Present: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper. City Attorney Tscharner City Clerk Hynes City Engineer Brooks Superintendent of Streets Wolfe ' Absent: None The City Attorney announced that this is, the time and place set by the City Council at which all protests and objections will be heard under the proceedings for im- provement proposed to be conducted under the Improvement Act of 1911 for the im- provement of certain streets in the City of Azusa. The City Clerk presented to the Council affidavits of mailing of notices of hearing on Debt Limit Report for the following projects: Project No. 1 Project No. Project No. Project No. 5 Upon motion duly made, seconded and unanimously carried, the Council accept- ed said affidavits and ordered them filed. ' The proceedings were taken in the follow- ing order: Project No. 1 Virginia Avenue between Paramount Avenue and Broadway Road (formerly known as Dalton Road). Prior to consideration of protests and objections, the City Attorney read to the Council the report on Fro'ect No. 1 re- quired by the Special asessment Investi- gation, Limitation and Majority Protest Act of 1931. The City Attorney then asked if there was any one present who wished to pro- test the improvement of Virginia Avenue between Paramount Avenue and Broadway Road as set forth in Project No. 1. There were no written or oral protests on Project.No. 1 involving the improve- ment of Virginia Avenue between Paramount Avenue and Broadway Road. Project No. 2 This project was cancelled by action of Council on September 12, 1949, and pro- ceedings started under Project No. 6. Date of hearing was set for November 21, 1949. 17e5 PROCEEDINGS.FOR STREET IMPROVEMENT ACT OF 1911 90CAR 9 CITY HALL, AZUSA, CALIFORNIA, MONDAY, OCTOBER 319 1949 Project No. 3 Angeleno Avenue on both sides of the street between First Street and North line of Lots 3 and 11 of Sub. No. 1 of Lends of Azusa Land and Water Company as per map re- corded in Book 16, pages 17/18 of Miscellaneous Records of Los Angeles County and San Gabriel Avenue on both sides of the street between First Street and the North line of Tract No. 13641 as per map record- ed in Book 328, Page 19 of Maps records of Los Angeles County. Prior to consideration of protests and objections, the City Attorney read to the Council the report on Project No. 3 required by the Special Assessment Investigation, Limitation and Majority Protest Act of 1931. The City Attorney asked if there was any one present who wished to protest the improvement of the streets as set forth in Project No. 3. A petition with fourteen signatures attached thereto, representing 728 feet of frontage (the total being 1240 feet) requesting Council to exclude the construction of concrete sidewalks from the former petition for the improvemet t of Angeleno Avenue between First Street and the North line of Lots 3 and 11 cf Sub. No. 1, Azusa Land and Water Company and requesting the construction of 6 inch Portland cement driveway aprons in place of the 2 inch thick pre -mix pavement as specified under Project No. 3. There were no written or oral protests involving the improvement of San Gabriel Avenue between First Street and the North line of Lots 3 and 11 of Sub. No. 1, Azusa Land and Water Company, included in Project No. 3. The City Attorney then asked if there was anyone present who objected to the modification requested in the petition involving Angeleno Avenue included in Project No. 3. There were no written or oral protests or objections to the granting of the changes requested for the improvement of Angeleno Avenue between First Street and the North line of Lots 3 and 11 of Sub. No. 1, Azusa Land and Water Company. Protect No. 4 Duell Street on both sides of the street between Orange Avenue and Vernon Avenue. A petition filed October 10, 1949, with 22 signatures attached thereto request- ing Council's permission to withdraw this improvement from the proceedings, was presented. 7:30177 P.M. 90CAa CITY HALL, AZUSA, CALIFORNIA, MONDAY, OCTOBER 319 19+9 Councilman Malone offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, GRANTING THE REQUEST THAT PROJECT NO. FOUR BE WITHDRAWN FROM THE PROCEEDINGS FOR STREET IMPROVEMENT OF CERTAIN STREETS. Moved by Councilman Memmesheimer, seconded by Councilman Ortuno this resolution be adopted as read and numbered Resolution No. 23554 Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper. Noes: None Absent: None Pro ect No. Angeleno Avenue on both sides of the street between Second Street and Third Street on the south side of the street between Orange Avenue and Angeleno Avenue. Second Street on the north side of Second Street between the southerly prolongation of the egsterly line of Lot 18 of Tract No. 13736 as er map recorded in Book 275, Pages &}8/50 of Maps records of Los Angeles County and San Gabriel Avenue. The City Attorney asked if there was ' anyone present who wished to protest the improvement of the streets set forth in Projedt No. 5. A written protest with 29 signatures attached thereto was presented, re- questing Council to withdraw their petition for the improvement of the south side of Third Street from Orange Avenue to Angeleno Avenue aid both sides of Angeleno Avenue from Third Street to Second Street. Councilman Malone offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, GRANTING THE REQUEST THAT PROJECT NO. FIVE BE WITHDRAWN FROM THE PROCEEDINGS FOR THE IMPROVEMENT OF CERTAIN STREETS UNDER THE 1911 STREET IMPROVEMENT ACT. Moved by Councilman Malone, seconded ' by Councilman Ortuno that this resolut- ion be adopted as read and numbered Resolution No. 2356.E Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper. Noes: None Absent: None Moved by Councilman Malone, seconded by Councilman Ortuno that Projects No. 7:30179 P.M. RESOLUTION NO. 23551 ADOPTED RESOLUTION NO. 2356- ADOPTED 90CAM _ CITY HALL, AZUSA, CALIFORNIA, MONDAY, OCTOBER 31, 1949 7:30 1 and No. 3 be given further consideration P.M. on November 7, 1949, at 8:30 P.M. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper.
