The City Council of the City of Azusa met in regular adjourned session at the above time and place. Present at roll call: Councilmen: Nasser, Ortuno, Memmesheimer, City Attorney Tscharner, City Engineer Brooks and City Clerk. Absent: Councilman Malone and Street ROLL CALL Superintendent A. Wolfe. The Clerk announced that one bid had been received in answer to Notice Calling for Bids on welded steel water pipe. Moved by Councilman Nasser, seconded by Councilman Ortuno and duly carried the bids be now opened, examined and publicly declared. SOUTHERN PIPE & CASING COMPANY Pursuant to your advertisement for bids for welded steel pipe to be opened at 7:00 P.M. Monday, January 9, 1950, we are pleased to quote as follows: 3500 ft. 811I.D. #10 gauge Automatic Electric Fusion Welded Steel Pipe, double asphaltum dipped & spirally wrapped with 40# Pabco, with ends belled for lapwelding, in 24, 36 or 48 ft. joints, per ft. $1.09 The above price is net f.o.b. truck and trailer Azusa or near vicinity where same can travel under its own power. Delivery of this pipe can be made one week after receipt of the order. Enclosed is a cashiers check in the sum of 0450. which is in excess of the re- quired 10% deposit. Moved and carried the bid be referred to Supt. of Water Dept. for checking. Mr. Smith recommended that Council accept the bid of the Southern Pipe and Casing Company. Moved by Councilman Nasser, seconded by Councilman Ortuno that Council accept the Bid of Southern Pipe and Casing Company. Carried by the following vote of Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer. Noes: None Absent: Councilman Malone. Dr. Cook addressed Council relative to the type of dwellings to be constructed in the new subdivision on North Pasadena Avenue. No action was taken at this time. Mr. C. W. Grandin, Mr. Clyde A. Paige and others addressed Council relative to the ' size of side yards on corner lots in Subdivision No. 15711. The members of the Planning Commission being present, Acting Mayor Memmesheimer requested them to express their opinion in this matter. After some discussion, Mr. Ebersold, Chairman of the Planning Commission, requested permission to retire for further discussion. PAONDAY_ JANTA RY 0. 19K0 7!10 263 P.M. man reported that due to the fact that Ordinance No. 409 does not contain authorization for a set -back on corner lots, it is the recommendation of the Commission that a setback of nine feet and eight inches be permitted in Tract TRACT N0.15711 No. 15711. Carried by the following vote of Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer. Noes: None Absent: Councilman Malone. Councilman Nasser offered an ordinance Ii entitled: U AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA OF LOS ANGELES COUNTY, CALIFORNIA, AMENDING SECTIONS 4.13(C), 413(1) and 4.13(J) OF ORDINANCE N0. 409 ENTITLED: AN ORDINANCE ESTABLISHING A ORDINANCE ZONING AND DISTRIBUTING PLAN WITHIN THE FOR FIRST CITY OF AZUSA CREATING THIRTEEN USE ZONES; READ REGULATING THE USE OF PROPERTY HEIGHT AND ME AREA OF STRUCTURES AND OPEN SPACES FOR LIGHT, AIR AND VENTILATION: ADOPTING A MAP OF SAID ZONES; DEFINING TERMS USED; PROVIDING FOR THE ADJUSTMENT, ENFORCE- MENT AND AMENDMENT THEREOF; PRESCRIBING PENALTIES FOR VIOLATION; AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. to be placed upon its first reading. This ordinance was then read for the first time. The City Attorney announced that this is the time and place set by the City Council for the continued hearing on the Debt ' Limit Report for Project No. 7, the pro- HEARING ON posed improvement of Angeleno Avenue between PROJECT NO. 7 Fifth Street and Sixth Street in the City of Azusa, at which all protests and ob- jections will be heard. The City Clerk presented to the Council affidavits of mailing of notices of hear- ing on Debt Limit Report on Project No. 7. Upon motion duly made, seconded and unanimously carried, Council accepted said affidavits and ordered them filed. Prior to consideration of protest and ob- jections, the City Attorney read to the Council the report on Project No. 7 re- quired by the Special Assessment Investigation, Limitation and Majority Protest Act of 1931. A petition dated December 10, 1949, and one dated January 6, 1950, requesting A petition with eight signatures attached thereto petitioning Council for permission to withdraw the petition for the improvement 7 of Angeleno Avenue between Fifth and Sixth Streets was presented. ' Moved and carried the petition be referred to the City Engineer for checking. City Engineer Brooks reported that there were twenty-four signatures on the original petition; that eight property owners had petitioned Councils permission to withdraw their names, leaving twelve in favot of the improvement. A petition dated December 10, 1949, and one dated January 6, 1950, requesting W, PETITIONS REFERRED FOR CHECILING A petition dated December 10, 191±9, and ? one dated January 6, 1950, requesting the City Council to withdraw previous Petitions regarding the construction of curb gutters and sidewalks on Angeleno Avenue between Fifth Street ` and Sixth Street and to withdraw their names from the proposed assessment issue and leave them free to do their curb gutters and sidewalks under private contract, were presented by certain property owners with- in the proposed assessment district. It was moved and carried that said petitions be referred to City Engineer Brooks for examination. After examination City Engineer Brooks reported that the property owners signing said petitions were not the owners of a majority in area of the land proposed to be assessed. Aaron F. Shank, F. B. Ashley addressed Council. Thereupon A. F. Shank, F. B. Ashley, Roger Sheppard, James Wyatt and Edward L. Voight, who had signed both the petition of December 10, 1949 and the petition of January 6, 1950, orally re- quested that their signatures be with- drawn from said petitions as they wished to go on record as having withdrawn their objections to the improvement. Councilman Ortuno offered a resolution entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DETERMINING RESULTS OF HEARING; OVERRULING PROTESTS; DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN WORK OR IMPROVEMENT SUBSTANTIALLY AS SET FORTH IN REPORT ON PROJECT FILED UNDER THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 AND DETERMINING THAT SAID PROJECT IS FEASIBLE. Moved by Councilman Nasser, seconded by Councilman Ortuno this resolution be adopted as read and numbered Resolution No. 2372. Carried by the following vote of Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer. Noes: None Absent: Councilman Malone Supt. Smith reported on the bids sub- mitted to him for checking, recommend- ing that the Westinghouse Electric Corporation be awarded the bid on 2/0 7 strand copper wire; that Zimco Corp. be awarded the bid on #29 #4 and #6 weather proof copper wire. Moved by Councilman Nasser, seconded by Councilman Ortuno that Council accept the recommendation of the Water Supt., and the City Clerk be instructed to return to the unsuccessful bidders the bid checks submitted with their bids. Carried by the following vote of Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer. Noes: None Absent: Councilman Malone The City Clerk announced that no bids had been received in answer to the notice inviting bids on meters and valves. Moved by Councilman Nasser, seconded by Councilman Ortuno that the Supt of Water Dept, be authorized to purchase the necessary meters and valves in the open market. Carried by the following vote of Council: Ayes: Councilmen: Nasser, Ortuno, Memmesheimer.
