MORROW, DIRECTOR OF UTILITIES DATE: JUNE 27, 2016 SUBJECT: FIRST READING OF ORDINANCE NO. 2016-O3 AMENDING DIVISION 6 OF ARTICLE VI OF CHAPTER 78 OF THE AZUSA MUNICIPAL CODE REGARDING WATER CONSERVATION SUMMARY: Based on proposed State drought target “self-certification” regulations, Azusa Light & Water (AL&W) and its customers will need to reduce water consumption by a minimum of 3% from average actual calendar 2013 and 2014 levels beginning July 1, 2016. Staff has updated Water Rule 21 to include the latest State mandatory minimum requirements as well as AL&W’s recommendation for a voluntary conservation level of 20% beginning July 1, 2016. AL&W’s recommendation takes into account, the State’s mandatory minimum requirements as well as additional local water supply impacts affecting the Utility and region. The recommendation would continue the current enforceable water restrictions in place. This action amends Division 6 of Article VI of Chapter 78 of the Azusa Municipal Code in order to maintain consistency with the proposed changes to Water Rule 21 considered by the Utility Board on June 27, 2016. RECOMMENDATION: Staff recommends that the City Council approve the following action: 1) Introduce for first reading, by Title only and waive further reading, Ordinance No. 2016-O3; amending Division 6 of Article VI of Chapter 78 of the Azusa Municipal Code regarding Water Conservation. DISCUSSION: Azusa Light & Water (AL&W) uses Rules and Regulations to govern utility services rendered outside of the City in portions of Covina, West Covina, Irwindale, Glendora, and Los Angeles County. Since Water Conservation regulations are so critical, it has been the past practice to incorporate Water Conservation rules/regulations into the Azusa Municipal Code. APPROVED SPECIAL MEETING 6/27/2016 Water Conservation Amendment June 27, 2016 Page 2 On June 27, 2016, the Utility Board will consider an amendment to Water Rule 21 “Water Conservation” to reflect current water supply conditions and considerations. Because of the significance of the Azusa Light & Water’s water conservation rules, it is important to maintain consistency between the Azusa Municipal Code and ALW’s Rules and Regulations with respect to enforcing water conservation requirements both inside and outside of the City. The proposed ordinance amends the pertinent section of the City’s Municipal Code to reflect the changes to Water Rule 21. Butzlaff, ICMA-CM City Manager Attachment: 1) Ordinance Amending AMC Division 6 of Article VI of Chapter 28 ORDINANCE NO. 2016-O3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA AMENDING DIVISION 6 OF ARTICLE VI OF CHAPTER 78 OF THE AZUSA MUNICIPAL CODE REGARDING WATER CONSERVATION WHEREAS, on May 9, 2016, Governor Brown issued an Executive Order mandating extending the State’s emergency drought response program through January 2017 and ordering a number of corresponding actions by the State Water Resources Control Board; and WHEREAS, on May 18, 2016, the State Water Resources Control Board issued regulations implementing the Executive Order, including the requirement for mandatory water restrictions and for “self-certification” by urban water agencies of individual water reduction targets; and WHEREAS, drought conditions continue in the Azusa Light & Water (ALW) service area for the fourth year; and WHEREAS, the Utility Board has recently approved an amended Water Utility Rule No. 21, Water Conservation; and WHEREAS, because of the significance of ALW’s water conservation ordinance, it is important to maintain consistency between the Azusa Municipal Code and the Rules and Regulations with respect to enforcing water conservation requirements both inside and outside of the City. THE CITY COUNCIL OF THE CITY OF AZUSA CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Amendment to AMC. DIVISION 6. CONSERVATION PLAN, set forth in Sec. 78-501 through Section 78-515 of the Azusa Municipal Code, is hereby deleted and replaced by the provisions of Water Utility Rule No. 21. Any future amendment or revision to Water Utility Rule No. 21, shall be concurrently and automatically included as an amendment or revision to the CONSERVATION PLAN. SECTION 2: If any provision of this Ordinance is found to be unconstitutional or otherwise invalid by any court of competent jurisdiction, it is the intent of the City Council that such portion of this Ordinance be severable from the remainder and that the remainder be given full force and effect. SECTION 3: Effective Date. This Ordinance shall take effect thirty (30) days after its passage. SECTION 4: The City Clerk shall certify to the passage and adoption of this Ordinance, causing it to be published/posted as required by law.
