The City Council of the City of Azusa
met in regular session at the above
time and place.
Present at roll call: Councilmen: Jackson,
Ortuno, Seltzer, Memmesheimer, Jones,
City Engineer Brooks, Acting City Attorney
Snidow, Deputy City Clerk. Absent: City
Clerk.
Each member of Council present acknowledged
receipt of a written copy of the minutes
of October 2, 1950. The Mayor asked if
there were any objections or corrections to
said minutes.
Councilman Jackson filed a sworn affidavit
made by City Clerk M. A. Hynes relative to
the November 7th election to be appended
to the minutes of October 2nd, 1950.
A general discussion followed relative to
correspondence and it was moved by Council-
man Seltzer, seconded by Councilman Ortuno
a committee be appointed to investigate
manner of handling correspondence.
Carried by the following vote of the Council:
Ayes: Councilmen: Jackson, Ortuno,
Seltzer, Memmesheimer, Jones.
Noes: None Absent: None
Mayor Jones appointed Councilmen Ortuno,
Seltzer and Memmesheimer to serve on said
committee.
The minutes of the meeting of October 2,
1950 were approved with the above additions.
Relative to action on the decontrol of
rent, it was moved by Councilman Seltzer,
seconded by Councilman Memmesheimer the
matter be tabled until the next regular
meeting of Council.

Seltzer, Memmesheimer, Jones.
Noes: None Absent: -None
The matter of appeal from the report and
recommendation of the Planning Commission
relative to the application of Calbuilt
Homes, Inc. and Al W. Wertz was discussed.
Acting City Attorney Snidow reported to
Council, as he had been requested, relative
to documents that had been referred to in
hearings before the Council.
After discussion the following action was
taken.
Moved by Councilman Ortuno, seconded by
Councilman Memmesheimer the action of the
Planning Commission be affirmed and the appeal
of Calbuilt Homes, Inc. be denied.

M.A. Hynes, being first duly sworn on oath, deposes and
That I am now and for many years last past have been the
duly elected and acting City Clerk of the City of Azusa.
That on/September 12 , 19509, Mr. Hite, the Registrar
of Voters called me and asked me what decision the City Council
had reached relative to placing the proposition concerning a City
Coordinator on the County Ballot. Mr. Hite stated that he was
ready to send the County Ballot to the printer and wanted to know
definitely whether or not the City's proposition was to be included
in the County Ballot. I told Mr. Hite that I did -not know, however
I would call Mr. Snidow, the City Attorney, and would call him back.
I then called Mr. Snidow's office and learned that I could not reach
Mr. Snidow. I then called Mayor Jones who said that he would call
Mr. Snidow and call me back. Mayor Jones called back and told me
that in a conversation with Mr. Snidow he understood that the
proposition was not to go on the County Ballot, but the City would
print their own ballots so I said to Mayor Jones, "This must be
exactly right and will you please repeat what you have just said."
Mayor Jones then repeated what he said and I said to him, "This is
so important and it must be exactly right so I am going to repeat
after you just what you have said so that I may give the correct
information to Mr. Hite."
I am advised that at the meeting of the City Council on
October 2, 1950, the statement was made by Mayor Jones that he
advised me over the telephone to use my own judgment with reference
to the procedure relative to whether or not the proposition be placed
on the County Ballot or that the City print their own ballot. With

reference to said statement, if the same was made, I desire to deny
it, and reaffirm the conversation hereinbefore set forth between the
Mayor and myself relative to said ballot, and I am pleased to submit
herewith also, and attached hereto, the affidavit of Elsie P. Foskett
In regard to such conversation.

ELSIE P. FOSRETT, being first duly sworn on oath deposes
and says:
I am Accounts Clerk in the office of the City Clerk of the
City of Azusa; that on or about the 12 day of September, 1950,
I was present in that office when Mrs. Hgnes, the City Clerk,
received a telephone call from Mr. Hite, Registrar of Voters of
Los Angeles County, California, and I heard part of the conversation
which was as follows:
°I don't know what they want to do about it, but I will
at once get in touch with the City Attorney and call you back
F immediately.°
That Mrs. Hynes then did at once call the office of the
City Attorney and he was not in at that time; that Mrs. Hynes then
called Mayor Jones and advised the Mayor that she could not reach the
Acting City Attorney, Mr. Snidow, and wanted to know what she was to
do with reference to the'Coordinator Ordinance so that she could call
Mr. Hite and advise him; that she had to have the information at
once.
Later on, Mayor Jones called the office and I answered the
phone and Mrs. Hynes then took the phone and had a conversation with
Mayor Jones; the part of said conversation which I heard was as
follows:
"I want to be sure.and-get this right, because it is
important and it has to be exactly right."
Then they had a short conversation, and I heard Mrs. Hynes
say: "Now I will repeat this back to you, because it must be exactly
right. I will tell Mr. Hite that the City will not place the
proposition on the County Ballot, but will print their own ballots,
is that right, Mr. Jones?"
That Mrs. Hynes, then, in my presence and in my hearing,
called Mr. Hite, the Registrar of Voters, and advised him that she
had been informed
by
the Mayor
that the City
would print
its own
ballots and would
not
put the
proposition on
the,County
Ballot.
Further deposing, deponent says:
That I know of my own knowledge that immediately after the
two letters received from Los Angeles County, dated September 1 and
September 6, 1950, Mr. Snidow came into our office and had long
telephone calls with the County authority.

Councilman Memmesheimer the action
of the Planning Commission be affirmed and the
appeal of Al W. Wertz be denied.
Carried by.the following vote of the Council:
Ayes: -Councilmen: Jackson, Ortuno,

Noes: Councilman: Seltzer Absent: None DENIED
Councilman Seltzer stated that in voting
against the appeal he was not upholding
Ordinance #343 as he had not voted for'it
any time feeling that the ordinance is
not legal and not a just ordinance. He
stated further that he felt consideration
of that area for industrial should be
made by Council and would be lad to con-
sider a change of Ordinance #409.
At this point Mr. Leland S. Bower, attorney
for Assets Reconstruction Corporation,
came forward and served Mayor Jones with a
court summons and also served the City
Clerk with a similar summons. Both were
referred to Acting City Attorney Snidow.
The Clerk announced that three bids had
been received in answer to Notice Inviting
Bids for transformers.
Moved by Councilman Memmesheimer, second-
ed by Councilman Jackson the bids be now
opened, examined and publicly declared.

Seltzer, Memmesheimer, Jones.

A petition containing 18 signatures of
property owners on San Gabriel Avenue
between Sixth Street and Santa Fe Avenue
was filed with Council requesting a zone

Councilman Seltzer the matter be referred
to the Planning Commission for recommendation
and clarification of previous recommendations.

A communication from the Assembly California
Legislature was Pee relative to tide-
land reclamation and development and grade
separation crossings was read and ordered COMMUNICATIONS
placed on file.
The Oath or Affirmation of Allegiance for
Civil Defense Workers and Public Employees OATH OF ALLEGIANCE
was read and each member of Council signed
an oath.
A resolution of the County of Los Angeles
relative to an engraved scroll -for -the
City casting the greatest percentage of
votes was read and ordered filed.
A notice of hearings before the Public
Utilities Commission was read and ordeed HEARING BEFORE PUBLIC
placed on file. UTILITIES COMMISSION
A statement for medical care to a prisoner
by the Los Angeles County General Hospital
was read and referred to the Attorney for
checking. Acting City Attorney Snidow MEDICAL CARE FOR PRISONER
stated that the law required that type
claim be paid by the City and the Clerk was
instructed to check with the Chief of Police
and prepare demands for payment if facts
warrant.
A Proclamation designating October 24.. 1950
as a day of special commemoration in honor
of the fifth birthday of the United Nations UNITED NATIONS' BIRTHDAY
was read and signed by the Councilmen.
The Treasurer's monthly report was ordered
placed on file. Council discussed the pur-
chase of bonds and Councilman Jackson was
requested to contact the auditor relative PURCHASE OF GOVERNMENT
to the purchase of bonds and report back. BONDS
A request for interpretation on collection SALES TAX
of sales taxes was referred to the Acting
City Attorney.
A letter from the Air Pollution Control
District was ordered placed'on file.
A copy of an sp proved license for the 375th
Military Police Company was ordered MILITARY POLICE

The matter of appointing a person to
fill the vacancy on the Park and Re-
creation Commission was discussed.
Mayor Jones suggested the name of Mrs.
Peter Ramirez and Councilman Memmesheimer
withdrew his previously suggested
nomination of Mrs. Bud Latta. A unanimous
vote was cast placing Mrs. Peter Ramirez
on the Park and Recreation Commission.

Councilman Jackson went on record as stating
that he was voting against this resolution
because Alvarez had failed to pass the COIRICILMN'JACKSON IS
written civil service examination and was STATEt;.ENT
not voting against the other three appointees.
Councilman Ortuno stated for the record
that none of the other officers on duty
or on the police force had taken or were
required to take the examination and that
Alvarez had been on the force and was ex-
perienced help.
Mayor Jones stated as a matter of record
that Alvarez had come highly recommended
by the Police Chief and had done outstanding
work in. the Police Department and has work-
ed well and conscientiously.
Councilman Memmesheimer offered a resolution

A letter from the County Board of Supervisors
was read relative to Civil Defense and

Disaster Relief and the Clerk -was in-
structed to furnish a copy to Charles
Shelton.
After discussion of the paving of
portions of community streets on Paramount
Avenue, it was moved by Councilman
Seltzer, seconded by Councilman Ortuno PAVING ON PARAMOUNT AVE.
the work be done by the City providing
it is legal and that a surety bond or cash
is posted by the subdivider before the
work is done to secure payment to the City.

A. J. Hartzell reported on an investigation
of Christmas decorations for the City and
displayed samples which are available for
purchase. After discussion, however, it
was moved by Councilman Ortuno, seconded CHRISTMAS DECORATIONS
by Mayor Jones Council authorize expenditure
for Christmas decorations by the Chamber
of Commerce from the Music and Promotion
Fund and retain the Jones Decorating Company
to do the decorating. Also that a letter
be written to the Azusa Retail Businessmen's
Association advising -them of action taken -
and requesting a more definite committment
of their financial cooperation.
