DELACH, EXECUTIVE DIRECTOR DATE: SEPTEMBER 28, 2009 SUBJECT: AUTHORIZATION TO AWARD THE ABATEMENT/REMOVAL OF ASBESTOS AND DEMOLITION CONTRACT OF TWELVE-FIFTEEN, 4-UNIT (QUADRUPLEXES) MULTIFAMILY PROPERTIES/STRUCTURES AND OTHER SUBSURFACE PARKING AREAS LOCATED AT THE ATLANTIS GARDENS PROJECT SITE RECOMMENDATION It is recommended that the Agency Board approve and award the contract for the abatement/removal of asbestos and demolition to Prime Demolition Inc. in the amount of$286,340.00 and authorize the Executive Director to execute the requisite contracts and agreements for the removal of twelve-fifteen, 4-Unit(Quadruplexes)multifamily properties,structures and other subsurface parking areas located at the Atlantis Garden project site. BACKGROUND The subject properties are situated within the Merged Central Business District and West End Redevelopment Project Area. The project site is located south of Foothill Boulevard,west of Alosta Avenue and east of Cerritos Avenue in an area known as "Atlantis Gardens". The site is currently developed with a total of thirty-nine(39)residential for-rent quadruplexes which make up the Atlantis Gardens site. The properties are owned by thirty-seven (37) different property owners. The Site, measuring approximately 7.5 acres and includes public rights of way located within the site. In November 2008,the Agency Board and City Council met in closed session to authorize staff to enter into property negotiations with several of the property owners of the Atlantis Garden project area that were interested in selling their property to the Agency. Beginning in February 2009,the City of Azusa Redevelopment Agency began acquiring property. To date and with Council Approval,Agency staff has successfully negotiated a total of seventeen purchase and sale agreements with willing sellers of the Atlantis Garden project site and has closed escrow on thirteen of the proprieties with an additional two The Honorable Chairman and Members of the Agency Board Subject:Atlantis Garden Award Bid September 28,2009 Page 2 properties scheduled to close escrow at the end of September or in early October 2009. Two of the remaining properties have one-year escrows and cannot close early due to the restrictions on the sellers mortgage note. Tenants within the subject parcels mostly occupy the Site. All thirteen properties currently owned by the Agency are vacant,secured and boarded up. Tenants that occupy the properties that are scheduled to close escrow have either vacated or will vacate no later than the end of September or in early October 2009. The units owned by the Agency will be abated with the removal of asbestos and demolished leaving the parcels free of improvements and rough graded. The attached parcel map (Exhibit A-1) indicates those properties that will be abated and demolished. DEMOLITION On September 8, 2009, the Agency Board approved the bid specifications for abatement/removal of asbestos and demolition of twelve-fifteen,4-Unit(Quadruplexes)multifamily properties,structures and other subsurface parking areas located at the Atlantis Garden project site and authorized staff to advertise the bid. On September 11, 2009 staff advertised the Public Notice for the abatement/removal of asbestos and demolition of the Atlantis Garden project in the San Gabriel Tribune and Green Sheet classifieds. On September 17,2009 as a requirement to the bidding process, a mandatory job walk was scheduled for contractors who were interested in submitting a bid for the project. Approximately thirty (30) contractors and/or subcontractors participated at the job walk. On September 17th and 21St addendums to the contract were issued modifying the original specifications as set forth under the original bid spec. The addendums were emailed to all the contractors and subcontractors that participated at the mandatory job walk. On September 23, 2009 all bids for the abatement/removal of asbestos and demolition of the Atlantis Garden Project site were due. During the bid opening, twelve (12) bids were received from various contractors by the required deadline. The bids ranged from$983,837 to $286,340 with the lowest bid submitted by Prime Demolition Inc. The breakdown of the three lowest bids are as follows: Company Atlantis Garden Bid 1) Prime Demolition Inc. $286,340.00 2) R.B. Holt Inc. $296,300.00 3) Housley Demolition Excavation $328,940.00 The Work that will be performed by the selected demolition contractor will include abatement/removal of asbestos and demolition of twelve-fifteen,4-Unit(quadruplexes)structures to include the removal of subsurface parking areas, asphalt and vegetation leaving the parcels vacant of all improvements and graded to the site level. The bid specs also included an alternative bid item for on-site crushing of concrete and asphalt should the city elect to construct the alternate bid item as a method of fill or base material for groundcover of the parcels. The Honorable Chairman and Members of the Agency Board Subject:Atlantis Garden Award Bid September 28,2009 Page 3 During the time of the abatement and demolition,a City inspector will ensure proper work performance and handle daily contractual field issues. The City will enforce the contractor's requirement to provide adequate site security, implement dust control, air pollution prevention,and odor control measures to prevent the creation of dust, air pollution, and odor during the period of operation. The site will be protected throughout the abatement and demolition process. A screened fence and gate will remain in place to ensure safe passage around the demolition area.The use of explosives will not be permitted for demolition. The contractor will be given a period of 120 calendar days to complete both the abatement and demolition work under the contract. The Contractor will also be required to be bonded,carry the requisite insurance and shall furnish proof thereof, and will be required to indemnify the Agency and City. The contractor will need to meet all the required federal,state,and local requirements,including Cal OSHA,NPDES,and AQMD as designated in the project specifications. The project will be subject to prevailing wage requirements. The demolition work is necessary in order to prepare the site for a future affordable housing development project. Further, it is determined that the anticipated environmental impacts of the abatement and demolition project are not substantial enough to warrant an environmental review. FISCAL IMPACT: The cost of the project is estimated at $303,340.00 which includes the alternative bid item in the amount of$17,000 should the city elect to construct the alternate bid item. The project has been budgeted in the FY 2009/10 Agency budget as part of the housing set-aside funds. Prepared by S.
