The City Council of the City of Azusa met in
regular session at the above time and place.
Present at roll call: Councilmen: Jackson,
Ortuno, Seltzer, Memmesheimer, Jones, City
Attorney_Snidow, City Clerk and City Engineer
Brooks. Absent: None.
Each member present acknowledged receipt
of a written copy of the minutes of March
17, 1952. The Mayor asked if there were any
objections or corrections to same. There being
' none, the minutes of March 17, 1952 were approved
as written.
The Mayor announced that this is the time and
place fixed by this City Council for the con-
tinued hearing on the report which was ordered
by Resolution No. 2574 for certain work or
improvement consisting of certain grading and
the construction of certain curbs, gutters,
driveway aprons, and appurtenances and appurtenant
work on Bayless Street and other streets in the
City of Azusa. -
The Mayor requested the Clerk to read any
written protests, withdrawals of protest,
or communications not heretofore presented
to the City Council and which may have been
filed with her since March 3, 1952•
The Clerk announced that no protests, with-
drawals or communications had been received.
The Mayor announced that
the Council will now hear any oral protests
or objections concerning the report, the work,
' the district or the proceedings. Any persons
present who have filed written protests and
who now desire to withdraw the sane are ad-
vised that written withdrawals of protest must
be filed before the conclusion of this hearing.
The Mayor then asked if there were any other
interested persons present who desired to be
heard. No,persons present indicated desire
to be heard.
The Mayor asked the City Engineer to please
advise Council whether he recommends that any
omissions, decreases, alterations or changes
in the work proposed to be done, and if so,
whether the same will increase the estimated
cost by more than one-tenth.
The City Engineer stated: "Based upon certain
protests made at the hearing and my further
investigation of the project, I recommend that
the following omissions, decreases, alterations
or changes be made: (1) a decrease in the quantity
of excavation; (2) the omission of construction
of curbs and gutters in front of Parcel 129;
' (3) the omission of construction of curbs,
gutters and driveway aprons in front of Par-
cels__l30 and 131 and (4) the addition of.con-
t'� struction of a driveway -apron in front of
Parcel 42. The foregoing omissions, decreases,
alterations or changes will net increase the
estimated cost by more than one-tenth, but on
the contrary will decrease the estimated cost
approximately 1.4%."
The Mayor then asked the City Engineer to
advise the City Council what percentage of the
area of the property to•be assessed for the im-

cost of omissions, decreases, alterations or
changes and the City Council ordered same filed

and assessment district map.
Councilman Me=esheimar offered a resolution
entitled:
The City Engineer stated: "The total area
represented by all written protests filed
in this proceeding represents 16.3% of the
area of the property to be assessed for this
improvement. However, subsequent to the filing 1911 STREET

certain of said protestants signed and have
filed with the City Clerk a communication dated
March 5, 1952 requesting the improvement. Con-

WHEREAS, this City Council has heretofore, on December
3, 1951by Resolution No. 2574, taken the steps provided
by Sections 2821, 2822 and 2823 of the Streets and Highways
Code of the State of California (said sections being a part
of the Special Assessment Investigation, Limitation and Majority
Protest Act of 1931) for certain proposed work or improvement
consisting of certain grading and the construction of certain
curbs, gutters and driveway aprons on Bayless Street and,other
streets in the City of Azusa, California; and
WHEREAS, by said Resolution No. 2574, this City Council
directed the City Engineer to procure the required information
and prepare and present to this City Council the written re-
port on said work and improvement required by the Special
Assessment Investigation, Limitation and Majority Protest Act
of 1931 as set forth in Division 4, Part 2, Sections 2824 to
2830, inclusive, of said Streets and Highways Code; and
WHEREAS, said report has been presented to this City
Council and approved and ordered filed by this Council; and
WHEREAS, by Resolution No. 2583, adopted on January 21,
1952, this City Council fixed a time and place for hearing
by it on said report; and
WHEREAS, notice of said hearing was mailed as required
by said Special Assessment Investigation, Limitation and Majority
Protest Act of 1931; and
WHEREAS, a hearing was duly held by this City Council at
the time and place so fixed and at adjournments and continuances
thereof, at which all written protests or objections which were
presented were read, and all persons desiring to be heard thereon
were heard, and this City Council gave all persons present an
opportunity to be heard in respect of any matter relating to
said report, said work or improvement, or any of the proceedings
therefor; and
WHEREAS, all persons desiring to appear aid be heard were
heard at said hearing and said hearing has been closed; and
WHEREAS, this is the time and place designated by this
City Council for consideration of said report, and this City
Council has considered said report and is fully informed in the
premises; and
WHEREAS, this City Council considers it desirable that
certain omissions, decreases, alterations or changes be made
in the work proposed to be done;
NOW, THEREFORE, the City Coun:il of the City of Azusa,
DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER as follows:
Section 1. That said report contains all the matters and
things required by law and that notice of hearing on the pro-
posed project generally described therein has been duly and
regularly given.
Section 2. That omissions, decreases, alterations or
changes in the work proposed to be done shall be made as follows:

The question of whether or not the City em-
ployees should include a municipal election CITY EMPLOYEES'
in the list of legal holidays enumerated in HOLIDAYS
Resolution No. 2477 was discussed.
Moved by Councilman Jackson, seconded by
Councilman Ortuno the Heads of Departments be
instructed to advise the employees that Counc.1l
granted permission to include the day on which
a municipal election is held in the list of
legal holidays, granted with pay, andthe
Police Department to receive the usual re-
muneration for working on a legal holiday.

A communication from A. H. Adams, Director of
Planning, The Regional Planning Commission,
relative to proposed amendments to the Master
Plarn 'of Hili ways which would affect the high-
ways in the Foothill Area, was offered.
The City P33ining Commission recommended the
amended map #211 be accepted with the provision
that Fifth Street be eliminated from the Master
Highway Play because of schools.
George Grandstaff stated that the proposed
amendments were the result of a joint meeting
of the Azusa and Glendora representatives with
the Regional Planning Commission where they con-
centrated their efforts on a free -way type of
highway through the center of the valley as far
' east as San Bernardino.
After discussion, it was moved by Councilman
Jackson, seconded by Councilman Memmesheimer
the City Attorney be instructed to prepare a
resolution accepting Amendment No, 211, The
Master Plan Metropolitan Area - County of Los
Angeles.

A decrease in the quantity of excavation; the
omission of the construction of curbs and gutters in
front of Parcel 129; the omission of the construction
of curbs, gutters and driveway aprons in front of
Parcels 130 and 131; and the addition of construction
of a driveway apron in front of Parcel 42;
that said omissions, decreases, alterations or changes will
not increase the estimated cost by more than one-tenth, or at
all.
Section 3. That the City Engineer be and he hereby is
directed to estimate separately the cost of each addition
to or omission from or decrease in the things proposed to be
done as set forth in said report and to file such estimate with
the City Clerk.
Section 4. That no written protest has been filed with
the Clerk of this City Council by the owners of more than one-
half of the area of the property to be assessed for said pro-
posed work or improvement and that there is no majority pro-
test as provided in Section 2931 of the Streets and Highways
Code, against only a portion of said proposed work or Improve-
ment.
Section 5. That all protests and objections be and the
same are hereby overruled and denied.
Sectlon 6. That the public interest, convenience and
necessity require the work or improvement substantially as
set forth in said report; that the project for said work or
improvement is feasible; that the lands to be assessed for
said work will be able to carry the burden of the proposed
assessment for said work; and that pursuant to Section 2905
of said Code the limitations set forth in Division 4 of said
Code shall be disregarded, both with respect to the limitation
on the proposed assessment district as a whole and as to the
limitation on individual specific assessments.
Section 7. That this resolution shall be entered in full
upon the minutes of -this City Council.

instructed to prepare a resolution request-
ing the exclusion of Fifth Street from the
Master Plan of Higiways, suggesting the
Freeway be located near the central portion
of the vdley.

The City Planning Commission recommended that
the request of Soil Builders, Inc., fcr a
special use permit to erect and maintain an
organic fertilizer plant on property described

Tract 8507, be granted subject to the approval
of property owner and provided all contingencie
covering the Special Use Permit be adhered to.
Moved by Councilman Seltzer, seconded by
Councilman Ortuno the City Attorney be instruct-
ed to prepare,a resolu� n granting the Soil
Builders, Inc., reques ?o incorporate the pro-
visions whereby all processing and storage be
carried on inside the building. In the event
that the material be stored outside the build-
ing, all provisions relative to fencing and
black -top be complied with, also to include
all provisions required by the Planning Commission.

The Planning Commission recommended the approval
of a tentative map ct Tract #18038 as revised
and presented by Mr. Clarence Day, Engineer,
and Mr. Guy Pollard, owner, providing it meet
all City requirements for improvements, with
the exception that 970 square foot houses be
accepted in this subdivision.
Mr. Clarence Day deposited a fee of $20.00 for
plan check.

the Planning Commission and tentative map of

vote "no" on this motion as he felt this
type of business did not add to the potential
value of the area; that it should be reserved
for industries with worth -while payrolls.

Relative to a request of David W. Eccles and
Robert B. Searles for variance to divide lots
at Second Street and Orange Avenue, a motion of
the Planning Commission was read recommending
that if the City quitclaim an easement on this QUIT CLAIM EASEMENZ
property which is no longer needed for utilities,
that division of the property be granted, pro-
viding 55 foot property frontage and 906 sq.
ft. for the houses.

plans with Council, asking their permission to
secure the necessary petition signatures to create
a hospital district. Dr. Larus was informed that

this plan was a Courty affair rather than
a City matter.
A communication from the State Employees+
Retirement System was read advising that,
Judge John 0. Durrell may remain in the ser-
vice of the City of Azusa until notified by
them when the retirement of this employee must
take place. The letter was ordered placed on
file.
A letter of appreciation signed by Rude F.
' Smith, Supervisor of the Ground Observers
Corps, was read thanking Council for pro-
viding them with a typewriter. An invitation
was also extended for Council to attend their
next exercise. Letter was ordered filed.
A communication from the Park and Recreation
Commission was read recommending the follow-
ing procedure for the use of the City -owned
"Scout Hall":
1. A master list of users of the Scout Hall should
be developed and kept on file at the Police De-
partment. The list should include the name of
the organization, the adult leader, meeting date
and time.
2. The Police Department should be instructed
to issue keys only in accordance with the master
list and only to the adult leader. If impossible
for the adult leader to request the keys in per-
son, then he should send a signed request for
the person who is to receive the keys. Signed
requests should be kept on file by the Police
' Department.
3. If a request for the keys is made to the
Police Department by some person or organization
not on the master list, the person or group should
be referred to the specific member of the Park
and Recreation Commission designated by the
chairman for that purpose (At present this is
D. T. Dawe)
4. Names of organizations should be added to
the master list only after approval by the
Park and Recreation Commission. However, to
meet emergencies and to provide some flexibility
in the plan, authority to approve use of the
building for single occasions or on a temporary
basis, should be given to the member of the
Commission referred to in No. 3 above. This
member should give his approval in writing so
the Police Department would have written authority
to release the keys.

commendation be accepted and the City Clank
be instructed to notify the Park and Recreation
Commission of this acceptance and mail a copy
of the plan to all regular users of the Hall.
