Present at Roll Call: Councilmen: Ortuno, Malone, Memmesheimer, City Attorney Tscharner, City Engineer Brooks, Street Supt. Wolfe and Deputy City Clerk. Absent: Councilmen: Nasser, Flannery and City Clerk. Each member present acknowledged re- ceipt of a written copy of the minutes of April 3, 1950 and the adjourned meeting of April 10, 1950. The Mayor asked if there were any objections or corrections to said minutes. There being none, the minutes of April 3, 1950 and April 100 1950 were approved as written. Alfred M. Rulofson, Auditor for the City of Azusa, presented Council with the regular'quarterly examination of the accounts and records of the City, a tabulated statement of Condition of Funds, and a statement of Receipts and Disbursements. Council requested Mr. Rulofson to pre- pare a report for publication. Councilman Flannery entered the meeting and took his seat at the Council table. Mayor Memmesheimer announced that this Is the time and place fixed by this ' Council for hearing objections or protests on the proposed work, or the extent of the assessment district, or on the proposed grades under the Resolution of Intention, to wit: Resolution No. 2382 which concerns certain grading and the construction of certain curbs, gutters and drive- ways on Virginia Avenue gnd other streets. The Clerk presented affidavits of publication, mailing and posting. Council approved said affidavits and ordered same filed. City Engineer Brooks announced that a majority protest petition had been filed with the City Clerk representing 55.2% of the total area under this improvement district. Moved by Councilman Ortuno, seconded by Councilman Flannery that the Virginia Avenue proceedings be thrown out and abandoned and the above resolution be adopted as re*d and ' Numbered Resolution No. 2390. Mayor Memmesheimer announced that this is the time and place fixed by this Council for hearing objections or protests on the proposed work, or the extent of the assessment district, or on the proposed grades under the Resolution of Intention, to wit: STREET PROCEEDINGS Resolution No. 2385 which concerns certain grading and the construction of certain curbs, gutters and driveways on Angeleno Avenue, San Gabriel Avenue and of er streets. The Clerk presented affidavits of publication, mailing and posting. Council approved said affidavits and ordered same placed on file. ' The Mayor announced that the City Attorney would now read all of the Debt Limit Report including any changes, modifications or omissions therein, but excluding the map of assessment district, assessed valuations, true values, assessments and proposed assess- ments upon each parcel of land in the district. The City Attorney then read the Debt Limit Report. The Mayor asked for written or oral protests or objections concerning the work, extent of assessment district or grades. No written or oral protests were presented. The following resolution was offered by Councilman Malone: RESOLUTION OF THE CITY COUNCIL OF THE ' CITY OF AZUSA, CALIFORNIA, MAKING FINDINGS AND OVERRULING PROTESTS AND OBJECTIONS AFTER HEARING ON RESOLUTION RESOLUTION NO.2391 OF INTENTION RESOLUTION NO. 2385. ADOPTED Moved by Councilman Malone, seconded by Councilman Ortuno this resolution be adopted as read and numbered Resolution No. 2391. Carried by the following vote of Council: Ayes: Councilmen: Ortuno, Flannery, Malone, Memmesheimer. Noes: None Absent: Councilman Nasser. Moved by Councilman Malone, seconded by Councilman Ortuno this resolution be adopted as read aid numbered Resolution No. 2392. A letter from the Azusa'City Planning Commission relative to a request of Dan Martin to erect a residence on the rear of 945 N. Azusa Avenue, was read. The Planning Commission recommended that this request be approved with the understanding that the garage be erected adjoining the alley to the west of the residence. ' Moved by Councilman Malone, seconded by Councilman Ortuno that Council accept the recommendation of the Planning Commission. Noes: None, Absent: Councilman Nasser. 373 RESOLUTION NO. 2392 ADOPTED DAN MARTINIS RE'gUEST GRANTED CC CITY HALL, AZUSA, CALIFORNIA, MONDAY, APRIL 17, 1950 7:30 375 P.M. A letter from the State Compensation Insurance Fund relative to a refund of $1,593.90 was read. This amount represents a saving of 42% in the cost of workmen's compensation insurance due to on-the-job accident prevention STATE COMPENSATION activities of the City of Azusa Employees. INSURANCE FUND The letter was ordered filed. A communication from the Planning Commission relative to a request of Mrs. Marion Blatchley for a 12 unit apartment building to be erected on Lots 23 and 24, Block 14, was read. The Planning Commission recommended MRS BLATCHLEY'S that Mrs. Blatchley's request be REQUEST GRItNTED granted. Moved by Councilmanttt�n?o segpo ded by Councilman Flafer `ve&�96 endation of the Planning Commission be acceo;ed with the provision that Mrs. Blatchley begin building at the rear of the lots and work toward the front of the property. City Engineer Brooks presented new study maps of the Gladstone Avenue area. The Mayor invited all interested persons to come to the Council table and see the maps. Moved by Councilman Flannery, seconded by Councilman Ortuno the tentative map of the Tadlock subdivision #16687 be rejected and referred back to the Planning TENTATIVE MAP OF Commission to be resubmitted. TRACT NO. 16687 ' Councilman Ortuno stated that he felt City Engineer Brooks should not be the representative of the property owners of the Gladstone area, as well. City Engineer Brooks stated he was willing to withdraw as representative of the property owners. Councilman Flainery offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, PLACING CERTAIN EMPLOYEES RESOLUTION NO. 2393 ON RESOLUTION AND FIXING THEIR SALARY. ADOPTED Moved by Councilman Malone, seconded by Councilman Ortuno this resolution be adopted as read and numbered Resolution No. 2393• Carried by the following vote of Council: Ayes: Councilmen: Ortuno, Flannery, Malone, Memmesheimer. Councilman Malone offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, FIXING THE PAY OF JACK ELLINGTON AS SKIP LOADER OPERATOR IN THE STREET DEPART- MENT OF THE CITY OF AZUSA AND ALSO FIXING THE SALARY OF LUTHER A. City Attorney Tscharner read to Council a copy of letter of protest they had requested him to write to the Inter- state Commerce regarding abandoning of the street car facilities in the City of Azusa. Mayor Memmesheimer presented Council with a letter of resignation from Milo T. Hawkins, Chief of the Fire Department. Moved by Councilman Flannery, seconded by Councilman Malone the resignation of Milo T. Hawkins be accepted and the City Clerk be instructed to write him a letter of appreciation for services rendered the City. Carried by the following vote of Council: Ayes: Councilmen: Ortuno, Flannery, Malone, Memmesheimer. Noes: None Absent: Councilman Nasser. A letter addressed to the City Council from M. A. Hynes, City Clerk, relative to a request for a one month sick leave and a one month vacation, was read. Attached was a letter from Dr. Ernsberger. Moved by Councilman Ortuno, seconded by Councilman Malone the City Clerk's request be granted. Carried by the following vote of Council: Ayes: Councilmen: Ortuno, Flannery, Malone, Memmesheimer. Noes: None Absent: Councilman Nasser. Moved by Mayor Memmesheimer, seconded by Councilman Ortuno the sick leave ' of John R. Sttton be extended up to sixty days. Moved by Councilman Flannery, seconded by Councilman Ortuno the City Clerk be authorized to advertise for bids for a pump to be used by the Azusa Agricultural Water Company to help provide water for the City. THE SECOND PART" AND AUTHORIZING THE MAYOR OF SAID CITY TO SIGN THE SAME AND THE CITY CLERK TO ATTEST SAME. Noes: None Absent: Councilman Nasser. Moved by Councilman Flannery that Leo C. Nasser be appointed to the Park and Recreation Commission. After general discussion it was decided this appointment should be made by the new Council and Mr. Flannery withdrew his motion. Councilman Malone requested that Council speed action on the purchase of property for the new City reservoir. The matter was referred to City Engineer Brooks for investigation. Engineer Brooks presented Council with a request by Mrs. Dawson on West First Street asking the City to do street work at First and Orange Avenues, the City to be reimbursed by'her for work done. Moved by Councilman Ortuno, seconded by Councilman Malone the City Engineer be instructed to draw up estimate of cost for curbs and gutters and present it to Council and Mrs. Dawson. Carried by the following vote of Council: Ayes: Councilmen: Ortuno, Flannery, Malone, Memmesheimer, Noes: None Absent: Councilman Nasser. Councilman Nasser entered the meeting and tak his seat at the Council table. At the request of the Bell Construction Company, the City Engineer was instructed and authorized by Council to write a letter to the Veteran's Administration advising them that Council has asked for an advance of Los Angeles County Funds for the improvement of Paramount Avenue. Mr. Brooks presented Council with a bill from the Cee Tee Construction Company for the balance of money due him from the Leland Realty Company. Moved by Councilman Malone, seconded by Councilman Ortuno the City Clerk be authorized to pay the balance of the bill due after 35 day waiting period, upon filing of notice of completion. Carried by the following vote of Council: Ayes: Councilmen: Ortuno, Flannery, Malone, Memmesheimer. Noes: None Councilman Nasser passes. Mayor Memmesheimer offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, COMMENDING LEO NASSER AND THE GROUP WHO WORKED WITH HIM FOR THE SUCCESSFUL OUTCOME OF THE "AZUSA GOLDEN DAYS CELEBRATION" OF OCTOBER, 1949.
