Present at roll call: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones, City Engineer Brooks, Acting City Attorney Snidow, Deputy City Clerk. Absent: City ROLL CALL Clerk. Each member present acknowledged receipt of a written copy of the minutes of ' September 18, 1950. The Mayor asked if there were any objections or corrections to said minutes. There being none, the minutes of September 18, 1950 were approved as written. Relative to action on Rent Decontrol, it was moved by Councilman Seltzer, seconded by Councilman Ortuno action on rent control be tabled until the next regular meeting of Council.. October 16, 1950. Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None A letter of resignation from Leo V. Ebersold, Chairman of the Azusa Planning Commission, was read. Moved by Councilman Memmesheimer, seconded by Councilman ortuno Mr. Ebersold's resigna- tion be accepted and the City Clerk be instructed to write a letter of appreciation for his years of faithful service. ' Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None A petition containing 48 signatures was filed with Council protesting various nuisances existing in the West First Street area. Those cited were noise.and dust from Azusa Rock & Sand Company and smudging in nearby groves. The matter was -referred to Acting City Attorney Snidow for checking and report. A petition signed by approximately 25 property owners on Azusa Avenue between Sixth Street and Santa Fe Avenue was presented requesting installation of new street lights within these boundaries, said lights to be paid for on a cash basis by the property owners. one signer also filed a preference to have lights installed under a bond issue. After general discussion, an informal discussion meeting between the members of Council and ' the property owners was set for October lO, 1950 at 7:30 PM in the Auditorium and the City Clerk was instructed to notify all property owners on Azusa Avenue between Sixth Street and Santa Fe Avenue of ad d hearing. A list of names certified for employment as Police officers by the Civil Service Personnel Board was read and ordered placed on file. Magnell, Charles C..MoCain, Carl W. Elkins, Robert B._Edborg, Robert M. Torrance. The letters were placed on file. A letter from Chief of Police Kendrick was read notifying Council of the appoint- ment as patrolman of the three applicants certified by the Civil Service Board: Wilford Holmes, Robert Wolverton and John Sapano, Jr. Moved by Councilman Seltzer, seconded by Councilman Ortuno the Acting City Attorm y be instructed to prepare a resolution appoint- ing Wilford Holmes, Robert Wolverton and John Kapano, Jr. as probationary employees at a starting.salary of $235 per month. Carried by the following -vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None Stating that he felt a resolution cannot abridge an initiative ordinance and is not legal, it was moved by Councilman Jackson, seconded by Councilman Memmesheimer Resolution No. 2454 relative to the hiring of emergency help, adopted September 18, 19502 be rescinded. Motion failed to carry by the following vote of the Council: Ayes: Councilmen: Jackson, Memmesheimer. Noes: Councilmen: Ortuno, Seltzer, Jones. Absent: None Two letters signed by Chief of Police Sen- driok were read relative to the hiring of emergency help. One letter requested Council to terminate Edward G. Alvarez pursuant to Section 7, Paragraph 3 of the Initiative Civil Service Ordinance, in that he has been employed for 90 days in the present fiscal year and requested Council to reappoint him as a temporary emergency employee. The other letter notified Council of the appointment of three temporary emergency employees: Wallace W. Franklin, James R. Lynch and Clifford Smith. A general discussion ensued about the Civil Service status of these emergency employees and the fact that Alvarez had failed to pass the recent written examination for police officer. Moved by Councilman Seltzer, seconded by Councilman Ortuno the Acting City Attorney be instructed to prepare a resolution authoriz- ing the hiring of Edward G. Alvarez, Wallace W. Franklin, James R. Lynch and Clifford ' Smith as temporary emergency employees with no Civil Service status at a salary of $235 per month. Carried by the following vote of the Council: Ayes: Councilmen: Ortuno, Seltzer, Jones. Noes: Councilmen: Jackson, Memmesheimer. Absent: None Fire Chief Madison discussed with Council the advisability of establishing a_24 hour Fire Department engineer service, explaining MILITARY LEAVES APPOINTIMTS IN POLICE DEPARTMENT MOTION FAILED TO CARRY EMERGENCY HELP WIX F I c 00 CITY HALL, AZUSA, CALIFORNIA, MONDAY, OCTOBER 2, 1950 that only two additional men would be needed and that sleeping quarters could be provided at practically no expense by using part of the present engineering office space. Moved by Councilman Memmesheimer, seconded by Councilmah Seltzer the Act- ing City Attorney be instructed to prepare a resolution authorizing the establishment of 24 hour Fire Depw tment engineer service. Carried by the follev ing vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None A Crusade for Freedom scroll was presented to Council and -was signed by each as well as by members of the audience. Moved by Councilman Jackson, seconded by Councilman Seltzer Acting City Attorney Snidow be instructed to prepare a resolution declaring September 16th to October 16th as Crusade for Freedom month. Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None A letter from Rolla E. Clapp, President of Assets Reconstruction Corporation, Inc., was read requesting a refund of overpayment of $48.50 for taxes paid in 1945• Moved by Councilman Jackson, seconded by Councilman Seltzer Mr. Clapp be requested to file a verified claim for payment. Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None A letter from Albert H. Miller, legal counsel for Mrs. Hazel L. Hinds, was read relative to an accident sustained by her on City -owned property. Attached was a -verified claim in the amount of X15,000. Moved by Councilman Memmesheimer, seconded by Councilman Seltzer the matter be referred to Acting City Attorney Snidow for action: Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. S. Tire Service relative to the City's annual tire,supply was read and referred to -Councilman Jackson. COMMUNICATIONS A letter of appreciation from the Salvation Army was read and ordered placed on file. A notice of increase in telephone rates was presented and it was moved by Councilman Seltzer, seconded by Councilman Jackson and duly carried the matter be referred to Acting INCRL&SE IN TELEPHONE City Attorney Snidow for investigation. RATES Mayor Jones announced that the local Aircraft Warning Service had held one week -end practice and would hold another soon. 9MFle - CITY HALL, AZUSA, CALIFORNIA, MONDAY, OCTOBER 2, 1950 A general discussion about the purchase of bonds was held over for action until the next quarterly statement is received. Moved by Councilman Seltzer, seconded by Councilman Memmesheimer Acting City Attorney Snidow be instructed to prepare a resolution transferring the following amounts into the reserve funds: $2500 per month into the Light Reserve Fund and $1000 into the Water Reserve Fund, retroactive to July 1, 1950. Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None Councilman Memmesheimer offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, CALIFORNIA, ACCEPTING AN EASEMENT FOR STREET PURPOSES. FROM THE AZUSA CITY SCHOOL DISTRICT FOR PARAMOUNT, AVENUE, ORANGE AVENUE AND ANGELENO AVENUE. Moved by Councilman Seltzer, seconded by Councilman Ortuno this resolution be adopted as read and numbered Resolution No. 2455. SUPPLIES AND_ SET. . COMPENSATION TO BE PAID -ELECTION OFFICERS. A general discussion ensued relative to the reasons why the County had not includ-ed the measure on its ballot and two letters from the Board of Supervisors were read relative to the subject. The advisability of using the November 7th date or another date was discussed due to the extra work for precinct boards and possible extra ex- pense of the election. Extra compensation for the precinct workers was agreed upon and incorporated in the resolution. Moved by Councilman Ortuno, seconded by Mayor Jones this resolution be adopted as read and numbered Resolution #2458. Carried by the following vote -of the Council: Ayes: Councilmen: Ortuno, Seltzer, Jones. Noes: Councilmen: Jackson, Memmesheimar. Absent: None In voting no, Councilman Jackson stated, as a matter of record, that he was voting no because correct parliamentary procedure had not been followed and the cost of this election would far exceed that of a special election. Supt. Virgil D. Smith advised Council of the need of three new transformers. Moved by Councilman Seltzer, seconded by Councilman Ortuno the City Clerk be instruct- ed and authorized to advertise for three transformers, specifications to be supplied by Supt. Smith. Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memsesheimer, Jones. Noes: None Absent: None Relative to Christmas decorations, it was moved by Councilman Memmesheimer, seconded by Councilman Seltzer the matter be referred to Councilmen Jackson and Ortuno for in- vestigation with power to act in contacting the Azusa Retail Businessmen's Association and recommending said decorations to the Chamber of Commerce. ' Mr. Ashkenas discussed installation of curbs and gutters on South Sunset Avenue with Council. No action was taken on the matter.
