of a gas leak within the

City Hall Buildings and matter was referred
to the Building Inspector for action.
A letter from the Planning Commission to-
gether with a copy of tentative map for
Tract #13791 was offered, recommending
the subdivision by H. J. Leland. City TENTATIVE MAP OF
Clerk was instructed to advise Mr. Leland TRACT NO. 13791
that approval was given on condition that
he meet all requirements of subdivision
ordinance and the City Engineer.
Moved by Councilman Malone, seconded by
Councilman Memmesheimer that Council accept
the recommendation of the Planning Commission,
provided Mr. Leland comply with all require-
ments.

A communication addressed to Harry D. Jumper,
Mayor, from Mrs. Louise Kilmer offering her
resignation from the Park and Recreation
Commission was read.
Moved by Councilman Nasser, seconded by
Councilman Ortuno this resignation be accept-
ed and the City Clerk be instructed to ex-
press the Council's appreciation of services
to Mrs. Kilmer.
Carried by the following vote of Council:

' Mrs. Darris Wimberly was recommended by
Mayor Jumper to replace Mrs. Kilmer.

Council from Mr. Wayne R. Beeman offering
his resignation from the City Planning
Commission was read.

Councilman Memmesheimer this resignation
be accepted and the City Clerk be instruct-
ed to express the Council's appreciation of
services to Mr. Beeman.

Mayor Jumper recommended Mr. Henry Elder
to fill the vacancy left -by Mr. Beeman.

City Attorney Tscharner presented a letter
from the Associated Telephone Company re-
questing permission to erect a pole and
anchor on Angeleno Avenue near Ninth Street.
Moved by Councilman Malone, seconded by
Councilman Ortuno that request be granted.

A communication addressed to Council from
Secretary Smith of the Planning Commission
was read recommending that Mr. Frank T. Tarble

existing trees and replace them with new ones.

Councilman Memmesheimer that Council accept
the recommendation of the Planning Commission.

Mr. Tscharner read a letter from the Division
of Highways in answer to his inquiry regard-
ing a crosswalk across Azusa Avenue about REPORT ON CROSSWALK
145 feet north of the intersection of Foot-
hill Blvd. and Azusa Avenue. The letter
advised that the Division of Highways cannot
' approve said crosswalk.
Councilman Memmesheimer offered a resolution
entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA,
AUTHORIZING AND DIRECTING THE CHIEF OF POLICE
TO ERECT AND MAINTAIN STOP SIGNS AT CERTAIN
STREET INTERSECTIONS IN THE CITY OF AZUSA IN
ACCORDANCE WITH ORDINANCE OF SAID CITY NO. 408.

WHEREAS, Investigation Report No. 6 under the provisions of
the "Special Assessment Investigation, Limitation and Majority
Protest Act of 1931" in the matter of the improvement of Louise
Avenue on both sides of the street between Paramount Avenue and
Broadway formerly known as (Dalton Road) with certain grading,
the construction of Portland concrete curbs and gutters, and
paving the driveway aprons with pre -mix pavement two inches
thick; and the construction of Portland cement concrete side-
walks and also the improvement of Paramount Avenue and Broad-
way at their intersections with Louise Avenue by grading and
the construction of Portland cement concrete curb and gutter,
and Portland cement concrete sidewalks, has been prepared by
the City Engineer and Superintendent of Streets and is presented
herewith; and
WHEREAS, this City Council has examined the same and deems that
the public interest and convenience require the proposed improve-
ment therein provided for in the manner therein set forth:
' NOW THEREFORE, that the said report be and the same is hereby
approved, and the City Clerk is hereby authorized and directed
to file the same in her office and to execute the certificate
therein that said report was approved by this motion; and
That Monday, the 21st day of November, 1949 at the hour of 7:30
o'clock P.M. is hereby fixed as the time and the Auditorium in
the City Hall of the City of Azusa, situated at 213 E. Foothill
Blvd., Azusa, is hereby fixed as the place at which the City Council
of the City of Azusa is hearing the said report, and the City Clerk

of the City of Azusa is hereby directed to mail said notices
of said hearing in the form and manner provided in Division
4, Part 3, of the Streets and Highways Code of the State of

A communication from the'Aazsa City Planning
Commission was read recommending that Mr.
Edward J. Brahan+s request for dividing of
' Lot 71, Tract 13736 be granted.
Moved by Councilman Malone, seconded by EDWARD J. BRAHANIS
Councilman Ortuno that Council accept the REQUEST GRANTED
recommendation of the Planning Commission.

City Attorney Tscharner read a request from
the Associated Telephone Company for an
easement for the construction, maintenance
and operation of a telephone line with poles
and all necessary equipment across a portion
of Lot 4, Block B of Subdivision No. 1 of
Lands of the Azusa Land and Water Co.
Councilman Memmesheimer offered a resolution
entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA, LOS ANGEIE S COUNTY, CALIFORNIA,
AUTHORIZING THE MAYOR ON BEHALF OF THE CITY RESOLUTION N0.2354
OF AZUSA TO SIGN A RIGHT OF WAY EASEMENT IN ADOPTED
THE LAND HEREINAFTER DESCRIBED AND ALSO
DIRECTING THE CITY CIE RK TO ATTEST THE SAME
AND PLACE THE SEAL OF THE CITY THEREON.

A Quit Claim Deed from the City of Azusa to
H. J. Leland was read and Council advised
that it would be the responsibility of Mr.
Leland to have same recorded.
Two petitions were read and filed for Street
Improvements under the 1911 Act for South PETITIONS ON 1911
Sunset Avenue from First Street south to' STREET IMPROVEMENT
the dead end of the street and for Angeleno ACT.
Avenue between Fifth and Sixth Streets.
' Mayor Jumper announced that since the City
must stand the total expense of all pre-
liminary work done, provided the improvement
is discontinued on a protest of a Majorit
of the property owners, Council will not act
on further petitions until after the hear-
ings set for October 31st, 1949.
Mr. Kloepfer of the Azusa Voters Association
asked Council why the City could not improve
all these districts under some other plan
than the 1911 Act. Mayor Jumper replied that

every possible plan would be studied.
Mr. Henderson, 126 S. Angeleno, Asked Council
if any one of the street improvement bids
would have to be accepted or if they may be
rejected. He was advised that the notices
contain provision that Council can reject
or accept any or all bids.
Mr. Owens reported a low place at the
intersection of First Street and San Gabriel
Avenues where water settles and causes a
hazardous traffic condition. The matter
was referred to City Engineer Brooks for
investigation and action.
Council was presented with a petition signed
by the property owners on Duell Street
between Orange and Vernon Avenues asking
that the proceedings of Street Improvements
under the 1911 Act be stopped. Council
ordered the petition filed and instructed
Mr. Hollis D. Critchlow to file an affidavit
to the effect that he personally witnessed
the signatures of the property owners in-
volved. Mr. Critchlow agreed to comply with
their request and Mr. Tscharner was asked
to write resolution accepting the withdrawal
of this group as soon as affidavit has been
filed..
It was moved by Councilman Malone and seconded
by Councilman Memmesheimer that City Attorney
Tscharner be instructed to communicate with
the Los Angeles County Flood Control with
regard to the bridge across the flood control
wash on -Azusa Lane.
