The City Council of the City of Azusa met in regular session at the above time mid place. Present at roll call: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper, City Attorney, City Berk. Absent: None Each member receipt of minutes of ' Mayor asked jections or There being 17th, 19490 present acknowledged a written copy of the October 17th, 1949. The if there were any ob- corrections to sati minutes. none, the minutes of October were approved as written. Mr. Rolla E. Clapp addressed Council relative to the condition of the streets in Paramount Heights Tract offering an amendment to the petition filed with Council on August 1, 1949. Mr. Clapp also requested a Quit Claim Deed on lot purchased by him in Tract No. 8507. Mr. A. H. Miller, representing the Azusa Rock & Sand Company, addressed Council and presented a petition request- ingcertain streets be vacated in Tract No. 8507. Moved by Councilman Malone, seconded by Councilman Memmesheimer the amend- ment to petition filed by Mr. Clapp be placed on file and the City Attorney instructed to prepare a resolution in form of a quit claim deed to Lot 30, Block 60 Tract No. 8507. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper. Noes: None Absent: None Moved by Councilman Malone, seconded by Councilman Memmesheimer the application of the Azusa Rock and Sand Company be placed on file and the City Attorney instructed to prepare an ordinance de- claring the vacation of certain streets. Noes: Ortuno Absent: None Mr. George Grandstaff introduced Captain Richins of the California National Guard who addressed Council ' relative to the rules and regulations governing the use of the new Azusa Armory of the California National Guard. Thayer appeared before Council requesting permission to operate a restaurant and cocktail lounge at 403 W. Foothill Blvd. Moved by Councilman Memmesheimer, seconded by Councilman Ortuno that the City License Collector be authorized to issue a business license to Mr. Thayer to operate a restaurant and cocktail lounge at 403 W. Foothill Blvd. Carried by the following vote of the Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer, Malone, Jumper. Noes: None Absent: None RESOLUTION NO, 2354 ADOPTED RESOLUTION NO. 2355 ADOPTED RESOLUTION NO. 2356 ADOPTED MR. R. K. THAYER GRANTED BUSINESS LICENSE CITY HALL, AZUSA, CALIFORNIA, MONDAY, NOVEMBER 7, 1949 Mr. Victor C. Jabson of 222 S. Virginia Avenue addressed Council relative to the accumulation of rubbish and tree trimmings on South Virginia Avenue between First Street and Paramount Avenue. It was unanimously agreed that the Police Chief be instructed to make a survey of this condition, securing the names and addresses of the owners of vacant lots where fire menace exist. I The owners to be notified to clean premises; the Fire Dept. to post warn- ings against further violation. Mr. Jabson also requested that a wide curb be placed on the corner of First Street and Virginia Avenue to eliminate accidents. This matter was referred to the Street Superintendent. Mr. George Blazer addressed Council relative to the amendments to the Zon- ing Ordinance. Mr. H. Critchlow thanked Council for the cooperation given those who were en- deavoring to construct their own curbs and gutters. Moved by Councilman Malone, seconded by Councilman Memmesheimer Council ad- journ and continue the adjourned Hear- ing on the 1911 Street Improvement act set for Monday, November 7, 1949, at ' 8:30 P.M. After a period of thirty minutes the meeting was resumed. A Notification of Alaholic Beverage License Applications for Charles Turner, Beer and Wine Wholesalerts and Beer and Wine Importerts and Beer and Wine on Sale was read. No action was taken. The announcement of the Regular Monthly Meeting of the Los Angeles County Division of the League of California Cities, was read, and ordered placed on file. A communication received from L. W. Coffee who lives on the corner of 6th and Azusa Avenues, relative to the con- dition of the parkway and alley, was read. Moved and carried this matter be re- ferred to the Street Superintendent, with power to act. A request from the Associated Telephone Company, Ltd., to place poles and anchors at certain locations, was read. Moved and carried this matter be re- ferred to Supt. V. D. Smith to report back. M. on this day and at this meeting place to continue the hearing on the Debt Limit Reports for Project No. 1, the improvement of Virginia Avenue between Paramount Avenue and Broadway Road (formerly known as Dalton Road) and for Pro ect No. , the improvement of Angeleno venon ue both sides of the street between First Street and on the North line of Lots 3 and 11 of Sub. ' There were no written or oral protests or objections on the proposed improve- ment set forth in the Debt Limit Report onPro ect No. 1 and no one present de- sire o e heard in connection therewith. Councilman Malone offered the follow- ing resolution: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DETERMINING RESULTS OF HEARING; OVERRULING PROTESTS; DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN WORK OR IMPROVEMENT SUBSTANTIALLY AS SET FORTH IN REPORT ON PROJECT FILED UNDER THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 AND DETERMINING THAT SAID IR OJECT IS FEASIBLE. WHEREAS, this City Council has heretofore, on September 12, 1949, by Resolution No. 2339, taken the steps provided by Sections 2821, 2822 and 2823 of the Streets and ' Highways Code of the State of California (said sections being a part of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931) for certain work or improvement consisting of certain proposed grading, construction of drive- ways, curbs and gutters in the City of Azusa, California; and WHEREAS, by said Resolution No. 2339, this City Council directed the City Engineer and the Superintendent of Streets to procure the required information and prepare and present to this City Council the written report on said work and improve- ment required by the Special Assessment Investigation, Limitation avid Majority Protest Act of 1931 as set forth in Division 4, Part 2, Sections 2824 and 2830, inclusive, of said Streets and Highways Code; and WHEREAS, said report has been presented to this City Council and approved aid ordered filed by this City Council; and ' WHEREAS, by motion duly seconded and carried on thel2th day of September, 1949, this City Council fixed a time and place for hearing by it on said report; and WHEREAS, notice of said hearing was mailed as required by said Special Assessment Investigation, Limitation and Majority Protest Act of 1931; and WHEREAS, at the time and place so fixed a 7:30 P.M. 197 RESOLUTION NO. 2357 ADOPTED Mob CITY HALL, AZUSA, CALIFORNIA, MONDAY, NOVEMBER 7, 1949 hearing was duly held by this City Council at which no written protests or objections were presented or read, there having been none filed, and all persons desiring to be heard thereon were heard, and this City Council gave all persons present an opportunity to be heard in respect of any matter relating to said report, said work or improvement, or any of the proceedings therefor; and ' WHEREAS, all persons desiring to appear and be heard were heard at said hearing and said hearing has been closed; and WHEREAS, this is the time and place designat- ed by this City Council for consideration of said report, and this City Council has considered said report and is fully in- formed in the premises; NOW, THEREFORE, the City Council of the City of Azusa DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER as follows: Section 1. That sdd report contains all the matters and things required by law and that notice of hearing on the proposed project generally described therein has been duly and regularly given. Section 2. That no written protest has been filed with the Clerk of this City Council by the owners of one- half of the area of the property to be assess- ed for said proposed work or improvement and that there is no majority protest as provided in Section 2931 of the Streets and Highways Code, against only a portion of said proposed work or improvement. Section 3. That all protests and objections be and the same are hereby overruled and denied. Section 4. That the public interest, convenience and necessity require the work or improvement substantially as set forth in said report, and that the project for said work or improvement is feasible. Noes: None Absent: None ' The City Attorney then announced that this was the time and place set for continuing the hearing on the Debt Limit Report for said Project No. 3 at which all protests and objections will be heard. ' Mr. Arthur D. Kloepfer of 135 S. San Gabriel Avenue, Azusa, California, called attention to the request of property owners on Angeleno Avenue that the proposed improve- ment as set forth in the Debt Limit Report for said Project No. 3 be changed by ex- cluding the construction of cement side- wglks on Angeleno Avenue and the substitut- ion of concrete in place of pre -mix pave- ment for driveway aprons. Mr. Weber then asked whether the granting of the request of Angeleno Avenue property owners would necessitate the commencement of new im- provement proceedings by property owners on San Gabriel Avenue. The Mayor called upon Mr. Franklin T. Hamilton of the legal firm of O'Melveny & Myers, Los Angeles, counsel employed by the City for said street improvement pro- ceedings, to answer the question of Mr. Weber. Mr. Hamilton stated that the grant- ing of the request of property owners on Angeleno Avenue would reduce the estimated cost of the improvement as set forth in the Debt Limit Report by more than 10%, and that in view of certain provisions of the Debt Limit Act there was a possibility that new improvement proceedings would have to be commenced if the request of Angeleno Avenue property owners were granted. How- ever, before giving a definite opinion one way or the other, Mr. Hamilton desired further time to investigate the matter. Upon Motion of Councilman Malone, seconded by Councilman Masser and unanimously carried, the hearing on the Debt Limit Report for said Project No. 3 was continued to the regular meeting of the Council at 7:30 P.M., Monday, November 21, 1949. 7:30201 P.M.
