The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Mayor Rocha called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ROCHA ABSENT: COUNCILMEMBERS: ALVAREZ ALSO PRESENT Elected Officials: City Clerk Cornejo. CEREMONIAL An “Employee of the Quarter” Certificate was presented to Mr. Brent Hale, Community Improvement Inspector. CLOSED SESSION The City Council recessed to closed session at 6:38 P.M. to discuss the following: 1.PUBLIC EMPLOYEE PERFORMANCE EVALUATION – Pursuant to California Government Code, Section 54957. Title(s): City Manager 2.CONFERENCE WITH LEGAL COUNSEL – THREAT OF LITIGATION/POSSIBLE INITIATION OF LITIGATION – Pursuant to California Government Code, Sections 54956.9(d)(2) & (d)(4). 1 Potential Case – Dispute with Waste Management regarding payment of landfill. 3.CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION - Pursuant to Government Code section 54956.9(d)(1). 1 Potential Case REGULAR SESSION Mayor Rocha called the meeting to order at 7:30 P.M. CONSENT ITEM E-1 Approved Council Meeting 9/19/2016 The Pledge of Allegiance was led by Mr. Robert Cruz. The invocation was given by Pastor Dan Simpson. CLOSED SESSION REPORT The City Council reconvened at 7:30 P.M.; City Attorney Martinez announced the following regarding Closed Session: Item 1: Item was not discussed due to Councilmember Alvarez’s absence and would be continued to a future meeting; Item 2: Council heard an update from the City Attorney’s office, no reportable action; and Item 3: Council heard a presentation from the City Attorney’s office, no further reportable action. PUBLIC COMMENT Dr. Barbara Dickerson made suggestions regarding the scholarship selection process; inquired about a list of high school graduates that are going forward to post-secondary education; and provided an update about Citrus College. Ms. Yolanda Haro, YWCA Representative, discussed the various ways that the YWCA was trying to increase community engagement in Azusa. Mr. Dan Simpson advocated for the re-opening of the Garcia Trail. Mr. Arturo Nevarez, Senior Field Representative for Assembly Member Hernandez, announced the Community Health Fair on August 27, 2016 at Memorial Park. In response to the comments made during public participation, City Manager Butzlaff stated that the scholarships that will be awarded are for the 2016/17 academic school year and briefly discussed the selection process; and clarified his comments regarding the Rosedale area parking situation in regards to the Garcia Trail and opportunities to reestablish the trail in an alternative location. REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL Presentation from Robert Cruz of SoCalGas Company on Energy Reliability. Mr. Robert Cruz, SoCalGas Company Public Affairs Manager, presented information regarding the Aliso Canyon methane leak and energy reliability. Mayor Rocha thanked Mr. Cruz for the donation of the air filtration systems that were provided to Azusa residents. City Clerk: Request for City Council to set a time and date to hold the interviews of applicants received for City Commissioners. City Council scheduled commissioner interviews on September 12, 2016 at 6:30 p.m. in the Light & Water conference room. City Manager: Request to form an Ad-Hoc Committee to review Scholarship Applications. Mayor Rocha and Councilmember Gonzales were appointed to the Scholarship Ad-Hoc Committee. Mayor Pro-Tem Carrillo congratulated his colleagues and volunteers for another successful Kathy’s Cool Kutz event; reminded residents of Girls Winter Softball registration at Memorial Park; and wished students luck for their upcoming school year. Councilmember Macias congratulated the Employee of the Quarter, Mr. Brent Hale; thanked Mr. Robert Cruz for his presentation; wished students a successful school year; clarified that the Fire Department was responsible for the Garcia Trail closure; and requested that a Hilton Project update be given at the following Council Meeting. Councilmember Gonzales thanked everyone that participated in the 9th Annual Kathy’s Cool Kutz event; and announced “A Salute through Song” benefit concert honoring local veterans on Novembe r 12, 2016, proceeds would be donated to the VFW, American Legion and Eagles Lodge. Mayor Rocha announced that the meeting would be adjourned in memory of Mr. Boyd Piper, Lifelong Azusa Resident; thanked everyone that contributed to the Kathy’s Cool Kutz event; and requested an update on the Serrano Development and Charles Company projects at the following Council meeting. He announced the following events: Low Cost Vaccination/Microchip & Licensing Clinic for dogs and cats on August 17; concerts in the p ark on August 18 and August 25; Return of the Rubber Ducky Regatta on August 27 at Slauson Park; Community Health Fair at the Senior Center on August 27; Azusa Cares “Let’s Talk” Seminar on Police Community Relationship, School Community Relationship and Bullying Impacts on Students and Parents, on September 10; Azusa Day at the Fair on September 23; and asked that everyone keep service men and women in their daily prayers. PAGE TWO – 8/15/2016 SCHEDULED ITEMS PUBLIC HEARING – FIRST READING OF ORDINANCE NO. 2016-O6 – AMENDING SECTION 88.38.040(D) AND ADDING SECTION 88.38.085 TO THE AZUSA MUNICIPAL CODE TO AUTHORIZE BILLBOARDS RELOCATION AGREEMENTS. Associate Planner Munoz presented the item stating that the proposed code amendment would provide a mechanism to remove outdated billboards without paying compensation, amend section 88.38.040(D) of the Azusa Municipal Code (AMC) and add section 88.38.085 to the AMC. Mayor Rocha declared the hearing open. City Clerk Cornejo read the affidavit of proof of publication published on August 5, 2016, in the San Gabriel Valley Tribune. Public Comment None given. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: ALVAREZ Councilmember Macias offered Ordinance No. 2016-O6 entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 88.38.040(D) AND ADDING SECTION 88.38.085 TO THE AZUSA MUNICIPAL CODE (DEVELOPMENT CODE) TO AUTHORIZE BILLBOARD RELOCATION AGREEMENTS Moved by Councilmember Gonzales, seconded by Mayor Pro-Tem Carrillo, and carried by unanimous vote of the members present to approve the first reading of Ordinance No. 2016-O6. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: ALVAREZ PUBLIC HEARING – FIRST READING OF ORDINANCE NO. 2016-O7 – AMENDING AND RESTATING ARTICLE XVII OF THE AZUSA MUNICIPAL CODE REGARDING REGISTRATION AND MAINTENANCE OF VACANT AND ABANDONED COMMERCIAL, INDUSTRIAL PROPERTY AND OTHER RESIDENTIAL PROPERTIES. Acting Community Improvement Manager McMinn presented the staff report stating that the Proposed Ordinance would require property owners to register and maintain vacant and abandoned properties. In response to questions posed by the Council, he stated that the Ordinance would provide the City with more opportunities to enforce the maintenance of vacant properties. City Attorney Martinez clarified that residential, commercial and industrial properties would be incorporated into one Ordinance. Discussion was held in response to Councilmember Macias’ concerns regarding the benefits and enforcement of the Proposed Ordinance. Mayor Rocha declared the hearing open. City Attorney Martinez announced that the Public Hearing did not require notice/publication. Public Comment None given. AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: ALVAREZ ACCEPTANCE OF TITLE TO HILLSIDE LAND NORTH OF THE ROSEDALE PROJECT, CONVEYANCE OF SAID LAND TO AZUSA-RMC JOINT POWERS AUTHORITY, APPOINTMENT OF TWO JOINT POWERS AUTHORITY BOARD MEMBERS, AND APPROVAL OF OPERATING MEMORANDUM NO. 2 TO DEVELOPMENT AGREEMENT WITH ROSEDALE LAND PARTNERS. City Manager Butzlaff presented the item stating that the San Gabriel and Lower Los Angeles Rivers and Mountains Conservancy formally took action on July 25 to form the new Azusa-RMC Joint Powers Authority (JPA). Staff recommended that the City accept the title to the hillside land north of the Rosedale Project from Rosedale Land Partners and then convey the hillside property to the new JPA for long-term management; appoint two Councilmembers to the JPA Board of Directors; and approve Operating Memorandum No. 2 with Rosedale Land Partners, which would allow the parties to make certain minor changes, adjustments or clarifications to the Development Agreement in order to implement its terms without going through the formal amendment process. City Attorney Martinez recommended the following language be added to the Operating Memorandum No. 2: Page 2, Recital F, “pursuant to the 4th agreement, the term of the development agreement has been extended to August 27, 2017”; Page 3, Section 3, “and is contingent of the City accepting dedication of the open space from the developer.” Discussion ensued regarding the conveyance of the title to the JPA and the management of the property. No action was taken on the conveyance of the property to the JPA; the item would be brought back to a future meeting for further discussion. Moved by Councilmember Macias, seconded by Councilmember Gonzales, and carried by unanimous vote of the members present to approve the City Manager’s execution of the Certificate of Acceptance of title to hillside property north of the Rosedale Project. Resolution No. 2016-C54 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The Human Resources Action Items, in accordance with the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s), were approved as follows: New Appointment: J. Macias Merit Increase and/or Regular Appointment: O. Morales, D. Ochoa, C. Grant, R. Landeros, K. Soliven Class Specification Revision: Assistant Chief Deputy City Clerk, Deputy City Clerk II Reclassification: A. Juarez. 4. The purchase of exercise equipment from Greenfield’s Outdoor Fitness was approved in the amount not to exceed $87,264.97. 5. An agreement between the City of Azusa and Azusa Pacific University for University Resource Officer Se rvices was approved for the 2016-2017 undergraduate academic school year. 6. A lease contract with Enterprise Fleet management for the lease of one (1) truck through the use of a bid with TIPS - USA was approved. 7. Amendments to the agreement with Azusa Pacific University for Azusa Reads, Writes, Counts & Azusa Calculates and the agreement with Azusa Pacific University for kids on the Move/Computer Lab Training Programs were approved. 8. A grant award from the Los Angeles County Area Agency on Aging for the Senior Center Elderly Nutrition Program was accepted. 9. A non-binding letter authorizing the exploration of a Joint Powers Authority for the management of Enhanced Watershed Management Program responsibilities in the Rio Hondo/San Gabriel River Watershed Group was approved and the City Manager was authorized to execute the letter on behalf of the City. 10. A Use/Lease Agreement with Azusa Pacific University for the Slauson Park Pool/Azusa Aquatics Center from August 29, 2016 through May 6, 2017 was approved. 11. The purchase of one (1) 2016 Ford Police Interceptor Utility vehicle from Wondries Fleet Group , in an amount not to exceed $30,182.10, was approved. 12. The three (3) year Resolution for Designation of Applicant’s Agent for Non -State Agencies and Memorandum of Agreement pertaining to assistance under the Law Enforcement Mutual Aid Plan to seed Fire Management Assistance Grant Reimbursement for costs associated with the Fish Fire between the City of Azusa and Cities of Covina, La Verne, Arcadia, Pomona, El Monte, Baldwin Park, Claremont, West Covina, Irwindale and Sierra Madre were approved. 13. Special Call. 14. The list of agreements executed by the City Manager for the period of March 23, 2016 through July 5, 2016 was received and filed. SPECIAL CALL CITY TREASURER’S STATEMENT OF CASH AND INVESTMENT BALANCES FOR THE MONTH OF JUNE 2016. Councilmember Macias thanked the City Treasurer for his hard work and due diligence. Moved by Councilmember Macias, seconded by Councilmember Gonzales, and carried by unanimous vote of the members present to receive and file the City Treasurer’s Statement of Cash and Investment Balances for the month of June 2016.
