HomeMy WebLinkAboutE-5 - Request for Extension of Industrial LeaveCONSENT ITEM E-5 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: AMELIA AYALA, DIRECTOR OF HUMAN RESOURCES & RISK MANAGEMENT VIA: TROY BUTZLAFF, ICMA-CM, CITY MANAGER DATE: MAY 16, 2016 SUBJECT: REQUEST FOR EXTENSION OF INDUSTRIAL LEAVE SUMMARY: On Monday, February 22, 2016, Bus Driver (“Employee”) sustained a work injury which resulted in the Employee being placed off work by a medical doctor. Employee continues to remain off work. This action approves the Employee’s request for an extension of Industrial Leave as provided for in Memorandum of Understanding (MOU) with the Azusa City Employees (ACEA). RECOMMENDATION: Staff recommends that the City Council take the following action: 1)Approve Employee’s request for an extension of Industrial Leave, for the maximum period of six months per the Azusa City Employees Association (ACEA) MOU for a work related injury/illness. DISCUSSION: An Employee sustained a work related injury on February 22, 2016 which resulted in the Employee being placed off-work (Industrial Leave) by a medical doctor. The Employee continues to on Industrial Leave and is now requesting an extension of their regular rate of pay as stated in the Azusa City Employees Association (ACEA) Memorandum of Understanding (MOU). The MOU states in part: 16.3.1 An employee granted Industrial Leave shall continue to be compensated at his regular rate of pay in lieu of temporary disability payments. 16.3.3 An Industrial Leave of up to ninety (90) calendar days shall be authorized for each injury or illness determined to be compensable under the Workers’ Compensation Act. Paid leave may be continued subject to review by the City Council at the end of such ninety (90) calendar day period to a maximum of six (6) months. Supporting medical documentation must accompany such requests for leave and be submitted thirty (30) days prior to expiration date. APPROVED COUNCIL MEETING 5/16/2016 Extension of Workers Compensation Salary Continuation May 16 , 2016 Page 2 Employee’s 90 calendar days of Industrial Leave will end on or about May 23, 2016. Employee has submitted the appropriate medical documentation to certify absence from work and has requested an additional 90 calendar day extension, up to a maximum of six months (per the MOU), which is August 23, 2016. Employee will be evaluated again by a physician on June 21, 2016, at which time the Employee’s ability to return to work will be addressed.
