PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items within the subject matter jurisdiction of the council/agency board that are not listed on this agenda or are listed on this agenda as air item other than a public hearing item. Members of the audience will have the opportunity to address the city council/agency board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the council/agency board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. The council/agency board will respond after public comment has been received. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments shall be handled after the speaker has completed his/her comments. SCHEDULED ITEMS FIRST READING OF ORDINANCE AMENDING CHAPTER 88.22 — NEIGHBORHOODS AMENDING SECTION 88.30.014 — DWELLING UNIT MINIMUM FLOOR AREA, AMENDING SECTION 88.36.050 — NUMBER OF PARKING _SPACES REQUIRED — TABLE 3-7 PARKING REQUIREMENTS, S AMENDING SECTION 88.42.020 — ACCESSORY STRUCTURES DELETING SECTION 88.42.190 — SECOND UNITS AND CARRIAGE HOUSES ADDING SECTION 88.42.190 — ACCESSORY DWELLING UNITS, AND AMENDING SECTION_ 88.70.020 — DEFINITIONS OF SPECIALIZED TERMS AND PHRASES OF THE AZUSA MUNICIPAL CODE PERTAINING TO ACCESSORY DWELLING UNIT REGULATIONS. Statutorily exempt from the requirements of CEQA pursuant to Section 21080.17 of the Public Resources Code because it is an ordinance regarding second units in a single-family or multifamily residential zone to implement the provisions of Government Code Section 65852.1 and 65852.2. AMENDMENT TO SPECIAL EVENT PERMIT AGREEMENT BETWEEN CITY OF AZUSA AND BR_OOKSEE, LLC, TO CONDUCT A MARATHON AND A HALF MARATHON FOOTRACE THROUGH THE CITY OF AZUSA IN 2018 AND 2019. RECOMMENDED ACTION: 1) Approve an amendment to the Special Event Permit Agreement with Brooksee, LLC., for the REVEL Canyon City 2018 Marathon and Half Marathon and REVEL Canyon City 2019 Marathon and Half Marathon; and 2) Authorize the City Manager to execute an amendment, in a form acceptable to the City Attorney, on behalf of the City. E. CONSENT CALENDAR The Consent Calendar adopting the printed recommended actions will be enacted with one vote. If Councilmembers or Staff wish to address any item on the Consent Calendar individually, it will be considered under SPECL4L CALL ITEMS. 1. MINUTES OF THE REGULAR MEETING OF NOVEMBER 6 2017 AND SPECIAL MEETING OF NOVEMBER 27, 2017. RECOMMENDED ACTION: Approve minutes as written. 2. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED NOVEMBER 2, x017 THROUGHNOVEMBER 29, 2017. RECOMMENDED ACTION: Adopt Resolution No. 2017-C74 allowing certain claims and demands and specifying the funds out of which the same are to be paid. 3. HUMAN RESOURCES ACTION ITEMS. RECOMMENDED ACTION: Approve the following Personnel Action Requests in accordance with the City of Azusa Civil Service Rules Section 5.7.5 and applicable Memorandum of Understanding(s). 12/4/2017 - 3 - 4. CITY TREASURER'S STATEMENT OF CASH AND INVESTMENT BALANCES FOR THE MONTH OF SEPTEMBER 2017. RECOMMENDED ACTION: Receive, review, and file the City Treasurer's Report for the month of September 2017. 5. AWARD A CONSTRUCTION MANAGEMENT, PROJECT MANAGEMENT, AND INSPECTION SERVICES AGREEMENT FOR THE AZUSA LIBRARY AMERICANS WITH DISABILITIES ACT (ADA) COMPLIANT RESTROOM RETROFIT AND IMPROVEMENT PROJECT f [COMMUNITY DEVELOPMENT BLOCK GRANT PROJECT (CDQG) 601863-171. RECOMMENDED ACTION: Award a Professional Services Agreement for a total not -to -exceed amount of $70,026, which includes a 10% contingency for potential change orders as needed, to HR Green to provide construction management, project management and inspection services for the Azusa Library ADA Compliant Restroom Retrofit and Improvement Project; and Authorize the Interim City Manager to execute a Professional Services Agreement, in a form acceptable to the City Attorney, on behalf of the City. 6. APPROVE THE PLANS AND SPECIFICATIONS FOR THE ALOSTA AVENUE SUBDRAIN PROJECT AND AUTHORIZE STAFF TO SOLICIT A NOTICE OF INVITING BIDS — CIP PROJECT 66515A. RECOMMENDED ACTION: Approve the project plans and specifications; and Authorize Staff to solicit a Notice of Inviting Bids for the Alosta Avenue Subdrain Project. 7. APPROVE ANNUAL MAINTENANCE AGREEMENT WITH SPILLMAN TECHNOLOGIES. RECOMMENDED ACTION: Approve a Maintenance Agreement with Spillman Technologies for all current software programs for the period of December 1, 2017 through November 30, 2018 in the amount of $71,139.24; and Authorize the City Manager to execute the Maintenance Agreement, in a form acceptable to the City Attorney, on behalf of the City. 8. APPROVE LEASE AGREEMENTS WITH ENTERPRISE FLEET MANAGEMENT FOR THE REPLACEMENT OF SIX VEHICLES. RECOMMENDED ACTION: Waive competitive bidding as authorized under Azusa Municipal Code Section 2.521(a) and approve lease agreements with Enterprise Fleet Management for the lease of six (6) replacement vehicles through the use of a bid with TIPS -USA; and Authorize the Interim City Manager to execute lease agreements with Enterprise Fleet Management, in a form acceptable to the City Attorney, on behalf of the City. 12/4/2017 - 4 - 9. APPROVAL OF AMENDED AND RESTATED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE AZUSA INTERNATIONAL BROTHERHOOD ELECTRICAL WORKERS (IBEW), AND APPROVAL OF AMENDED AND RESTATED MIDAMERICA ADMINISTRATIVE & RETIRMENT SOLUTIONS INC.,_ HEALTH REIMBURSEMENT ARRANGEMENT PLAN DOCUMENT BETWEEN THE CITY AND THE AZUSA INTERNATIONAL BROTHERHOOD ELECTRICAL WORKERS (IBEW). RECOMMENDED ACTION: Approve amended and restated Memorandum of Understanding between the City and the Azusa International Brotherhood Electrical Workers (IBEW); and Authorize the City Manager to execute the amended and restated Memorandum of Understanding, in a form acceptable to the City Attorney, on behalf of the City; and Adopt Resolution No. 2017-C75 to amend and restate the MidAmerica Administrative & Retirement Solutions, Inc. Health Reimbursement Arrangement Plan Document for Azusa International Brotherhood Electrical Workers (IBEW). 10. ADOPT RESOLUTION NO. 2017-C76 ESTABLISHING THE EMPLOYEE PAID MEMBER CONTRIBUTION UNDER THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM FOR THE AZUSA INTERNATIONAL BROTHERHOOD ELECTRICAL WORKERS (IBEW). RECOMMENDED ACTION: Adopt Resolution No. 2017-C76 establishing the Employee Paid Member Contribution under the California Public Employees' Retirement System for the Azusa International Brotherhood Electrical Workers (IBEW). 11. AWARD A PROFESSIONAL SERVICES AGREEMENT TO HR GREEN PACIFIC, INC. TO PROVIDE PROFESSIONAL ENGINEERING SERVICES RELATED TO THE ALOSTA AVENUE STREET IMPROVEMENTS PROJECT. RECOMMENDED ACTION: Award a professional services agreement to HR Green Pacific Inc. for a total not -to -exceed $61,336.24, which includes a 10% contingency for potential change orders as needed, for the Alosta Avenue Street Improvements Project; and Authorize the Interim City Manager to execute a professional services agreement, in a form acceptable to the City Attorney, on behalf of the City. 12. AWARD OF CONTRACT FOR CONTRACTING OF RENTALS AND CATERING SERVICES FOR THE AZUSA WOMAN'S CLUB TO THE BASHFUL BUTLER. RECOMMENDED ACTION: Award a contract to The Bashful Butler for the contracting of rentals and catering services for private party events held at the Azusa Woman's Club for a (3) year term, commencing on December 5, 2017 and concluding November 30, 2020; and Authorize the Interim City Manager to execute the contract, in a form acceptable to the City Attorney, on behalf of the City. 13. APPROVE A TEMPORARY LICENSE AGREEMENT WITH OLSON URBAN HOUSING LP FOR THE TEMPORARY PARKING OF PASSENGER VEHICLES AND LIGHT TRUCKS ON CITY OWNED PROPERTY LOCATED AT THE SOUTHEAST CORNER OF AZUSA AVENUE AND NINTH STREET. 12/4/2017 - 5 - RECOMMENDED ACTION: Approve the Temporary License Agreement with Olson Urban Housing, LP for the temporary parking of passenger vehicles and light trucks on City owned property through May 31, 2018 subject to any non - substantive changes made by the Interim City Manager and City Attorney; and Authorize the Interim City Manager to execute the Temporary License Agreement, in a form acceptable to the City Attorney, on behalf of the City. F. SUCCESSOR AGENCY RELATED BUSINESS. 1. RESOLUTION AUTHORIZING PAYMENT OF WARRANTS BY THE SUCCESSOR AGENCY DATED NOVEMBER 2.2017 THROUGH NOVEMBER 29.2017. RECOMMENDED ACTION: Adopt Resolution No. 2017-R16 allowing certain claims and demands to be paid out of Successor Agency Funds. 2. REFUNDING RESULTS OF 2007A AND 2007B TAX ALLOCATION BONDS WITH 2017 TAX ALLOCATION REFUNDING BONDS. RECOMMENDED ACTION: Receive and file 2007A and 2007B Tax Allocation Bonds refunding results. G. ORDINANCES/SPECIAL RESOLUTIONS SECOND READING OF ORDINANCE NO. 2017-12 ADDING SECTION 14-12 OF ARTICLE I OF CHAPTER 14 TO THE AZUSA MUNICIPAL CODE RELATING TO THE EXPEDITED AND STREAMLINED PERMITTING PROCEDURES FOR ELECTRIC VEHICLE CHARGING STATIONS. The proposed Code Amendment is not subject to the California Environmental Quality Act ("CEQA') pursuant to Sections 15060(c)(2), and 15060(c)(3) because the activity is not aproject as defined in Section 15378 of the CEQA Guidelines, California Code of regulations, Title 14, Chapter 3. In addition, the project is exempt from environmental review per CEQA under the General Rule (Section 15061(b)(3)). The project involves updates and revisions to existing regulations. It can be seen with certainty that the proposed Development Code text amendments will have no significant negative effect on the environment. RECOMMENDED ACTION: 1) Read by title only, second reading and adoption of Ordinance No. 2017-12., AN ORDINANCE OF THE CITY OF AZUSA ADDING SECTION 14-12 OF ARTICLE I OF CHAPTER 14 TO THE AZUSA MUNICIPAL CODE RELATING TO THE EXPEDITED AND STREAMLINED PERMITTING PROCEDURES FOR ELECTRIC VEHICLE CHARGING STATIONS. 2. SECOND READING OF ORDINANCE NO. 2017-13 AMENDING SECTION 2-1 OF ARTICLE I OF CHAPTER 2 OF THE AZUSA MUNICIPAL CODE, CHANGING THE GENERAL MUNICIPAL ELECTION DATE FROM MARCH OF ODD -NUMBERED YEARS TO THE STATEWIDE PRIMARY ELECTION IN MARCH OF EVEN -NUMBERED YEARS, COMMENCING WITH THE MARCH 2020 ELECTION IN ORDER TO COMPLY WITH CALIFORNIA SENATE BILL 415. 12/4/2017 - 6 - RECOMMENDED ACTION: 1) Read by title only, second reading and adoption of Ordinance No. 2017-13., AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA AMENDING SECTION 2-1 OF ARTICLE I OF CHAPTER 2 OF THE AZUSA MUNICIPAL CODE, CHANGING THE GENERAL MUNICIPAL ELECTION DATE FROM MARCH OF ODD -NUMBERED YEARS TO THE STATEWIDE PRIMARY ELECTION IN MARCH OF COMMENCING WITH THE MARCH, 2020 ELECTION, CALIFORNIA SENATE BILL 415 H.
