HUNT, CHIEF OF POLICE DATE: JUNE 18, 2018 SUBJECT: RENEWAL OF JAIL PRIVATIZATION SERVICES WITH THE G4S CORPORATION BACKGROUND: The Police Department staff is pleased with the service of the G4S Corporation and is recommending exercising the second of the two optional one year terms as specified in the attached contract. The renewal of this contract is based on the alternative purchasing procedure authorized under Section 2- 253(e) of the Azusa Municipal Code. Under that Section, competitive bidding is not required where a competitive bid procedure has been conducted by another public agency. Here, this requirement is fulfilled by the Request for Proposals to Provide the Operation of the Bell Police Department’s Type 1 Jail Facility completed by the City of Bell in September 3, 2013. The City Attorney’s office has reviewed and approved as to form the proposed renewal of the Operating Contract for the Azusa City Jail with the G4S Corporation for a one year term, effective through June 30, 2019. California law authorizes general law cities to contract out the operation of their jail facilities. (See Penal Code, § 6031.6; see also Costa Mesa City Employees Association v. City of Costa Mesa (2012) 209 Cal. App. 4th 298, 310-311 (holding that Section 6031.6 of the Penal Code “expressly authorizes” general law cities to contract out jail services. RECOMMENDATION: Staff recommends the City Council take the following actions: 1) Approve the renewal of the Operating Contract for the Azusa City Jail with the G4S Corporation for a one year term, effective July 1, 2018. APPROVED CITY COUNCIL 6/18/2018 RENEWAL OF JAIL PRIVATIZATION SERVICES JUNE 18, 2008 Page 2 ANALYSIS: City Council originally approved of the privatization of Azusa’s City Jail with the G4S Corporation (formerly Wackenhut Corporation) in July 1999 in terms of a five year contract. The contract was renewed for five years in July 2004 and again in July 2009. In 2014 the contract was renewed for a three year term with two additional optional one year terms. G4S provides the labor to operate Azusa’s Type I Jail on a year round, 24 hour a day basis. G4S’s performance over the past nineteen years has been commendable. G4S jailers have thwarted many attempt suicides by inmates; they maintain the cleanliness of the jail facility and are in part responsible for the successful inspections by jail oversight entities (e.g., California Standards Authority, Grand Jury, Juvenile Court Commissioner, L.A. County Health and Fire Departments). Highlights of the contract include a minimum of two custody officers on duty for each shift 24 hours a day, one of the custody officers being female to be in compliance with regulations regarding female inmates, and one of the custody officers being bilingual in the Spanish language. FISCAL IMPACT: The proposed FY 2018/19 includes $488,340, approximately a $38,340 increase over the current year budget, for G4S’s services under 10-20-333-000-6493. Each year, any increases in the contract cost is negotiated by Staff and G4S and is restricted as per the terms agreed upon in the contract. It is estimated that if Azusa staffed the jail with the equivalent number of City employed personnel, the cost would be approximately $806,400 annually. Therefore, the contracted services results in an approximate savings of $318,060 annually.
