PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items within the subject matter jurisdiction of the council/agency board that are not listed on this agenda or are listed on this agenda as an item other than a public hearing itens. Members of the audience will have the opportunity to address the city council/agency board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the council/agency board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. The council/agency board will respond after public comment has been received. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments shall be handled after the speaker has completed his/her comments. SCHEDULED ITEMS CONDUCT THE PUBLIC HEARING REGARDING THE SALE OF CERTAIN PROPERTY LOCATED AT 17511 E. ARROW HIGHWAY, AZUSA (APN 8621-024-905) BY THE CITY TO CHARVAT FAMILY, LLC., CONSIDERATION OF A PURCHASE AND SALE AGREEMENT BETWEEN THE CITY OF AZUSA AND CHARVAT FAMILY, LLC. The parcel is currently being used as a parking lot and landscape area, and is less than I acre, with no change of use being proposed. Therefore, this action is exempted pursuant to the California Environmental Quality Act (Pub. Resources Code, § 21000 et seg.) and State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.) section 15332, the Class 32 Infill Exemption. Further, given that there is no change of use proposed here, this action is merely the transfer of title, which does not have any attendant environmental impacts. Therefore, this action is also exempt pursuant to State CEQA Guidelines, section 15061(b)(3) which exempts actions for which it can be seen with certainty that there is no possibility of a significant environmental impact. RECOMMENDED ACTION: 1) Open the public hearing and receive testimony from the public regarding the proposed sale of the Property owned by City. 2) Close the public hearing and, if any protests were received regarding the sale of the Property, overrule the protest by a 4/5 majority vote. 3) Approve the attached City Resolution No. 2017-059 approving the Purchase and Sale Agreement; and 4) Authorize the Mayor to execute the Purchase and Sale Agreement on behalf the City in a form acceptable to the City Attorney. 2. PUBLIC HEARING - 2017 JUSTICE ASSISTANCE GRANT (JAG) APPLICATION. RECOMMENDED ACTION: 1) Open the Public Hearing, receive public testimony regarding, close the Public Hearing; and 2) Authorize the City Manager to submit a grant application to the U.S. Department of Justice for the purchase of specified equipment; and 3) Authorize the City Manager to execute all contracts, reports, and other documents required for receiving such funds pursuant to the terms and conditions of the U.S. Department of Justice. 3. APPROVE A RESOLUTION AUTHORIZING THE APPOINTMENT OF A RETIRED ANNUITANT AS INTERIM CITY MANAGER PURSUANT TO GOVERNMENT CODE SECTION 21221(h); AND APPROVE AN EMPLOYMENT AGREEMENT FOR INTERIM CITY MANAGER SERVICES BETWEEN THE CITY OF AZUSA AND DON PENMAN. 8/21/2017 -3 - RECOMMENDED ACTION: 1) Adopt Resolution No. 2017-C60 authorizing the appointment of an Interim City Manager pursuant to Government Code Section 21221(h); and 2) Approve an employment agreement for Interim City Manager services between the City of Azusa and Don Penman, subject to any non -substantive changes made by the City Attorney. 4. REQUEST FOR DIRECTION REGARDING THE USE OF THE AZUSA CIVIC AUDITORIUM BY THE AZUSA UNIFIED SCHOOL DISTRICT FOR MONTHLY BOARD MEETINGS. RECOMMENDED ACTION: 1) Discuss the conditions presented by the Azusa Unified School District for the use of the City of Azusa Civic Auditorium and provide Staff with direction on whether to negotiate an MOU with the AUSD regarding the use of the civic auditorium. JOINT SUCCESSOR AGENCY AND CITY COUNCIL APPROVAL OF QUITCLAIM DEED CONVEYING ASSESSOR PARCEL NO. 8605-015-907 FROM THE SUCCESSOR AGENCY TO THE CITY OF AZUSA IN COMPLIANCE WITH THE CITY OF AZUSA'S SUCCESSOR AGENCY LONG RANGE PROPERTY MANAGEMENT PLAN RECOMMENDATIONS AND ACCEPTANCE BY THE CITY. COMMENDED ACTION: Staff recommends the Successor Agency take the following action: 1) Approve the Quitclaim Deed conveying Assessor Parcel No. 8605-015-907 from the Successor Agency to the City of Azusa in compliance with the City of Azusa and Successor Agency's long range property management plan recommendation. Staff recommends the City Council take the following action: 1) Accept the Quitclaim Deed conveying Assessor Parcel No. 8605-015-907 from the Successor Agency to the City of Azusa. E. CONSENT CALENDAR The Consent Calendar adopting the printed recommended actions will be enacted with one vote. If Councilmembers or Staff wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. 1. MINUTES OF THE REGULAR MEETING OF JULY 17. 2017 AND SPECIAL MEETING OF JULY 242 2017 AND AUGUST 2, 2017. RECOMMENDED ACTION: Approve minutes as written. 8/21/2017 - 4 - 2. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED JULY 13, 2017 THROUGH AUGUST 16, 2017. RECOMMENDED ACTION: Adopt Resolution No. 2017-C61 allowing certain claims and demands and specifying the funds out of which the same are to be paid. 3. HUMAN RESOURCES ACTION ITEMS. RECOMMENDED ACTION: Approve the following Personnel Action Requests in accordance with the City of Azusa Civil Service Rules Section 5.7.5 and applicable Memorandum of Understanding(s). 4. APPROVE PROFESSIONAL SERVICES AGREEMENT WITH JONES LANG LASALLE BROKERAGE INC. TO RENDER COMMERCIAL REAL ESTATE BROKERAGE CONSULTING SERVICES. RECOMMENDED ACTION: Approve a professional services agreement with JLL, in an amount not -to -exceed $30,000 to render commercial real estate brokerage consulting services; and authorize the City Manager to execute, in a form acceptable to the City Attorney, on behalf of the City. 5. APPROVAL OF OFF -CAMPUS FEDERAL WORK STUDY PROGRAM AGREEMENTS WITH AZUSA PACIFIC UNIVERSITY. RECOMMENDED ACTION: Approve an amendment to the agreement with Azusa Pacific University for Azusa Reads, Writes, Counts & Azusa Calculates; and approve an amendment to the agreement with Azusa Pacific University for Kids on the Move/Computer Lab Training Programs; and authorize the City Manager to execute the amendments, in a form acceptable to the City Attorney, on behalf of the City. 6. CONSIDERATION OF A SECOND PROFESSIONAL SERVICES AGREEMENT AMENDMENT WITH CSG CONSULTANTS INC. AND ONE YEAR (1) CONTRACT EXTENSION. RECOMMENDED ACTION: Authorize the City Manager to execute an amendment to the Professional Services Agreement with CSG Consultants, Inc., in a form acceptable to the City Attorney, on behalf of the City. 7. AUTHORIZE EXECUTION OF ASSURANCES AND UNDERSTANDINGS REGARDING RECEIPT AND USE OF MEASURE M LOCAL RETURN FUNDS. RECOMMENDED ACTION: Approve the Assurances and Understandings; and authorize the Chief of Police/Acting City Manager to execute the Assurances and Understandings with LACMTA for receipt and use of Measure M Local Return funds. 8/21/2017 - 5 - APPROVE PROFESSIONAL SERVICES AGREEMENT WITH CWE TO PROVIDE MS4 PERMIT INDUSTRIAL/COMMERCIAL FACILITY PROGRAM INSPECTION SERVICES. RECOMMENDED ACTION: Approve a Professional Services Agreement with CWE for a not -to -exceed amount of $65,890.00, which includes a 10% contingency for potential change orders, to provide professional services related to the MS4 Permit Industrial/Commercial Facility Program; and authorize the Chief of Police/Acting City Manager to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. 9. REQUEST TO APPROVE PROFESSIONAL SERVICES AGREEMENT WITH NORTHSTAR. CHEMICAL. RECOMMENDED ACTION: Approve a Professional Services Agreement with Northstar Chemical, as a DBA of Pacific Star Chemical, for the period of July 24, 2017 through June 30, 2019 in an amount not -to -exceed $350,000, in accordance with Azusa Municipal Code Section 2-517 (a) (24); and authorize the Mayor to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. 10. AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH THE COUNTY OF LOS ANGELES DEPARTMENT OF PUBLIC WORKS TO CONTINUE PROVIDING PARATRANSIT SERVICES TO COUNTY UNINCORPORATED AREAS OF AZUSA. RECOMMENDED ACTION: Approve an Agreement between the City of Azusa and the County of Los Angeles Department of Public Works to provide paratransit services to disabled and elderly persons who reside in the County unincorporated areas of Azusa; and authorize the Chief of Police/Acting City Manager to execute the Agreement, in a form acceptable to the City Attorney, on behalf of the City. 11. APPROVAL OF EXTENSION OF THE USE/LEASE AGREEMENT WITH AZUSA PACIFIC UNIVERSITY FOR THE SLAUSON PARK COMMUNITY POOL/AZUSA AQUATICS CENTER. RECOMMENDED ACTION: Approve the Use/Lease Agreement with APU for Slauson Park Community Pool/Azusa Aquatics Center from August 28, 2017 through May 4, 2018; and authorize the City Manager to execute the use lease agreement in a form acceptable to the City Attorney, on behalf of the City. 12. AUTHORIZATION TO SOLICIT PROPOSALS TO PROVIDE PROFESSIONAL ENGINEERING SERVICES FOR THE ALOSTA AVENUE STREET IMPROVEMENTS PROJECT. RECOMMENDED ACTION: Authorize Staff to solicit a Request for Proposals to provide professional engineering services for the Alosta Avenue Street Improvement Project. 8/21/2017 - 6 - 13. REQUEST FOR PROPOSALS FOR A MINING CONSULTANT FOR VARIOUS REVIEWS ASSOCIATED WITH SMARA_(SURFAC.E MINING AND RECLAMATION ACT) COMPLIANCE AND BI -ANNUAL MONITORING. RECOMMENDED ACTION: Authorize Staff to circulate a Request for Proposals (RFP) to provide consulting services for various reviews associated with SMARA (Surface Mining and Reclamation Act) compliance and bi-annual monitoring. 14. LEASE AGREEMENT TO PURCHACE 2017 FORD POLICE SUV VEHICLES. RECOMMENDED ACTION: Approve the lease agreement between the City and First Capital Leasing Corporation for the purchase and outfitting of four (4), 2017 Ford Police Interceptor SUV vehicles for an amount not -to -exceed of $162,000; and Approve the purchase of four (4), 2017 Ford Police Interceptor SUV vehicles from Wondries Fleet Group (400 S. Atlantic, Alhambra, CA) under the County of Los Angeles Bid# DPO-SH-17361672, for an amount not -to -exceed $124,005.64. Authorized under City Municipal Code Section 2-521 allowing Cooperative or Piggyback purchases; and Approve the outfitting of emergency equipment for all four (4) vehicles by Black and White Emergency Vehicles (1611 W. San Bernardino Rd. Covina, CA) for an amount not -to -exceed $37,511.28; and Authorize the City Manager to execute the contracts and purchases in a manner acceptable to the City Attorney. 15. CITY TREASURER'S STATEMENT OF CASH AND INVESTMENT BALANCES FOR THE MONTH OF JUNE 2017. RECOMMENDED ACTION: Receive, review, and file the City Treasurer's Report for the month of June 2017. 16. APPROVAL OF REVISED CLASSIFICATION SPECIFICATION — PLANNING TECHNICIAN. RECOMMENDED ACTION: Approve the attached revised classification specification for Planning Technician. 17. APPROVAL OF REVISED CLASSIFICATION SPECIFICATION — STREET MAINTENANCE CREW SUPERVISOR. RECOMMENDED ACTION: Approve the attached revised classification specification for Street Maintenance Crew Supervisor. 18. APPROVAL OF TITLE CHANGE AND REVISED CLASSIFICATION SPECIFICATION — TRANSPORTATION DISPATCHER. RECOMMENDED ACTION: Approve the attached revised classification specification for Transportation Dispatcher and a title change to Transit Dispatcher. 8/21/2017 - 7 - 19. REQUEST TO APPROVE PROFESSIONAL SERVICES AGREEMENT WITH BAKERS PRODUCTIONS FOR VIDEO PRODUCTION SERVICES. RECOMMENDED ACTION: Approve a Professional Services Agreement with Bakers Man Productions for Video Production Services; and Authorize the City Manager to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. 20. APPROVE AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH JOE A. GONSALVES & SONS FOR LEGISLATIVE ADVOCACY SERVICES. RECOMMENDED ACTION: Approve an amendment to the contract with Joe A. Gonsalves & Sons, for legislative advocacy services extending the term through June 30, 2018; and Authorize the City Manager to execute, in a form acceptable to the City Attorney, an amendment to the contract with Gonsalves & Sons on behalf of the City. 21. APPROVE AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH BLAIS & ASSOCIATES FOR PROFESSIONAL GRANT MANAGEMENT SERVICES. RECOMMENDED ACTION: Approve an amendment to the contract with Blais & Associates, for grant research and development services extending the term through June 30, 2018; and Authorize the City Manager to execute, in a form acceptable to the City Attorney, an amendment to the contract with Blais & Associates on behalf of the City. 22. AUTHORIZATION TO RELEASE_ REQUEST FOR PROPOSALS FOR ARMED SECURITY SERVICES. RECOMMENDED ACTION: Authorize Staff to release the proposed Request for Proposals (RFP) for armed security services. 23. REQUEST FOR LEAVE OF ABSENCE WITHOUT PAY — WELDER/WATER DISTRIBUTION WORKER I. RECOMMENDED ACTION: Approve an employee's request for a leave of absence without pay beginning June 18, 2017 through November 16, 2017, in accordance with Azusa Civil Service Rules, Section 6.8.1. F. SUCCESSOR AGENCY RELATED BUSINESS. L RESOLUTION AUTHORIZING PAYMENT OF WARRANTS BY THE SUCCESSOR AGENCY DATED JULY 13, 2017 THROUGH AUGUST 16, 201'7.
