HUNT, ACTING CHIEF OF POLICE DATE: JUNE 20, 2016 SUBJECT: AZUSA UNIFIED SCHOOL DISTRICT AND AZUSA POLICE DEPARTMENT SCHOOL RESOURCE OFFICER CONTRACT; JULY 1, 2016 – JUNE 30, 2017 SUMMARY: The current agreement between the Azusa Unified School District and the Azusa Police Department is set to expire June 30, 2016 and a new agreement for the 2016/17 school year is required. This action approves an agreement between the Azusa Unified School District and the Azusa Police Department, for the provision of law enforcement services at a shared cost. RECOMMENDATION: Staff recommends that the City Council take the following action: 1) Approve the agreement for the 2016/17 school year between the Azusa Unified School District and the Azusa Police Department, for the provision of law enforcement services at a shared cost; and 2) Authorize the City Manager to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City. DISCUSSION: On May 24, 2016, the Azusa Unified School District delivered to the Azusa Police Department, a proposed contract for the assignment of one, full-time Azusa Police Officer, to the Azusa High School campus. The officer would hold the title, “School Resource Officer” (SRO), and be responsible for maintaining a police presence on campus, implementing an effective communication network to respond to emergencies, assisting in the enforcement of school rules, and conducting criminal investigations. The SRO would work under the direction and supervision of the Operations Division of the Azusa Police Department, in cooperation with the Azusa High School principal. The shared cost is defined by having AUSD pay 55% of the SRO’s Full Time Equivalent (FTE) x 50%, which will result in a payment of $46,500.00 to the City’s General Fund. The balance of the assigned officer’s FTE is paid by the City’s General Fund. Butzlaff, ICMA-CM City Manager Attachments: 1) 2016-2017 Agreement Attachment 1 Agreement between Azusa Unified School District, Los Angeles and Azusa Police Department, Los Angeles This agreement made and entered into for the 2016-2017 school year by and between the Azusa Unified School District, hereinafter referred to as AUSD, and the City of Azusa hereinafter referred to as City. Witnessed: Whereas, AUSD desires to further promote good citizenship and mutual respect between police and pupils; and the City desires to promote cooperation and mutual understanding through its Police Department, the City will make available to the District a trained person in the field of law enforcement. Therefore, be it agreed as follows: 1. AUSD will supply office space, necessary furniture, and telephone to the School Resource Officer. 2. AUSD will supply necessary office supplies and assistance necessary to carry out duties under this Agreement. 3. The City will make available a City police motor vehicle to the School Resource Officer for the performance of the services to be rendered under this Agreement and shall pay for all operating expenses. 4. The School Resource Officer shall work under the direction and supervision of the operations division of the Police Department in cooperation with the Azusa High School principal. The SRO’s duties and responsibilities shall include, but not be limited to, the following: a. Maintain a visible police presence on the Azusa High School campus. b. Establish and implement an effective communication network to respond to emergencies. c. Assist enforcing school rules. d. Document and follow up on mandated reports of assaults, child abuse, and illegal substance as it pertains to Azusa High School. e. Assist with Red Ribbon Week activity planning and implementation at Azusa High School. f. The SRO shall be available at the high school from 7 a.m. through 3 p.m., 4 days a week (at a minimum). Daily briefing at the Police station is included. g. Supervise at extra-curricular activities with flex hours or overtime pay as approved by the Police Department supervisor. h. Assist with outreach through student, school, home contacts and referral to appropriate agencies as it relates to Azusa High School. i. Assist with truancy sweeps. j. Assist with home calls and attendance follow-ups. k. Assist staff in matters of school discipline throughout the school day. l. Provide proactive interaction with students. m. Provide security and support for school personnel when on campus. n. Participate as a regular staff member. o. Maintain sensitivity to needs of situation for low-key or assertive interaction. p. Provide continued support to administration for a proactive stance on discipline. q. Provide intelligence resource to the high school and police department as it pertains to the prevention of crime. r. Present classroom lessons pertaining to youthful offenders, school and the law. The precise responsibilities of the School Resource Officer shall be mutually agreed upon between AUSD representative and the Police Department representative. The School Attachment 1 Resource Officer shall be assigned to Azusa High School and evaluated by his/her Division Commander with input from AUSD. 5. The District will pay the City for services annually based on the following formula: a. 144 days of instruction/school year, 8 hrs/day= 1,152; 2,080 hours/year full time= 55% of year spent instructing; School District agrees to pay 50% of cost of officer for 144 days of instruction: b. Formula: 55% x total cost of salary and benefits of SRO x 50% = cost to District 6. This Agreement may be terminated upon 30 days written notice by either party at any time. 7. The term of this Agreement shall be for a period beginning July 1, 2016 and ending June 30, 2017. 8. Parties’ hereto agree that the program shall be evaluated twice during the term of the Agreement. Said evaluation shall be made by the Comprehensive High School Principal, District representative, School Resource Officer, and Azusa Police Department reprehensive. 9. During the term of this Agreement, the City shall hold the District, its officers and employees harmless from any and all claims, demands, or liability arising from alleged acts of omissions by the City, its officers, agents, or employees during those times when said officers or agents are acting under the terms of this Agreement.
