The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. REGULAR SESSION Mayor Rocha called the meeting to order at 7:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ROCHA ABSENT: COUNCILMEMBERS: ALVAREZ ALSO PRESENT Elected Officials: City Clerk Cornejo, City Treasurer Vasquez. Staff Members: City Attorney Martinez, Chief of Police Hunt, Director of Public Works/City Engineer Bobadilla, Director of Human Resources and Risk Management Bragg; Director of Economic and Community Development Christiansen, Director of Information Technology and Library Services Graf, Acting Director of Utilities Lehr, Director of Recreation and Family Services Jacobs, Police Lieutenant Torres, Senior Management Analyst Lacasella, Recreation Superintendent Gonzales, Associate Planner Munoz, Recreation Supervisor Gonzales, Neighborhood Services Coordinator Quiroz, and Chief Deputy City Clerk Garcia. The Pledge of Allegiance was led by Mr. Tony Alvarez. The invocation was given by Reverend Kristina Collins, Sanctuary for Spiritual Living. PUBLIC COMMENT Mr. Tony Alvarez gave an update on Councilmember Alvarez’s health; and thanked the City, friends, and family for their support and prayers. Ms. Jule Arevalo spoke on behalf of the Azusa Woman’s Club Board of Directors; expressed concerns regarding the catering service provided by The Bashful Butler and the RFP process; requested that the Council reconsider awarding the contract to The Bashful Butler; and requested a private meeting with the City Manager and Chief of Police. Mr. Greg Ahern requested that the Council ensure that all aspects of the Rosedale Development Agreement have been completed prior to the Agreement’s expiration date. Ms. Mercedes Castro provided information about the East San Gabriel Valley Coalition homeless outreach; and invited everyone to the Azusa Chamber of Commerce Food and Toy Drive on December 5. Mr. Micheal O’Leary provided information about the State Board of Equalization Election and announced his candidacy. Ms. Yasmin Carroll spoke on behalf of the City Cafe and inquired about the proposal for the Azusa Woman’s Club catering services contract submitted by the City Café and the RFP process. Mr. Lovlesh Tandon expressed his concerns about the process of the Public Comment portion of the City Council meeting; and inquired about the Azusa-RMC JPA meeting and Garcia Trail/Fire Station property transfer of ownership. In response to the public comments, Director of Public Works/City Engineer stated that the Woman’s Club catering contract is on the agenda and can be pulled for discussion should the Council wish to do so; Staff will contact Mr. Ahearn with a response to his inquiries; Staff will be in contact with Mr. Tandon with a response to his inquiry regarding the Fire Station property; and the Azusa-RMC JPA meeting scheduled for December 14, 2017 was canceled due to a conflict and was rescheduled to March 8, 2018. CONSENT ITEM E-1 APPROVED CITY COUNCIL 12/18/2017 REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL Presentation of an “Employee of the Quarter” Certificate to Ginger Antunez, Librarian A Certificate of Recognition was presented to Ginger Antunez, Librarian for being selected as Employee of the Quarter. Mayor Rocha: Request for a Certificate of Recognition for Maria Perez in celebrating 100 years of life It was the consensus of the Council to prepare a Certificate of Recognition for Maria Perez. Mayor Pro-Tem Macias thanked Staff for the successful Winter Fiesta; wished Mr. Micheal O’Leary good luck; thanked Police Captain Fleming and Police Corporal Rodriguez for their service and wished them well in their retirement; and wished Councilmember Alvarez a speedy recovery. Councilmember Carrillo thanked Staff for the Winter Fiesta and Tree Lighting Ceremony; expressed his excitement for the extension of the Metro Gold Line; wished Councilmember Alvarez a speedy recovery and thanked first responders for their assistance. Mayor Rocha asked that everyone keep Councilmember Alvarez in their prayers; thanked Captain Fleming and Corporal Rodriguez for their dedicated service to the community; thanked Senator Hernandez, Assemblymember Rubio, and Supervisor Solis for their donation of hundreds of turkeys to the needy families in Azusa; thanked the Azusa Veteran’s Memorial Committee for the 17 boxes that were sent to service men and women from Azusa; discussed the extension of the Gold Line; announced the following events: December 9-10 – free yard sales, December 9 - Be-a-Walker Program at Memorial Park, December 10 – Breakfast with Santa at Memorial Park, December 10 – Cookies with Santa at the VFW, December 16 – Low Cost Pet Clinic at City Hall gazebo; and asked that everyone keep service men and women in their daily prayers. SCHEDULED ITEMS FIRST READING OF ORDINANCE AMENDING CHAPTER 88.22 – NEIGHBORHOODS, AMENDING SECTION 88.30.014 – DWELLING UNIT MINIMUM FLOOR AREA, AMENDING SECTION 88.36.050 – NUMBER OF PARKING SPACES REQUIRED – TABLE 3-7 PARKING REQUIREMENTS, AMENDING SECTION 88.42.020 – ACCESSORY STRUCTURES, DELETING SECTION 88.42.190 – SECOND UNITS AND CARRIAGE HOUSES, ADDING SECTION 88.42.190 – ACCESSORY DWELLING UNITS, AND AMENDING SECTION 88.70.020 – DEFINITIONS OF SPECIALIZED TERMS AND PHRASES OF THE AZUSA MUNICIPAL CODE PERTAINING TO ACCESSORY DWELLING UNIT REGULATIONS Associate Planner Munoz provided background on recently adopted State Legislation which regulates Accessory Dwelling Units and gave an overview of the proposed code amendment. In response to a question posed by the Council, Associate Planner Munoz stated that a business license and rental registration are required for Accessory Dwelling Units. Mayor Rocha declared the hearing open. City Clerk Cornejo read the affidavit of proof of publication published on November 24, 2017, in the San Gabriel Valley Tribune. Public Comment None given. Moved by Councilmember Carrillo, seconded by Mayor Pro-Tem Macias, and carried by the following vote of the Council to close the public hearing. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: ALVAREZ AMENDMENT TO SPECIAL EVENT PERMIT AGREEMENT BETWEEN CITY OF AZUSA AND BROOKSEE, LLC, TO CONDUCT A MARATHON AND A HALF MARATHON FOOTRACE THROUGH THE CITY OF AZUSA IN 2018 AND 2019 Economic and Community Development Director Christiansen presented the Staff Report stating that Brooksee, LLC has requested to change the date of the marathon to November 17, 2018 and November 16, 2018. Moved by Mayor Pro-Tem Macias, seconded by Councilmember Gonzales and carried by the following vote of the Council to approve an amendment to the Special Event Permit Agreement with Brooksee, LLC. The minutes of the Regular Meeting of November 6, 2017 and Special Meeting of November 27, 2017 were approved as written. 2. Resolution No. 2017-C74 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. Special Call. 4. The City Treasurer’s Statement of Cash and Investment Balances for the month of September 2017 was received, reviewed, and filed. 5. A Professional Services Agreement for a total not-to-exceed amount of $70,026 for construction management, project management, and inspection services for the Azusa Library ADA Compliant Restroom Retrofit and Improvement Project was awarded to HR Green and the Interim City Manager was authorized to execute the agreement in a form acceptable to the City Attorney. 6. The project plans and specifications for the Alosta Avenue Subdrain Project – CIP No. 66515A were approved and Staff was authorized to solicit a Notice of Inviting Bids. 7. A Maintenance Agreement in the amount of $71,139.24 was awarded to Spillman Technologies for all current software programs for the period of December 1, 2017 through November 30, 2018; and the City Manager was authorized to execute the agreement on behalf of the City. 8. Lease Agreements with Enterprise Fleet Management for the lease of six (6) replacement vehicles through the use of a bid with TIPS-USA was approved; and the interim City Manager was authorized to execute the agreements on behalf of the City. 9. An Amended and Restated Memorandum of Understanding between the City and the Azusa International Brotherhood of Electrical Workers (IBEW) was approved; and the City Manager was authorized to execute the agreement on behalf of the City. Resolution No. 2017-C75 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA TO AMEND AND RESTATE THE MIDAMERICA ADMINISTRATIVE & RETIREMENT SOLUTIONS, INC. HEALTH REIMBURSEMENT ARRANGEMENT FOR THE AZUSA INTERNATIONAL BROTHERHOOD ELECTRICAL WORKERS (IBEW) 10. Resolution No. 2017-C76 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTABLISHING THE EMPLOYEE PAID MEMBER CONTRIBUTION UNDER THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM FOR THE AZUSA INTERNATIONAL BROTHERHOOD ELECTRICAL WORKERS (IBEW) PAGE THREE – 12/4/2017 11. A Professional Services Agreement was awarded to HR Green Pacific Inc. for a total not-to-exceed amount of $61,336.24 for the Alosta Avenue Street Improvements Project; and the Interim City Manager was authorized to execute the agreement on behalf of the City. 12. Special Call. 13. A Temporary License Agreement with Olson Urban Housing, LP for the temporary parking of passenger vehicles and light trucks on City owned property through May 31, 2018 was approved; and the Interim City Manager was authorized to execute the Agreement on behalf of the City. SPECIAL CALL The following two items were heard separately but voted on simultaneously. E-3 HUMAN RESOURCES ACTION ITEMS Mayor Rocha expressed his sadness with the separation of Mr. Jacob Morua, Street Maintenance Worker and wished him the best. E-12 AWARD OF CONTRACT FOR CONTRACTING OF RENTALS AND CATERING SERVICES FOR THE AZUSA WOMAN’S CLUB TO THE BASHFUL BUTLER Recreation Supervisor Gonzales provided an overview of the Request for Proposals for catering services and the selection process. City Attorney Martinez described the process of responding to a prospective bidder’s questions about a Request for Proposals or contract ambiguity, which are typically handled prior to the submittal deadline; described the proposal review process; and explained Council’s options for handling the recommended bid proposal. Discussion ensued regarding the bidding process and the continuance of the item to allow time for a meeting with the Woman’s Club; facility damages and maintenance; and concerns from the Azusa Woman’s Club. It was the consensus of the Council to continue the Item to the December 18, 2017 Council Meeting to allow time for a meeting with the Azusa Woman’s Club to address their concerns. Mayor Pro-Tem Macias made a motion, seconded by Councilmember Carrillo and approved by the following vote of the Council to approve Item E-3 and continue Item E-12 to the December 18, 2017 City Council meeting.
