The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Mayor Rocha called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. Mayor Pro-Tem Macias arrived at 6:44 p.m. and Councilmember Carrillo arrived at 7:29 p.m., after roll call. The Pledge of Allegiance was led by Police Chief Hunt. CONSENT ITEM E-1APPROVED CITY COUNCIL 7/17/2017 The invocation was given by Mayor Rocha. CLOSED SESSION REPORT The City Council reconvened at 7:44 P.M.; City Attorney Martinez announced the following regarding Closed Session: Item 1: City Council provided direction to Staff, no reportable action; and Item 2: Councilmember Carrillo was not in attendance; City Council heard a presentation from legal Counsel, no further reportable action. PUBLIC COMMENT Mr. Jorge V. Rosales expressed dissatisfaction for the automobile allowances, the creation of Assistant Director positions, and proposed $100,000 increase in park maintenance costs in Item D-8. Mr. Tyler Laird presented his proposal for the restoration of the Garcia Trail and expressed his concerns about the Council’s Code of Ethics. City Manager Butzlaff stated that he would defer a response to the comments made by Mr. Rosales to the scheduled item and reiterated that he would not make any comments regarding the Garcia Trail unless directed by the Council. REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL City Manager Butlaff stated that the Garcia Trail issue was deferred to the Azusa RMC Joint Powers Authority and encouraged Mr. Laird and other Garcia Trail supporters to attend their meeting as they are now in control of the land that a portion of the Garcia Trail runs through. Mayor Pro-Tem Macias alerted the public about a phone scam that was taking place and expressed his appreciation of the opening of the Slauson Pool. Councilmember Alvarez hoped everyone had a Happy Father’s Day; thanked Staff for their quick response to his request for tree trimming near Memorial Park; and informed the public that cooling center information can be located on the City’s website. Councilmember Gonzales encouraged the use of the cooling centers for those that need it; wished everyone a happy and safe 4th of July; and reminded everyone of the $1,000 fine for the use of illegal fireworks. Councilmember Carrillo encouraged the public to use the cooling centers as needed; reminded everyone that the San Gabriel River should not be used for swimming purposes as it is dangerous; encouraged the support of local non-profits with the purchase of safe and sane fireworks; reminded everyone all firework usage prior to the 4 th of July is illegal; presented a plaque to the City on behalf of the Azusa Softball Little League; provided an update on the Little League softball tournament; and remarked the Code of Ethics in response to a comment made during public participation. Mayor Rocha hoped that everyone had a nice Father’s Day; reminded everyone that the July 3, 2017 Council Meeting was canceled; announced the following events: Library Summer Program Events begin June 20 at Memorial Park and Concerts in the Park begins July 6; announced that Channel 7 was at Slauson Pool; reminded everyone that the ratio of swimmers per lifeguard needs to be kept for public safety; requested that Staff look into the fees for recreational swimmers for non-residents; asked everyone to be aware of scams targeting seniors; provided an overview of the Azusa Cares Workshop and discussed the importance of communication with residents; and requested that everyone keep service men and women in their daily prayers. Police Chief Hunt gave an overview of firework enforcement and where they can be discharged. SCHEDULED ITEMS PUBLIC HEARING - FORMATION PROCEEDINGS FOR PROPOSED CITY OF AZUSA COMMUNITY FACILITIES DISTRICT NO. 2017-1 – RESOLUTIONS AND ORDINANCE. Director of Finance Johnson presented the Staff Report stating that the purpose of the Community Facilities District (CFD) is to partially fund the City’s public safety costs. Mayor Rocha declared the hearing open. City Clerk Cornejo announced that no individuals requested to present testimony; no written protests were received; and there are no persons registered to vote in the district. City Clerk Cornejo read the affidavit of proof of publication published on May 29, 2017, in the San Gabriel Valley Tribune and mailed on May 24, 2017. City Clerk Cornejo announced that the owners of all of the taxable property in the district have consented t o holding the Special Election on June 19, 2017 immediately following the Public Hearing and the Special Election may be held on June 19, 2017. Mr. Christian Warner, Athens Services Director of Compliance provided information about disposal process and costs. The Council expressed their appreciation for the quality of service provided by Athens. PUBLIC HEARING - FIRST READING OF ORDINANCE FOR A GENERAL PLAN AMENDMENT (GPA-2017-01) AND DEVELOPMENT CODE AMENDMENT (NO. 244) TO REFLECT THE CITY’S ADOPTION OF THE TOD SPECIFIC PLAN. and PUBLIC HEARING - FIRST READING OF ORDINANCE FOR A SPECIFIC PLAN AMENDMENT (SPA -2017-01) AMENDING THE TRANSIT ORIENTED DEVELOPMENT SPECIFIC PLAN. Assistant Planner Ibanez presented the Staff Reports; provided a brief history of the Transit Oriented Development Specific Plan; and described the amendments. In response to questions posed by the Council, Director of Economic and Community Development Christiansen stated that Staff had not proposed any amendments to the Edgewood District portion of the Specific Plan; Staff will recommend a Route 66 Historic Designation at a later time; Staff had not moved forward with the cost analysis for traffic calming on Azusa Avenue but will make recommendations to the Council once more development has occurred; and the Transit Oriented Development District does not include Lagunitas Brewery. Discussion ensued regarding the Specific Plan and open space located near the Lagunitas Brewery. Mayor Rocha declared the hearing open. AYES: COUNCILMEMBERS: GONZALES, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSTAIN: COUNCILMEMBERS: CARRILLO PROPOSED BUSINESS LICENSE TAX AMNESTY PROGRAM Management Analyst Lacasella presented the Staff Report and requested that a Business License Tax Amnesty Program be authorized to facilitate voluntary compliance for business es that have failed to obtain a business license tax or underpaid their tax obligation while waiving the payment of penalties or interest. In response to questions posed by the Council, Management Analyst Lacasella stated that Staff was expecting a positive fiscal impact; the program would be the first step in the audit process by providing an opportunity for business owners to pay the tax prior to being audited; and the penalties and interest would be forgiven. Mayor Pro-Tem Macias offered Resolution No. 2017-C44 entitled: A RESOLUTION OF THE CITY COUNCIL OF AZUSA APPROVING AN AMNESTY PROGRAM FOR BUSINESS LICENSE TAX Moved by Mayor Pro-Tem Macias, seconded by Councilmember Alvarez, and carried by unanimous vote of the Council to adopt Resolution No. 2017-C44. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ENACTED PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858 TEMPORARILY PROHIBITING THE ESTABLISHMENT OF HOOKAH LOUNGES AND TOBACO STORES PENDING STUDY AND ADOPTION OF REGULATORY AND ZONING STANDARDS Director of Economic & Community Development Christiansen presented the Staff Report stating that the Urgency Ordinance would halt the issuance of permits related to tobacco or hookah businesses in the City and would not affect the any current businesses until Staff is able to analyze which locations would be best suited for these types of businesses. In response to questions posed by the Council, Director of Economic & Community Development Christiansen responded that Staff would be reviewing the entire Zoning Code but are mainly focused on the Downtown area; the Code does not specify zoning for these types of establishments; and the definition of tobacco stores are those whose primary purpose is selling tobacco product or paraphernalia. Mayor Pro-Tem Macias offered Urgency Ordinance No. 2017-07 entitled: AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ENACTED PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858 TEMPORARILY PROHIBITING THE ESTABLISHMENT OF BUSINESSES HOOKAH LOUNGES AND TOBACCO STORES PENDING STUDY AND ADOPTION OF REGULATORY AND ZONING STANDARDS Moved by Mayor Pro-Tem Macias, seconded by Councilmember Alvarez, and carried by unanimous vote of the Council to introduce, waive further reading and read by title only and adopt Urgency Ordinance No. 2017-07. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE PAGE FIVE – 06/19/2017 FIRST READING OF ORDINANCE AMENDING SECTION 2-473 OF THE AZUSA MUNICIPAL CODE RELATING TO THE PAYMENT OF LANDFILL FEES City Attorney Martinez presented the item stating that City recently entered into an agreement with Azusa Land Reclamation to settle a dispute concerning the interpretation and payment of landfill and business license fees charged to their landfill and recommended the adoption of an Ordinance that would clarify the landfill fee that is located in the Municipal Code. Minor amendments were made to the Ordinance to ensure consistency in terms, a copy of the revised Ordinance was provided. Councilmember Gonzales offered Ordinance No. 2017-08 entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA AMENDING SECTION 2 - 473 OF THE AZUSA MUNICIPAL CODE RELATING TO THE PAYMENT OF LANDFILL FEES Moved by Councilmember Gonzales, seconded by Councilmember Carrillo, and carried by unanimous vote of the Council to introduce, waive further reading and read by title only Ordinance No. 2017-08. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ADOPTION OF FISCAL YEAR 2017/18 CITY, UTILITILES, AZUSA PUBLIC FINANCING AUTH ORITY, AND SUCCESSOR AGENCY OPERATING AND CAPITAL IMPROVEMENT PLAN BUDGETS Director of Finance Johnson presented the 2017-18 budget stating that the proposed budget was presented to the City Council on May 30, 2017; no changes were recommended by the City Council; minor changes had been made since the Study Session which resulted in a $45k reduction; the overall proposed General Fund Budget was $42.2M and Citywide Budget was $153.5M; and there would be no reduction programs and services. Discussion ensued regarding the creation of two Assistant Director positions and the reclassification of employees as a result of the Class & Compensation Study. The City Council expressed opposition to the creation of an Assistant Director of Recreation and Family Services position. In response to a question posed by the Council, Assistant Director of Electric Operations Langit provided information about the Advanced Meter Infrastructure Project. Further discussion ensued regarding the proposed Assistant Director of Recreation and Family Services position and the succession plan for the filling of the Director of Recreation and Family Services position, once the current Director retires at the end of the year. Director of Recreation and Family Services Jacobs responded to questions posed by the Council and further discussed the succession plan for his position. It was the consensus of the Council to remove the item regarding the creation of the Assistant Director of Recreation and Family Services from the proposed budget. The City Council of the City of Azusa, met in Special Session at the above date and time in the Azusa Light & Water Conference Room, located at 729 N. Azusa Avenue, Azusa, California. Mayor Rocha called the meeting to order at 7:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ, ROCHA ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT Elected Officials: City Clerk Cornejo. Staff Members: City Manager Butzlaff, City Attorney Martinez, Director of Utilities Morrow, Storekeeper Alvarez, Management Analyst Lacasella, Cpl. Paul Dennis and Chief Deputy City Clerk Garcia. PUBLIC COMMENT None given. THE AZUSA CITY COUNCIL RECESSED AT 7:32 P.M. AND RECONVENED AT 7:42P.M. REPORT REGARDING COMPLIANCE WITH SB 415 AND REQUIRED CHANGES IN MUNICIPAL ELECTION DATES. City Attorney Martinez gave a brief presentation regarding Senate Bill (SB 415) stating that Cities, Special Districts, and School Districts are required to move their election dates to a General Statewide Election or Primary Election in June or November of an even number year. Discussion was held regarding the implications of SB 415 and the need to implement an action by January 2018, and a plan that would go into effect no later than November 8, 2022. City Attorney Martinez responded to a question posed by Council stating that the law requires that at least one election cycle be completed by November 8, 2022. However, according to the Election Code both election cycles need to be complete. He further stated that one of the conditions required by SB415 is that no term of office can be increased or decreased by more than a year as a result of this change. Cities that are on a November of odd number years can increase the term by 12 months to November of even number years. However, cities conducting an election February through June of odd election years would need to adopt an Amended Ordinance referencing Municipal Code section 2-1 indicating elections held in March of odd number years, would be moved to even number year, in order to comply with the 12 month limitation required by SB 415. Council also has the option to implement a June or November 2022 election, which would decrease and reduce terms by 4 to 9 months depending on whether a June or November election is conducted. Chief Deputy City Clerk Garcia provided information about the analysis completed by the Los Angeles County Recorder’s Office which determined that the City of Azusa is able to conduct a stand-alone or consolidated election, and stated that there were additional draw backs to conducting a stand-alone 2022 election as the election consultant Martin & Chapman would not be conducting elections after 2019. Discussion was held regarding the election consultant aspects of conducting a stand-alone election. City Attorney Martinez stated that Council may choose to wait for a Legislative Fix authorizing a one time extension that would allow the election cycle to extend over the 12 month period for those cities that are on an odd year cycle and would be losing more than a 12 month term. Discussion was held regarding the Legislative Fix. It was the consensus of the Council to wait to see if there would be a Legislative Fix or an extension that would bring their 2023 election to November of 2022 and wait for a better view of the situation. The item will be discussed at a later time in November of 2017. CLOSED SESSION The City Council recessed to closed session at 8:30 P.M. to discuss the following: 1.
