HomeMy WebLinkAboutE-05 Staff Report - 2018 Fireworks Sales Permits−1− CONSENT ITEM E-5 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: MARTIN QUIROZ, PUBLIC INFORMATION OFFICER DATE: JUNE 4, 2018 SUBJECT: CONSIDERATION OF A RESOLUTION SETTNG THE NUMBER OF TRANSITIONAL FIREWORKS SALES PERMITS AVAILABLE FOR 2018 BACKGROUND: The City Council has previously approved an ordinance related to the issuance of fireworks sales permits. Under this ordinance, a number of legacy fireworks sales permits were issued. In addition, the City Council can set a number of transitional fireworks sales permits to be issued each year. This action adopts a resolution setting the number of transitional fireworks sales permits for 2018. RECOMMENDATION: Staff recommends the City Council take the following action: 1) Approve Resolution No. 2018-C42 setting the number of transitional fireworks sales permits available for 2018. ANALYSIS: On May 21, 2012, the City Council approved an urgency ordinance amending Chapter 30, Article IV, Section 30-132 and adding Section 30-133.5 relating to the issuance of fireworks sales permits. This ordinance created “transitional” fireworks sales permits. These are permits that are no longer being used. As you may recall, there were an original 23 fireworks sales permits issued. As organizations no longer renewed the sales permits, the permits were not reissued to other organizations. With the creation of transitional fireworks sales permits, the City Council has the option to issue these permits to new organizations that meet certain requirements: nonprofit associations or corporations or to other groups that provide services to military personnel and/or their families that are based in the City of Azusa (i.e. have their principal and permanent meeting place in the city limits.). For 2018, the City Council must adopt a resolution setting the number of transitional fireworks sales permits available for 2018. Staff recommends the City Council set the maximum number of transitional fireworks sales permits at six (6). APPROVED CITY COUNCIL 6/4/2018 −2− FISCAL IMPACT: The permit fees include application fee of $356.00, State of California Fee (CASp Fee) $4.00, Fire Inspection Fee $56.00 Building Permit Fee/Electrical $127.31, Scholarship Donation fee of $250, and $500 security deposit. Should the City Council make available six (6) transitional fireworks sales permits and all six (6) are awarded, $1,500 (6 x $250) in scholarship fees will be raised. The remaining fees simply cover actual costs. Prepared by: Reviewed and Approved: Martin Quiroz Sergio Gonzalez Public Information Officer City Manager Attachment: 1) Resolution No. 2018-C42 RESOLUTION NO. 2018-C42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, TO ESTABLISH THE NUMBER OF TRANSITIONAL FIREWORKS SALES PERMITS AUTHORIZED IN 2018 WHEREAS, the City of Azusa created Transitional Fireworks Sales Permits; and, WHEREAS, the City Council has the option to issue these permits to new organizations that meet certain requirements: nonprofit associations or corporations or to other groups that provide services to military personnel and/or their families that are based in the City of Azusa (i.e. have their principal and permanent meeting place in the city limits; and, WHEREAS, the City Council must establish the number of Transitional Fireworks Sales Permits available every year. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City of Azusa hereby authorizes the City Manager to award up to five (5)Transitional Fireworks Sales Permits in 2018. SECTION 2. The deadline to submit 2018 Transitional Fireworks Sales Permit Applications shall be Monday, June 4, 2018 by 12:00 p.m. SECTION 3. The City Clerk shall certify the adoption of this resolution.
