session at the above time and place.

by Councilman Nasser that Council pro-
ceed to canvass the returns of the
General Municipal Election held in the
City of Azusa on April 11, 1950.
Carried by the following vote of Council:
Ayes: Councilmen: Nasser, Ortuno,
Flannery, Malone, Memmesheimer,
Noes: None Absent: None
Upon completion of said canvass by the
Councilmen, it appears that the whole
number of votes cast at said election

CALIFORNIA, DECLARING THE RESULT OF THE
OFFICIAL COUNT AND CANVASS OF THE VOTERS
OF THE GENERAL MUNICIPAL ELECTION HELD
IN SAID CITY ON APRIL 110 1950.

ADOPTED
The City Council of the City of Azusa does resolve as follows:

P.M.
WHEREAS, a general municipal election was held and
conducted in the City of Azusa, Los Angeles County,
State of California, on Tuesday, the 11th day of April,
1950, as required by law; and
WHEREAS, it appears that notice of said election was duly
and regularly given and that there were five voting precincts
established for said election consisting of consolidation of
regular city precincts for holding State and County elections
as the same were and are established by the Board of Supervisors
of Los Angeles County, California; that election officials were
appointed and election supplies furnished and that in all respects
said election was held and conducted and returns thereof made
and declared in time, form and manner as required by the General
Election Laws of the State of California governing elections in
cities of the fifth and sixth classes; and
WHEREAS, the City Council of the City of Azasa met at the
Council Chambers of said Council on Tuesday, the 18th day of
April, 1950, to canvass the returns of said election and install
the newly elected officers, whereupon said Council found that the
number of votes cast, the names of the persons voted for, the re-
sult of said election and other matters required by law to be
as hereinfter stated.
NOW, THEREFORE, it is hereby resolved and declared as follows:
That said regular Municipal Election was held and conducted in
the City of Azusa, California, on Tuesday, the 11th day of April,
1950, in the time, form and manner as required by law.
That there were five voting precincts established for the purpose
of holding said election, consisting of a consolidation of the
regular election precincts established for holding general, state
and county elections.
That thevhole number of votes cast in said election in said City
of Azusa was 2532•
That the names of the persons voted for, the offices for which
they were voted, and the number of votes which were received in
the entire City of Azusa, are as follows:

BE IT FURTHER RESOLVED and determined that at said General
Municipal Election, Hickory S. Jackson, Art Seltzer and Karl
Jones were each elected to the office of member of the City
Council of the City of Azusa, California, each for a term of
four years; also that Stephen E. Skidmore was elected to the
office of City Treasurer of said City of Azusa, California for
the term of two years; that Proposition No. I was carried with
a majority vote and is hereby declared to be passed and adopted
as an initiative ordinance of the City of Azusa; that Proposition
No. 2, not having received a majority vote of the electors voting,
is declared lost; that Proposition No. 3 was carried with a
majority vote and is hereby declared approved and effective:
BE IT FURTHER RESOLVED that the City Clerk shall immediately make
and deliver to each of said persons so elected a Certificate of
Election signed by her and duly authenticated; that she shall also
Impose, or have imposed, the constitutional oath of office upon
said person so elected as members of the City Council and shall
have them subscribe thereto and file the same in her office; and
thereupon, each and all of said persons so elected to said
respective offices shall be inducted in said respective office to
which they have been elected.

Mr. Tscharner again addressed Council
thanking them for the vote of confidence
but asked that they reconsider their vote
and grant his resignation.

consider their vote and accept the
resignation of City Attorney Tscharner.

by Councilman Ortuno that Councilman
Memmesheimer be appointed temporary
chairman for the election of a mayor.

Chairman Memmesheimer called for
nominations for Mayor. ,
Moved by Councilman Seltzer, seconded
by Councilman Ortuno that Karl J. Jones
be nominated for Mayor of the City -of Azusa.
Moved by Councilman Jackson that Council-
man Memmesheimer be nominated for Mayor
of the City of Azusa.
Chairman Memmesheimer called for roll
call on the nomination of Karl J. Jones.
Ayes: Councilmen: Ortuno, Seltzer, Jones.
Noes: Councilmen: -Jackson, Memmesheimer.
Absent: None
Thereupon Mayor Jones took the chair
and addressed Council and others present
expressing his appreciation and pledging
cooperation for the welfare of the City.
Councilman Memmesheimer offered a -
resolution entitled:

THE SPLENDID WORK ACCOMPLISHED BY THE

Mrs. Woody Nelson arose from the audience
to question the advisability of retaining
a lawyer as City Attorney who is neither
a resident or registered voter of the City.
Councilman Seltzer advised Mrs. Nelson
that Mr. Snidow was being appointed only
Acting Attorney.
Councilman Memmesheimer offered a resolution
entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA, LOS ANGELES COUNTY,
CALIFORNIA, APPOINTING MARL= MADISON
FIRE CHIEF OF THE AZUSA CITY FIRE DEPART-
MENT AND FIXING HIS SALARY AS SUCH OFFICER.
Moved by Councilman Jackson, seconded
by Councilman Seltzer this resolution

Councilman Ortuno offered a resolution
appointing John Sitton Assistant Chief
of the Fire Department,
Councilman Memmesheimer advised Council
that John Sitton had been 111 and question ed
the advisability of saddling him with respon-
sibility of additional work at this time.
He paid tribute to Mr. Sitton's services
but stated that more time should be given
for Sitton's complete recovery.
Councilman Ortuno withdrew his motion
pending a decision of the Acting City
Attorney on the effect this appointment

date that Fred E. Williams, now holding
the position of Captain, be appointed
Acting Chief of Police, further that I
be assigned other duties in the Police
Department.

by Councilman Seltzer that the re-
commendation of Mr. Kendrick be accepted.

P. J. Tacharner advised Council that if
Chief Kendrick wished to be relieved
of his duties, he would have to resign
as Chief and be -reappointed to the de-
partment by a new resolution.
Chief Kendrick was asked to clarify his
wishes and replied that he wished to
resign as Chief of Police and be assign-
ed other duties in the Police Department.
Moved by Councilman Jackson, seconded
by Councilman Memmesheimer the resignation
of A. L. Kendrick as Police Chief be not
accepted.
Carried by the following vote of Council:

Moved by Councilman Memmesheimer, second-
ed by Councilman Jackson Council reconsider
the previous original motion accepting
the recommendation of A. L. Kendrick,
and replace Fred E. Williams to his
original classification of Captain and
retain Albert L. Kendrick as Chief of Police.

John H. Flannery arose from the audience
to ask if such a change should be handled
under the new Civil Service Ordinance
and was advised by Acting City Attorney
Snidow that the new ordinance does not
'
go into effect for ten days.
Leo C. Nasser addressed Council suggest-
ing that any change of personnel should
come under the jurisdiction of the Civil
Service Board when they have been appoint-
ed.
P. J. Tacharner advised Council that if
Chief Kendrick wished to be relieved
of his duties, he would have to resign
as Chief and be -reappointed to the de-
partment by a new resolution.

from Albert L. Kendrick, Chief of
Police, be tabled for the present.

' Councilman Memmesheimer suggested that
action be taken on the swimming pool
bids. He explained condition of funds
and reminded Council that heavy ex-
penditures would have to be anticipated
to insure sufficient water supply for
the coming year.
Moved by Councilman Memmesheimer,
seconded by Councilman Ortuno that
the bids for major repairs of the pool
be rejected, that the City Clerk be
authorized and instructed to return
the bid checks, and that only necessary
expenditures be made to put Slauson
Memorial Pool in condition, said re-
pairs not to exceed $50000.00.

Moved by Councilman Ortuno, seconded
' by Councilman Seltzer that the Mayor
appoint a committee of local engineers
to investigate plans for repairs of
Slauson Memorial Pool.
Carried by the following vote of Council:

Seltzer, Memmesheimer, Jones.

Mayor Jones thereupon appointed the
following group to serve on said
Committee: Messrs. Beckett, Petracek,
Snyder, Farrell and Davis.
At the suggestion of Farley Beckett,
Mayor Jones appointed Mr. Snyder chairman
of the committee.
Mr. Victor C. Jabson of S. Virginia
Avenue advised Council that the Carpenterts
Union would be glad to donate services toward.
the repair of the pool.
City Engineer Brooks explained to Council
a request of the Cee Tee Construction Co.
for the payment of the 20% balance of their
bill to the Leland Realty Company. Balance
of 20% will be paid contractor at the end
of 35 days waiting period and when he files
an original notice of completion with the
City Clerk.
Attorney Tscharner addressed Council re-
garding a lawsuit in the amount of $206,000
brought against the City of Azusa by Rolla
Clapp of Assets Reconstruction and advised

Council that suit had been dismissed
Mr. Tscharner also told Council of
action taken regarding a reservoir
and was asked by Council to finish
his negotiations and carry arrangements
through.
Mr. Victor C. Jabson reported various
fire hazards near the S. Virginia Ave.
area and was advised that the properties
had been checked previously and had not
been considered fire hazards at the time
but would be investigated again.
Moved by Councilman Memmesheimer,
seconded by Councilman Ortuno and duly
carried Council adjourn.
