Present at roll call: Seltzer, Memmesheimer, Snidow and City Clerk. Ortuno'. . Councilmen: Jackson, Jones, City Attorney .Absent: Councilman: Each member present acknowledged receipt of a written copy of the minutes of December 30 1951. The MW or asked if there were any objections or corrections to said minutes. There being none, the minutes of December 3, 1951 were approved as written. Councilman Seltzer offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, GRANTING A VARIANCE ON LOTS 1, 2 AND 3, BLOCK 439 OF MAP OF AZUSA, IN THE SOUTHWEST CORNER.OF SIXTH AND SAN GABRIEL AVENUES, CHANGING THE ZONING FROM R-2 to.C•2 USE, GRANTING PERMISSION TO ALTER THE PRESENT BUILDING AND TO MAINTAIN OFFICES FOR THE PRACTICE OF MEDICINE. Councilman Ortuno entered the meeting and took his seat at the Council table. Moved by Councilman Memmesheimer, seconded by Counoilman Jackson this resolution be adopted as read and numbered Resolution No. 2577. ' The Safeway Store located on Azusa Avenue made application for an off sale liquor license. Councilman Jackson offered a resolution entitled: T.3o P. ROLL CALL MINUTES APPROVED RESOLUTION NO. 2577 ADOPTED A RESOLUTION (F THE CITY COUNCIL OF THE CITY RESOLUTION NO. 2576 OF AZUSA, COUNTY OF LOS ANGELES, STATE OF ADOPTED CALIFORNIA, PROTESTING THE'GRANTING OF AN OFF -SALE LIQUOR LICENSE TO THE SAFEWAY STORE. Moved by Councilman Memmesheimer, seconded by Councilman Ortuno this resolution be adopted as read and numbered Resolution No. 2578. Noes: None Absent: None BEQUEST FOR REQUEST Dan Fay, Jr., Chief of Police of the City of BUSINESS Glendora, advised Council the City of Glendora had approved the purchase of a radio remote RADIO CALLS FOR control transmitter sad receiver for use in CITY OF GLENDORA their Police Department and requested permission to operate through the City of Azusa station, CIVIL SERVICE with all installations being paid for by the EMPLOYIENT LISTS ' City of Glendora. Moved by Councilman Memmesheimer, seconded by Counoilmai Jackson the City Clerk be in- structed to advise Chief Fay that the City of Azusa will grant the request and will monitor radio calls for the City of Glendora under Azusa Station control. Noes: None Absent: None An invitation to attend the ribbon -cutting ceremonies for the opening of the Hollywood INVITATION ORDERED Freeway Downtown from Grand Avenue to Los PLACED ON FILE Angeles Street, was read and ordered placed on file. A letter from Raymond A. Voigt, Field Representative CORRESPONDENCE RE - for the Housing and Home Finance.Agency, was read, relative to Slum Clearance. Mayor Jones suggested FERRED TO CHAIRMAN this matter be referred to Everett Morgan, Chair- OF PLANNING COMMISSIO] man of the Planning Commission. A letter from the League;of California Cities relative to the increase in League dues, was LEAGUE DUES Head. No action taken. A letter signed by William Schultz, Jr. request- Ing a business license to operate an.aztomobile BEQUEST FOR REQUEST aid salvage business at 934W. Foothill BUSINESS Blvd., was read. Moved and carried this matter be referred to the Plaining Commission for recommendation. The Civil Service Employment List 1 for Fire Department and Civil Service Employment List CIVIL SERVICE 3 for -the Police Department were read and EMPLOYIENT LISTS ordered placed on file. Councilman Memmesheimer offered an ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, REGULATING THE COLLECTION OF REFUSE AND RUBBISH, PROVIDING FOR THETYPESAND KINDS OF CONTAINERS AND THE TYPES OF MATERIAL TO BE COLIE CTED AND ORDINANCE NO. 440 PROVIDING FOR THE PAYMENT OF SAID SERVICES IN ADOPTED THE RESIDENTIAL SECTIONS OF THE CITY OF AZUSA. to be placed upon its second reading. Paramount Avenue re- quested that she be not billed the 50 cent monthly charge for rubbis} collection. HONTHLY CHARGE ON RUBBISH COLLECTION ' Moved by Councilman Memmesheimer, seconded by Councilman Seltzer the City Clerk be in- structed to write Miss Herzog advising her that there can be no exceptions, that it must be enforced as it is written. Noes: None Absent: None A letter from the League of California Cities relative to the Disposition of Court Fines LEAGUE CORRESPONDENCE and Forfeitures, was presented. ON COURT FINES Moved by Councilman Memmesheimer, seconded by Councilman Jackson and duly carried this document be placed on file. Councilman Seltzer offered a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING CONSUMERIS AGREEMENT AND ' APPLICATION FOR INSTALLATION OF WATER MAIN. BETWEEN THE CITY OF AZUSA AND LUCKY LAGER RESOLUTION NO. 2579 BREWING COMPANY AND AUTHORIZING THE MAYOR ADOPTED TO SIGN AND THE CITY CLERK TO ATTEST SAME. Moved by Councilman Ortuno, seconded by Councilman Memmesheimer this resolution be adopted as read and numbered Resolution No. 2579. Kendrick's report on the Pacific Electric Bus Route'was-again brought PACIFIC ELECTRIC BUS to the attention of Council. ROUTE Mayor Jones advised Council that he proposed to have a meeting in January relative to this matter and the City Attorney suggested that the City of Glendora be invited to participate as they have a similar problem. The minutes of the meeting,of the Azusa Public PUBLIC LIBRARY REPORT ' Library Trustees were presented sad ordered placed on file. The Park and Recreation Commission recommended the following improvements;be made at the Swimming Pool: rooms repainted] new light fixtures installed, shielded by a wire or RECOTd3RETU>E_TIONs RdADE BY steel framework; key switches be installed; RECO outside floods be repaired. Noes: None Absent: None The Park and Recreation Commission recommended ' the removal of five pepper trees from the parkway in front of Lot 37 at Second Street and Pasadena Avenue. Moved by Councilman Memmesheimer, seconded by Councilman Jackson this request be referred to Councilman Ortuno to check and report back. Noes: None Absent: None The Park and Recreation Commission recommended the removal of one palm tree on the west side of Azusa Avenue fust north of the Santa Fe tracks. Moved by Councilman Seltzer, seconded by Councilman Ortuno Council accept the recommendation of the Park and Recreation Commission aid the matter referred to the Street Superintendent with power to act. Carried by the following vote of the Council: Ayes: Councilmen: Jackson, Ortuno, Seltzer, Memmesheimer, Jones. Noes: None Absent: None The Park and Recreation Commission recommended the removal of pepper trees located in the park- way in the 500 block on Crescent Drive. Moved by Councilman Jackson, seconded by Councilman Memmesheimer this recommendation be referred back to the Park and Recreation Commission for clarification. Noes: None Absent: None City Attorney Snidow reported to Council that he had contacbd the firm of O'Melveny & Myers and was advised that the minimum charge for legal assistance in the 1911 Street Improvement Act proceedings is $350.00 or 2% of the con- tract price. Councilman Jackson requested information ' relative to the increase in gas rates. Moved and carried the City Clerk be instructed to write the League of California Cities to secure information available at this time. The Planning Commission recommended the request of Mobil Homes to build 970 sq. ft. homes in Block 16, Tract 17149 provided the garage set- back to property line be increased to 3 ft. minimum, be granted. Councilman Ortuno the recommendation of the Planning Commission be denied as Council is of the opinion this request does not meet the side -yard requirements. Noes: None Absent: None The Planning Commission reported that the used car lot on West Foothill Blvd. owned and operated by the Azusa Motor Sales was un- sightly. Moved by Councilman Jackson, seconded by Councilman Memmesheimer this report be re- ferred to the City Attorney to check acid re- port back at the neat regular meeting of Council. Absent: None REPORT ON USED CAR LOT REFERRED TO CITY ATTORNE' The Planning Commission recommended that additional tables be placed in the City park and evergreen Chinese elms be planted at the TABLES IN CITY PARK discretion of the Park and Recreation Commission. Moved by Councilman Jackson, seconded by Councilman Memmesheimer this matter be re- ferred to the Park and Recreation Commission to report back. Noes: None Absent: None City Engineer Brooks reported that the City reservoir is now complete.' Superintendent Smith reported that the'in- stallation of lights and water for the 9Dayu Tract had been completed. Dr. Hankins, Fred Smith and others addressed Council relative to the stables erected on city -owned property located north of Eleventh Street and west of Orange Avenue. After some discussion it was moved by Council- man Ortuno, seconded by Councilman Memmesheimer the City Clerk be instructed to check the re- cords to ascertain whether or not the former city councils had granted permission to house animals on this property and to check the deed to the property for limitations as to the use. Moved by Councilman Jackson, seconded by Councilman Ortuno the following requisitions be allowed: 3275-3280; 2181-2190 LW.
