HomeMy WebLinkAboutE-10 Staff Report -Resoulution to execute Grant Agreement with MetroCONSENT ITEM E-10 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: KURT CHRISTIANSEN, FAICP, ECONOMIC AND COMMUNITY DEVELOPMENT DIRECTOR DATE: MAY 7, 2018 SUBJECT: ADOPT RESOLUTION NO. 2018-C38 AUTHORIZING THE EXECUTION OF A GRANT AGREEMENT WITH LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY TO RECEIVE FUNDS FOR THE TRANSIT ORIENTED DEVELOPMENT PLANNING GRANT PROGRAM ROUND 5 TRANSIT ORIENTED COMMUNITIES (TOC) TAX INCREMENT FINANCING (TIF) PILOT PROGRAM FOR A TIF FEASIBILITY STUDY BACKGROUND: The City became aware of a grant opportunity from the Los Angeles Metropolitan Transportation Authority for the Transit Oriented Development Planning Grant Program Round 5 to conduct a feasibility study for the Transit Oriented Communities (TOC) Tax increment Financing (TIF) Pilot Program. At the July 17, 2017 City Council meeting, Staff was authorized to submit an application. The City was a successful applicant and on March 1, 2018, the Los Angeles County Metropolitan Transportation Authority Board of Directors approved the award of grant funds. The proposed action adopts Resolution No. 2018-C38 authorizing Staff to accept the award. RECOMMENDATION: Staff recommends the City Council take the following actions: 1) Adopt Resolution No. 2018-C38, authorizing Staff to accept the award; and 2)Authorize the City Manager to execute a grant agreement with Metro, in a form acceptable to the City Attorney on behalf of the City. ANALYSIS: The Los Angeles County Metropolitan Transportation Authority (Metro) Transit Oriented Development Planning Grant Program (Program) provides funds to local governments to encourage the development and adoption of land use regulations that promote transit oriented development (TOD). May 7, 2018 Page 2 On April 27, 2017 the Metro Board approved Round 5 of the program and a total of $3.1 million in funding became available to the County of Los Angeles and all local governments with land use regulatory jurisdiction within a one-half mile of exiting, planned or proposed Metrolink, Metro Rail or Metro Transitway/Bus Rapid Transit stations and adjacent transit corridors. In Round 5, Metro will fund two programs. The City was eligible to apply to the Transit Oriented Communities (TOC) Tax Increment Financing (TIF) District Pilot Program. This pilot program will fund studies that assess the feasibility of creating a tax increment financing districts which include Community Revitalization and Investment Areas (CRIA) or Enhanced Infrastructure Financing Districts (EIFD). The TIF feasibility study requires that transit supportive land use regulations be in place or under development. TIF can be used to finance infrastructure improvements as well as affordable housing. The program objectives include: • Supporting municipalities in implementing complimentary transit-supportive infrastructure projects and affordable housing; • Increasing transit ridership; • Increasing the number of comprehensive, community-driven transit supportive planning efforts around Metro light rail, Metrolink stations, and Metro Transitway/Bus Rapid Transit stations and adjacent transit corridors in Los Angeles County; • Improving local and regional efforts that enhance an equitable integration of transportation and community planning; • Improving the transit network and increase utilization of public transit by reducing the number of modes of transportation necessary to access regional and local transit lines; • Furthering the reduction in greenhouse gases through encouraging in-fill development along transit corridors and transit use; • Supporting and implementing sustainable development principles; and • Increasing opportunities to meaningfully engage diverse stakeholders, especially underserved and vulnerable communities, in advancing transit supportive planning efforts across the region. The City was awarded a grant in the amount of $141,000 to carry out the feasibility study. The Program is reimbursement-based. Funding will be disbursed on a quarterly basis subject to satisfactory compliance with the expenditure plan and schedule. The program will not require local matching funds. As part of the General and Administrative conditions, the TOC TIF Feasibility Study grant requires a local resolution evidencing the acceptance of the award and authorization to execute a Grant Agreement with Metro. The Agreement will include the statement of work, planning objectives to be achieved, the financial plan reflecting grant amount and any local match, if applicable, as well as a schedule and deliverables. The schedule must demonstrate the project will be completed within 36 months of the date of execution. These actions will authorize Staff to accept the award and authorize the City Manager to execute a Grant Agreement with Metro, in a form acceptable to the City Attorney on behalf of the City. May 7, 2018 Page 3 FISCAL IMPACT: There is no fiscal impact associated with authorizing Staff to accept the grant award and to execute a grant agreement with Metro. The City was awarded a grant in the amount of $141,000. The program is reimbursement-based. Funding will be disbursed on a quarterly basis subject to satisfactory compliance with the expenditure plan and schedule. Staff will prepare a budget amendment once the grant agreement is fully executed. WHEREAS, the City of Azusa has been awarded funding from Los Angeles County Metropolitan Transportation Authority for the Metro Transit Oriented Development Planning Grant Program Round 5; and WHEREAS, the funding opportunity provided by Metro through their Grant Program entitled Metro Transit Oriented Development Planning Grant Program Round 5 in the Transit Oriented Communities (TOC) Tax Increment Financing (TIF) Pilot Program seeks to provide a feasibility study of forming TIF districts. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa does hereby finds, determines and declares as follows: SECTION 1. Accepts funds from Metro for the Transit Oriented Development Planning Grant Program Round 5 Transit Oriented Communities (TOC) Tax Increment Financing (TIF) Pilot Program for a TIF Feasibility Study; SECTION 2. Certifies that the City understands they will work with Metro to meet established deadlines to complete project within 36 months of award; SECTION 3. Certifies that the City understands they will execute a Grant Agreement with Metro; and SECTION 4. Authorizes the City Manager, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project.
