HomeMy WebLinkAboutResolution No. 95-C075i 6 RESOLUTION NO. 95-C76 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA OPPOSING ASSEMBLY BILL 318 RESTRICTING TRANSFERS TO MUNICIPAL GENERAL FUNDS FROM MUNICIPAL UTILITY FUNDS WHEREAS, the City of Azusa is a General Law City that has owed and operated its own municipal utility services since incorporation December 29, 1898; and WHEREAS, the City of Azusa has historically, by means of a Noticed Public Hearing, collected and transferred to the Municipal General Fund, an amount equivalent to that commonly accepted practice of franchise fees for private utility corporations of two percent, and an in -lieu property tax of eight percent of utility revenues; and WIIEREAS, the City of Azusa has since its incorporation served the community well by providing a high level of police, fire and other governmental services; and WHEREAS, the City of Azusa Light & Water Department has continually maintained competitive electric and water rates to the Consumers; and WHEREAS, the City of Azusa Light & Water Department electric and water rates in fact have been at a lower rate than most of the private water and power companies in the State of California; and WHEREAS, Assembly Bill 318, as written, proposes to prevent the City from transferring funds from its municipal water and power utility to the City's Municipal General Fund; and WHEREAS, Assembly Bill 318 would devastate the City of Azusa's Municipal General Fund by reducing it by $3.5 million, significantly impacting public safety and other government services; and WHEREAS, besides the devastating fiscal impact on cities, Assembly Bill 318 represents a serious and inappropriate intrusion into local rate setting authority; and WHEREAS, the City Council of the City of Azusa strongly supports and endorses the power of local rate setting in determining how much and where its operating revenue should be distributed; and WHEREAS, Assembly Bill 318 would erode the right to make this choice for the cities in the State of California which have public utilities; NOW, THEREFORE, be it resolved that the City Council of the City of Azusa opposes Assembly Bill 318 and urges all members of the California Legislature to oppose same.
