HomeMy WebLinkAboutE-8 MP-5 Surplus Trande-InCONSENT ITEM E-8 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: TROY BUTZLAFF, ICMA-CM, CITY MANAGER FROM: STEPHAN HUNT, ACTING CHIEF OF POLICE DATE: OCTOBER 17, 2016 SUBJECT: DECLARATION OF SURPLUS PROPERTY AND APPROVAL OF TRADE-IN OF MP-5 SUB- MACHINEGUNS FOR CREDIT TOWARDS PURCHASE OF M-4 COLT RIFLES SUMMARY: The Azusa Police Department currently has 35 Heckler and Koch (H&K) MP-5 .40 caliber submachine guns in the Department’s firearms inventory. The Department currently deploys these MP-5’s in the Patrol Division and in the Special Weapons and Tactics Team. Due to the fact that Heckler and Koch no longer manufacturers the MP-5 anymore, it is becoming increasingly difficult to purchase magazines and parts from firearms vendors. The proposed actions adopts a resolution declaring these weapons to be surplus property and approving the trade-in of the MP-5 sub-machine guns with Clyde Armory for credit towards the purchase of additional (27) Colt M-4 rifles (with accessories) for the Azusa Police Department Patrol Division and Special Weapons and Tactics Team. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1) Adopt Resolution No. 2016-C72 declaring as surplus property 35 Heckler and Koch MP-5 and authorizing the Procurement Agent to utilize “best practices” in accordance with Azusa Municipal Code (AMC) Article III Section 46-87 (1) for the disposition of surplus property; and 2) Approve the trade-in of 35 MP-5 sub-machine guns to Clyde Armory for credit towards the purchase of additional (27) M-4 rifles (with accessories) for the Azusa Police Department Patrol Division and Special Weapons and Tactics Team. DISCUSSION: The MP-5 sub-machine gun manufactured by Heckler and Koch (H&K) has a long history at the Azusa Police Department. Unfortunately, H&K Customer Service has indicated that they will not be making replacement barrels or any replacement parts for the MP-5. The current lack of available parts and customer service support from H&K has become problematic for the Police Department. As a result, the Police Department has decided to use the M-4 rifle manufactured by Colt as the primary patrol rifle. APPROVED COUNCIL MEETING 10/17/2016 Declaration and Disposition of Surplus MP-5 Sub-Machine Guns October 17, 2016 Page 2 In 2011, the City purchased (19) Colt M-4 patrol rifles that are currently deployed by officers in the field. During the research conducted by the Firearms Training Unit, it was discovered that all of the police agencies that border the City of Azusa currently use the M-4 as their primary patrol rifle. This allows our M-4 magazines and ammunition to be interchangeable with weapons from neighboring agencies. Due to the condition of the MP-5’s and the market for parts, there is an opportunity to receive a significant amount of credit by trading-in these obsolete weapons. The trade-in credit can then be used to purchase (27) new M-4 rifles which will give the Azusa Police Department additional resources to protect the citizens of Azusa The Police Department received the following trade-in quotes from three (3) firearms dealers: 1) Clyde Armory has offered to accept the entire inventory of MP-5 sub-machineguns and magazines for a credit of $28,875.00. 2) ProForce Law Enforcement has offered to accept the entire inventory of MP-5 sub-machineguns and magazines for a credit of $26,180.00. 3) Allstate Police Equipment has offered to accept the entire inventory of MP-5 sub-machineguns and magazines for a credit of $22,500.00. Based on the three quotes, the Police Department’s Firearms Training Unit recommends that the City Council approve the trade-in of the MP-5 inventory to Clyde Armory for credit towards the purchase of an additional (27) M-4 rifles. The declaration of surplus property and trade-in will be in compliance with the City of Azusa Municipal Code (AMC) Article III Section 46-87 (1), which allows for the trade of such items by the City for other items to be used for City purposes. FISCAL IMPACT: There is no fiscal impact associated with the recommended actions, since the funds required for the purchase of the new M-4 rifles will be offset by the credit amount for the MP-5 submachine guns to be traded-in. Butzlaff, ICMA-CM Management Analyst City Manager Attachments: 1) Resolution Declaring Surplus Property RESOLUTION NO 2016-C72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING SPECIFIC POLICE DEPARTMENT FIREARMS AS SURPLUS WHEREAS, the City through the Police Department maintains a firearms inventory for providing public safety to the community; and WHEREAS, included in the City’s firearms inventory are 35 Heckler and Koch (H&K) MP-5 caliber submachine guns; and WHEREAS, H&K no longer manufactures the MP-5 making it increasingly more difficult for the City to purchase magazines and spare parts from firearms vendors; and WHEREAS, the City has determined that 35 MP-5 caliber submachine guns, that the Department currently deploys in the Patrol Division and in the Special Weapons and Tactics Team are no longer sustainable for continued operations of the department and should be declared surplus property in accordance with Azusa Municipal Code (AMC) Article III Section 46-87 (1); and WHEREAS, the City Council determines that adoption of this Resolution is in the public interest. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Azusa, California, does find and declare that: Section 1. Recitals. The City Council does hereby find, determine and resolve that all of the foregoing recitals are true and correct. Section 2. Approval and Authorization. The City Council does further resolve, order and/or direct that the City Council hereby declares the 35 Heckler and Koch MP-5 caliber submachine guns as surplus property and authorizes the Procurement Agent to utilize “best practices” in accordance with Azusa Municipal Code (AMC) Article III Section 46-87 (1) for their disposition. Section 3. This Resolution shall take effect immediately upon adoption.
