HomeMy WebLinkAboutE-16 Staff Report - Agreement with Michael Baker InternationalCONSENT ITEM E-16 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: KURT CHRISTIANSEN, FAICP, ECONOMIC AND COMMUNITY DEVELOPMENT DIRECTOR DATE: JUNE 4, 2018 SUBJECT: REQUEST TO AMEND PROFESSIONAL SERVICES AGREEMENT WITH MICHAEL BAKER INTERNATIONAL TO PROVIDE PLANNING CONSULTANT SERVICES FOR THE AZUSA TODD PROJECT LOCATED AT 1025 N. TODD AVENUE BACKGROUND: The project, Sierra Todd is proposing to redevelop the Colorama Wholesale Nursery site. The proposed project includes the construction of seven (7) large industrial buildings with a total of 462,491 s.f. The project would require a Design Review and Tentative Parcel Map. It is the City’s intention to hire an environmental consultant, whose service would be paid by Azusa Todd, LCC, to prepare the environmental documents for the project. On April 17, 2017, the City Council approved to solicit a Request for Proposals (RFP) for environmental consultant services for the preparation of Environmental Impact Report (EIR) for the Azusa Todd Project. Staff received proposals from 7 firms. Upon evaluation of the proposals, Staff has identified one firm with the necessary experience required to provide environmental consultant services. This action approves a Professional Services Agreement with Michael Baker International to provide environmental consultant services. On September 18, 2018, the City Council approved Professional Services Agreement with Michael Baker International to provide environmental consultant services for the Azusa Todd Project. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1)Approve a Professional Services Agreement with Michael Baker International to provide planning consultant services in an amount not to exceed $23,300; and 2)Authorize the City Manager to prepare and execute the agreements, in a form acceptable to the City Attorney, on behalf of the City. The Assistant Planner was the project planner on the Azusa Todd Project. The project applicant agreed to have Michael Baker International provide planning consultant services. Michael Baker International is already providing environmental consultant services on the project. FISCAL IMPACT: All costs associated with the consultant project review and environmental document preparation will be paid by the project applicant. The city will add a 25% administrative cost to each of the Professional Service Agreement to cover for staff time. Azusa, California 91702  Subject: Proposal for Planning Services for the Canyon City Business Center Project   Dear Mr. Muñoz:  Michael Baker International, Inc. (Michael Baker) is pleased to submit  this proposal to the City of Azusa for Planning Services to process  entitlements for the Canyon City Business Center Project (“Project”).   The Project proposes to develop approximately 463,316 square feet of  industrial business park and will demolish the existing Colorama  Wholesale Nursery to construct seven industrial buildings with  associated parking, landscaping, and infrastructure improvements.  The  buildings will range from approximately 28,576 s.f. to 161,231 s.f.  Land  uses proposed include industrial uses with office and mezzanine spaces  throughout to support warehouse and manufacturing operations.  The  Project considers two development options for an industrial business  park, one with manufacturing uses and one without manufacturing uses.  Based upon our knowledge of the Project stemming from Michael Baker’s preparation of the  Environmental Impact Report and additional information provided by City staff, we have developed a firm  understanding of the work program required for the project entitlements.    We appreciate your consideration of Michael Baker for Planning Services for the Canyon City Business Use Permit (for 24‐hour business operations)  2. Minor Use Permit (for outdoor storage)  3. Variance (to allow storage containers)  4. Sign Permit for each sign  5. Major Design Review (Site Plan Review)  6. Tentative Parcel Map 77150    TASK 1 – PLANNING ENTITLEMENTS    1.1 Review and Entitlement Processing    Michael Baker will assist the City in the processing of the Project, including review of the Project and  meeting and working with the Applicant and other project stakeholders.  This task includes the following:    1. Project review to identify informational needs, evaluate preliminary design and other merits  issues, and meeting with the Applicant to discuss options for addressing project needs.  2. Coordination meetings with City staff and/or the Applicant.  3. Community information and engagement meetings (if necessary).  4. Preparation of all staff reports, resolutions, findings of fact, and conditions of approval.  Staff  report will include the project description, requested applications, characteristics of the site,  history, surrounding streets and uses, conditions of approval, and other information needed to  fully understand the Project.  5. Processing includes preparation of presentations and attendance and presentations at public  hearings to the Planning Commission and City Council.    Throughout the review and entitlement process, Michael Baker will work with the City to refine the key  tasks and work products required for the overall Project.  Examples of deliverables include:        Scope of Work  5    Examples of Deliverables:    Letters of Completeness/Incompleteness   Memos regarding Design Review results   Notices of Public Hearing for Planning Commission and City Council   Community Meetings: Attendance and presentations   Coordination meetings with the Applicant and preparation of meeting summaries   Planning Commission staff report, conditions of approval, resolutions, and exhibits   City Council staff report, conditions of approval, resolutions, and exhibits   Hearings: Attendance and presentations for hearings at Planning Commission and City Council    1.2 Meetings and Coordination     Michael Baker will attend meetings and hearings as requested by the City.  This task will also include  periodic coordination with City staff and/or the Applicant, including meetings, phone calls, and conference  calls.  The Project Planner will provide regular status reports on the overall Project to City staff.  For the  public hearings, this task assumes one Planning Commission meeting and one City Council meeting.  This  task includes:     Ongoing project coordination; biweekly team conference calls; attendance at strategic team  meetings, as needed   Two (2) public hearing meetings          Schedule and Cost Proposal  6    SCHEDULE The work efforts related to the processing of entitlements for the Project will be ongoing from receipt of  the development applications through the public hearing process.        COST PROPOSAL The Scope of Work presented in this proposal will be provided on a fixed fee basis.  The estimated cost to  complete the Scope of Work is $23,300, which includes expenses for mileage and reproduction costs.  CITY OF AZUSA FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT 1.PARTIES AND DATE. THIS FIRST AMENDMENT TO THE PROFESSIONAL SERVICE AGREEMENT (the “First Amendment” is dated 4 day of June, 2018 by and between the City of Azusa, a municipal corporation organized under the laws of the State of California with its principal place of business at 213 East Foothill Boulevard, Azusa, California 91702 (“City”) and Michael Baker International with its principal place of business at 5 Hutton Centre Drive, Suite 500 Santa Ana, CA 92707 (“Consultant”). City and Consultant are sometimes individually referred to herein as “Party” and collectively as “Parties.” The agreement is hereby amended as follows: 2.RECITALS. 2.1 Consultant. Consultant desires to perform and assume responsibility for the provision of certain professional services required by the City on the terms and conditions set forth in this Agreement. Consultant represents that it is experienced in providing environmental and planning consulant services to public clients, is licensed in the State of California, and is familiar with the plans of City. 2.2 Previous Agreement. Except as expressly provided herein, all other terms and conditions of the Agreement shall remain in full force and effect. 3.TERMS. 3.1 Scope of Services and Term. 3.1.1 General Scope of Services. Consultant promises and agrees to furnish to the City all labor, materials, tools, equipment, services, and incidental and customary work necessary to fully and adequately supply the professional environmental and planning consulting services necessary for the Project (“Services”). The Services are more particularly described in Exhibit “A” attached hereto and incorporated herein by reference. All Services shall be subject to, and performed in accordance with, this Agreement, the exhibits attached hereto and incorporated herein by reference, and all applicable local, state and federal laws, rules and regulations. 3.3 Fees and Payments. 3.3.1 Compensation. Consultant shall receive compensation, including Attachment 1 First Amendment to Professional Service Agreement for Michael Baker International Page 2 of 4 authorized reimbursements, for all Services rendered under this Agreement at the rates set forth in Exhibit “A” attached hereto and incorporated herein by reference. The total compensation shall not exceed twenty three thousand three hundred ($23,300.00) without written approval of the City Council. Extra Work may be authorized, as described below, and if authorized, will be compensated at the rates and manner set forth in this Agreement.
