SUMMARY:
On October 8, 2015, Assembly Bill 1236 signed into law adding Government Code Section
65850.7 requiring jurisdictions with a population of less than 200,000 to adopt an ordinance that
creates an expedited, streamlined permitting process for electric vehicle charging stations (EVCS)
by September 30, 2017. The proposed ordinance adopts procedures consistent with the requirements
of the new law.
RECOMMENDATION:
Staff recommends the City Council take the following actions:
1) Waive further reading, read by title only and introduce Ordinance No. 2017-12, an
Ordinance of the City of Azusa adding Section 14-12 of Article I of Chapter 14 to the
Azusa Municipal Code relating to the expedited and streamlined permitting
procedures for electric vehicle charging stations.
DISCCUSION
On October 8, 2015, the Governor signed AB 1236 which modified the Electric Vehicle
Charging Stations Open Access Act. AB 1236 requires each city and county with a population of
less than 200,000 residents to adopt an ordinance that creates an expedited electric vehicle charging
station permitting process by September 30, 2017. The new law, codified in Government Code
65850.7, requires cities and counties to substantially conform their expedited, streamlined
permitting process to recommendations contained in the current version of the Zero-Emission

Vehicles in California: Community Readiness Guidebook. The purpose of the law is to further the
State Policy on promoting and encouraging the installation of electric vehicle charging stations
and limiting obstacles to their use.
Specifically, AB 1236 requires local jurisdictions to:
Adopt checklists of all requirements for which a EVCS system shall
comply to be eligible for expedited review;
Allow the use of electronic signatures on relevant permitting documents;
Approve an application that meets all of the prescribed requirements;
Allow for electronic submittal of the expedited permit documents;
Complete an expedited review with noticing requirements to the applicant if their submittal is
incomplete.
As required by AB 1236, the City of Azusa Building Division web page has been updated and now
includes the following:
Procedures for on line submitting of Electric Vehicle Charging Stations plans and applications;
Eligibility Check List for Residential Electric Vehicle Charging Stations;
Eligibility Check List for Commercial Electric Vehicle Charging Stations;
Eligibility Check List for Multi Family Electric Vehicle Charging Stations;
Residential EV Charger Guidelines.
ENVIRONMENTAL DETERMINATION:
This Ordinance does not commit the City to any action that may have a significant effect on the
environment. As a result, such action does not constitute a project subject to the requirements of the
California Environmental Quality Act (CEQA).
FISCAL IMPACT:
There is no anticipated fiscal impact as the costs to implement the expedited permitting process will
be recovered through existing building permit fees.

AN ORDINANCE OF THE CITY OF AZUSA ADDING SECTION 14-12 OF
ARTICLE I OF CHAPTER 14 TO THE AZUSA MUNICIPAL CODE RELATING TO
THE EXPEDITED AND STREAMLINED PERMITTING PROCEDURES FOR
ELECTRIC VEHICLE CHARGING STATIONS
WHEREAS, the State of California and the City of Azusa has consistently promoted and
encouraged the use of fuel-efficient electric vehicles; and
WHEREAS, the State of California recent adopted Assembly Bill 1236, which requires
local agencies to adopt an ordinance that creates an expedited and streamlined permitting process
for electric vehicle charging systems; and
WHEREAS, creation of an expedited, permitting procedure for electric vehicle charging
stations would facilitate convenient charging of electric vehicles and help reduce the City’s
reliance on environmentally damaging fossil fuels.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 14-12 is added to the City of Azusa Municipal Code to read in full as
follows:
Section 14-12 “Expedited, streamlined permitting process for electric vehicle stations”.
The purpose of this Chapter is to promote and encourage the use of electric vehicles by
creating an expedited, streamlined permitting process for electric vehicle charging stations,
promote public health and safety, and prevent specific, adverse impacts in the installation and
use of such charging stations. This Chapter is also purposed to comply with California
Government Code Section 65850.7.
SECTION 2. DEFINITIONS
(a)“Electric vehicle charging station” or “charging station” means any level of
electric vehicle supply equipment station that is designed and built in compliance with Article
625 of the California Electrical Code, as it reads on the effective date of this Chapter, and
delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle.
(b)“Specific, adverse impact” means a significant, quantifiable, direct, and
unavoidable impact, based on objective, identified, and written public health or safety standards,
policies, or conditions as they existed on the date the application was deemed complete.
(c)“Electronic submittal” means the utilization of one or more of the following:
a.Electronic mail or email;
b.The internet; or
c.Facsimile.

SECTION 3. EXPEDITED PERMITTING PROCESS
Consistent with Government Code Section 65850.7, the Building Official shall
implement an expedited, streamlined permitting process for electric vehicle charging stations,
and adopt a checklist of all requirements with which electric vehicle charging stations shall
comply with in order to be eligible for expedited review. The expedited, streamlined permitting
process and checklist may refer to the recommendations contained in the most current version of
the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission
Vehicles in California: Community Readiness Guidebook” as published by the Governor’s
Office of Planning and Research. The City’s adopted checklist shall be published on the City’s
website.
SECTION 4. PERMIT APPLICATION PROCESSING
(a) Prior to submitting an application for processing, the applicant shall verify that
the installation of an electric vehicle charging station will not have specific, adverse impacts to
public health and safety and building occupants. Verification by the applicant includes, but is
not limited to: electrical system capacity and loads; electrical system wiring, bonding and
overcurrent protection; building infrastructure affected by charging station equipment and
associated conduits; and areas of charging station equipment and vehicle parking.
(b) A permit application that satisfies the information requirements in the City’s
adopted checklist shall be deemed complete and shall be promptly processed. Upon
confirmation by the Building Official that the permit application and supporting documents meet
the requirements of the City adopted checklist, and is consistent with all applicable laws and
health and safety standards, the Building Official shall, consistent with Government Code
Section 65850.7, approve the application and issue all necessary permits. Such approval does
not authorize an applicant to energize or utilize the electric vehicle charging station until
approval is granted by the City. If the Building Official determines that the permit application is
incomplete, he or she shall issue a written correction notice to the applicant, detailing all
deficiencies in the application and any additional information required to be eligible for
expedited permit issuance.
(c) Consistent with Government Code Section 65850.7, the Building Official shall
allow for electronic submittal of permit applications and associated supporting documentations
covered by this Ordinance. In accepting such permit applications, the Building Official shall
also accept electronic signatures on all forms, applications, and other documentation in lieu of a
wet signature by any applicant.
SECTION 5. TECHNICAL REVIEW
(a) It is the intent of this Ordinance to encourage the installation of electric vehicle
charging stations by removing obstacles to permitting for charging stations so long as the action
does not supersede the Building Official’s authority to address higher priority life -safety
situations. If the Building Official makes a finding based on substantial evidence that the electric
vehicle charging station could have a specific adverse impact upon the public health or safety, as
defined in this Chapter, the City may require the applicant to apply for a use permit.
(b) In the technical review of a charging station, consistent with Government Code
Section 65850.7, the Building Official shall not condition the approval for any electric vehicle
charging station permit on the approval of such a system by an association, as that term is
defined by Civil Code Section 4080.
SECTION 6. ELECTRIC VEHICLE CHARGING STATION INSTALLATION
REQUIREMENTS
(a) Electric vehicle charging station equipment shall meet the requirements of the
California Electrical Code, the Society of Automotive Engineers, the National Electrical
Manufacturers Association, accredited testing laboratories such as Underwriters Laboratories,
and rules of the Public Utilities Commission or a Municipal Electric Utility Company regarding
safety and reliability.
(b) Installation of electric vehicle charging stations and associated wiring, bonding,
disconnecting means, and overcurrent protective devices shall meet the requirements of Article
625 and all applicable provisions of the California Electrical Code.
(c) Installation of electric vehicle charging stations shall be incorporated into the load
calculations of all new or existing electrical services and shall meet the requirements of the
California Electrical Code. Electric vehicle charging equipment shall be considered a continuous
load.
(d) Anchorage of either floor-mounted or wall-mounted electric vehicle charging
stations shall meet the requirements of the California Building or Residential Code as applicable
per occupancy, and the provisions of the manufacturer’s installation instructions. Mounting of
charging stations shall not adversely affect building elements.
SECTION 7. CEQA. The City Council hereby finds and determines that it can be see with
certainty that there is no possibility that this ordinance may have a significant adverse effect on
the environment. This ordinance does not result in any direct development of any parcel of land
or direct physical changes to the environment. Thus, the adoption of this ordinance is exempt
from the requirements of the California Environmental Quality Act (CEQA) pursuant to Sectio n
15061 (b) (3) of the CEQA Guidelines.
SECTION 8. SEVERABILITY. If any section, subsection, phrase, or clause of this ordinance
is for any reason held to be unconstitutional, such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council hereby declares that it would have passed
this ordinance and each section, subsection, phrase or clause thereof irrespective of the fact that
any one or more sections, subsections, phrases, or clauses be declared unconstitutional.
SECTION 9. CERTIFICATION/SUMMARY. The City Clerk shall certify the passage of this
ordinance and shall, with fifteen (15) days after the passage and adoption thereof, cause the
same to be published as required by law, in a local weekly newspaper of general circulation and
which is hereby designated for that purpose. Alternatively, the City Clerk may cause a summary
of this Ordinance to be prepared and published as provided by California Government Code
Section 36933 (c) (1). The summary shall be published in a local weekly newspaper of general
circulation and a certified copy of the full text of this Ordinance shall be posted in the Office of
the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is
to be adopted. Within fifteen days (15) days after the adoption of this Ordinance, the City Clerk
shall cause a summary to be published in a local weekly newspaper of the general circulation
with the names of those City Council members voting for and against this Ordinance and shall
post in the Office of the City Clerk a certified copy of the full text of this Ordinance along with
the names of those City Council members voting for and against this Ordinance.
SECTION 10. EFFECTIVE DATE. This ordinance shall take effect thirty (30) days after
its passage or on September 30, 2017, whichever is later.

Submittal Requirements Bulletin — Expedited Permitting Process for
Electrical Vehicle Charging Station (EVCS)
This bulletin is provided to guide permit applicants through an expedited permitting process for
Electric Vehicle Charging Stations. This bulletin provides information about submittal
requirements for plan review, required fees and inspections.
There are different types of Electric Vehicle (EV) Chargers, (Level 1 and Level 2).
1.Level 1 chargers are smaller units that plug directly into a standard 120 volt receptacle
outlet. These types of chargers do not require a permit from the Building Division as long as
there are not changes to the electrical system to provide the 120 volt receptacle. Any
changes to an electrical system require a permit prior to commencing the work.
2.Level 2 charging systems require a 240 volt electrical circuit. Level 2 charger
installations require an electrical permit and inspections of the installation. In order to
obtain the permit you will need to provide some basic information demonstrating electrical
service capacity for the added load.

1.Completed permit application form. The permit application is fillable online or can be

2.Complete the appropriate Eligibility Checklists for expedited review. The Eligibility
checklist is fillable online or can be downloaded at http://www.ci.azusa.ca.us/.

These checklists have been developed to streamline the permit, installation and inspection
process. As you complete the applicable checklist, you will be guided as what plans,
documents or information you need to provide.

Residential EVCS
Residential EVCS submittal requires a site/floor plan, a completed application, a completed
eligibility “Checklist for Single Family Residential” and a completed “Residential EV Charger
guideline form.
Commercial and Multifamily EVCS
Commercial and Multifamily EVCS submittal require a completed application, a completed
“Checklist for Commercial or Multifamily EVCS “and must be accompanied with the following:
1. A site plan and electrical plan with a single-line diagram. The site plan must be fully
dimensioned and drawn to scale and include the following information:
a. Showing location, size and use of all structures
b. Showing location of electrical panel for charging system
c. Showing type of charging system and mounting.
2. Electric load calculation worksheet.
3. Additional information based on response to questions in checklist, most commonly:
a. EVCS manufacturer specification and installation
b. Amperage and location of existing electrical services panels
c. Disconnecting means for high amperage charging units
d. Approval Listing of charging equipment by Nationally Recognized Testing Laboratory
(NRTL)
e. Information on trenching per checklist if trenching is part of this application
Plan Review
1. Permit applications, plans and other required forms may be submitted to the City of Azusa
Building Division in person at: 213 East Foothill Blvd. or; Submitted on line at
http://www.ci.azusa.ca.us/. City Building Division staff will review your application and
submitted information within 7 business days.
2. As part of the plan review process, all EVCS must be cleared by the Azusa Light Department.
Every submitted plan will be routed to the Azusa Light Department for clearance. If the
Azusa Light Department is unable to clear you plan for permit issuance, you will be notified.
3. Plan review fees will be collected at the time of permit issuance. For an estimate on your
plan review fees, please contact the Building Division at (626) 812-5234.
Permit fees and Permit Issuance
Once the EVCS plan is approved you will be contacted by Building Division staff informing you
the plan is approved and the permit can be issued once all fees are paid. Single residential EVCS
permit fees are $ 139.53, unless additional electrical work is performed. Commercial
multifamily, and single residential with added electrical work will vary and the fee will be
determined after the permit application is accepted. Permits can only be issued in person at
the City of Azusa Building Division located at 213 E. Foothill Blvd.
Inspections
Once all permits to construct the Electric Vehicle Charging Station have been issued and the
system has been installed, it must be inspected before final approval is granted for the EVC
system. On-site inspections can be scheduled by contacting Building Division at (626) 812-5234.
Permit holders must be prepared to show conformance with all technical requirements in the
field at the time of inspection. The inspector will verify that the installation is in conformance
with applicable code requirements and with the approved plans.

The purpose of this guideline is to assist permit applicants in streamlining the
permitting, installation and inspection process for Residential EV Chargers.
Be aware that there are different types of Electric Vehicle (EV) Chargers. There are 2
basic types of EV chargers for home use (Level 1 and Level 2). Level 1 Chargers are smaller units that plug
directly into a standard 120 volt receptacle outlet. These types of chargers typically require a longer period of
time to recharge the vehicle. As long as the receptacle outlet being used to plug-in the Level 1 Charger is
existing, there is no requirement to secure a permit from the Building and Safety Division. On the other hand,
if you will be installing a new 120 volt receptacle outlet for the charger, you will need to obtain a permit – but
you will not need to provide any plans or electrical load calculations as would be required for the more
powerful Level 2 type charging systems.
A Level 2 EV charging system requires a 240 volt electrical circuit and charges the vehicle battery much
faster than a Level 1 charger. Level 2 charger installations typically require an electrical permit and
inspections of the installation. In order to obtain the permit you will need to provide some basic information to
show that your existing electrical service can handle the added load.
What information do I need to provide in order to obtain the permit? This Residential EV
Charger Permit Guideline has been developed to streamline the permit, installation and inspection process.
In most cases, you or your contractor merely need to fill-in the blanks on this document, attach the
manufacturer’s installation instructions and charger specifications and submit it to the Building and Safety
Department for an over-the-counter review and permit issuance. If all of the information is provided and the
proposal complies with the applicable codes, the review and approval process can usually be performed over-
the-counter or within a day or two depending upon workloads and staffing levels at the time of submittal. Once
the permit is issued, the installation may begin. When the installation is complete, an inspection of the work
must be scheduled with the Building Inspector. Inspections are typically performed on the work day following
your request for inspection. Keep in mind that someone will need to be present during the inspection so that
the Building Inspector can access the location of the electrical meter and EV charger (typically in the garage).
Installing a Level 2 EV Charging system often requires changes to building’s electrical wiring.
Before installing the EV charging equipment and the associated wiring, talk to your EV
manufacturer about the electrical requirements for the charger unit to be installed at your home.
When installing your EV charger, be sure to use a licensed Electrical contractor whose state
contractor’s license and insurance are current. The contractor should follow the installation instructions of the
EV charger manufacturer and the requirements of California Electrical Code.
Why is the Electric Utility concerned about your EV charger installation?
Though an individual Level 2 EV charger may have a negligible impact on the utility electric system, the
combined effect of several chargers in the same neighborhood could result in overloads on utility secondary
wires and transformers. It is important that the Electrical Utility provider be notified of any Level 2 charger
installations to ensure that utility electrical system components are adequately sized to maintain high levels of
service reliability.

other provisions that may be applicable to the installation of a new electrical circuit.
Installers are cautioned to be aware of all applicable requirements before beginning the
installation. For additional information or guidance, consult with the Building and Safety
Division staff or a qualified and experienced Electrical Contractor.

GENERAL INSTALLATION GUIDELINES FOR LEVEL 2 RESIDENTIAL EV CHARGERS
1. GENERAL REQUIREMENTS - All Electrical Vehicle Charging Systems shall comply
with the applicable sections of the California Electrical Code, including Article 625.
2. EQUIPMENT HEIGHT - The coupling means of the Electric Vehicle Supply
Equipment shall be stored at a height of 18 – 48 inches above the finished floor.
(CEC Art 625.29(B)).
3. LISTED EQUIPMENT - All Electric Vehicle Supply Equipment shall be listed by a
nationally recognized testing laboratory.
4. FASTENED IN PLACE - Level 2 Electric Vehicle Supply Equipment must be
permanently connected and fastened in place in accordance with the manufacturer’s
installation instructions (CEC Art. 625.13).
5. PROTECTION FROM PHYSICAL DAMAGE - Electrical Vehicle Supply Equipment
shall be protected against vehicle impact damage when located in the path of a
vehicle. In order to avoid the installation of a substantial pipe bollard as an
equipment guard, locate the Electrical Vehicle Supply Equipment on a garage side
wall, out of vehicular path. (see sample drawing below) (CEC Art. 110.27(B))
6. IF MORE THAN 60 AMPS- When EV charging equipment is rated at more than 60
amps, the disconnect means shall be provided and installed in a readily accessible
location and shall be capable of being locked on the open position. (CEC Art.
625.23)
