LACASELLA, MANAGEMENT ANALYST DATE: APRIL 18, 2016 SUBJECT: REQUEST TO ADOPT RESOLUTION NO. 2016-C29 AUTHORIZING SUBMITTAL OF APPLICATION FOR CALRECYCLE PAYMENT PROGRAMS AND RELATED AUTHORIZATIONS SUMMARY: The California Department of Resources Recycling and Recovery (CalRecycle), a division of the California Natural Resources Agency, annually administers the City/County Payment Program to provide funding to local government for establishing beverage container recycling and litter abetment programs. The City/County Payment program assists municipalities in providing a variety of activities including beverage container collection, litter, clean-up, advertising, and recycling education. This action approves Resolution No. 2016-C29 authorizing the submittal of an application to CalRecycle for the payment programs and related authorizations. RECOMMENDATION: Staff recommends that the City Council take the following action: 1) Adopt Resolution No. 2016-C29 authorizing submittal of application for CalRecycle payment programs and related authorizations. DISCUSSION: The California Legislature passed a Beverage Container Recycling and Litter Reduction Act (AB2020) in 1986 and disbursing California Refund Value (CRV) to recyclers in 1987. The goal of CalRecycle’s Beverage Container Recycling City/County Payment Program is to reach and maintain an 80% recycling rate for all California Refund Value (CRV) beverage containers. Projects and programs implemented by cities and counties will assist in reaching and maintaining this goal. Incorporated cities and counties in California, as identified by the California Department of Finance, are eligible to receive funding under this program. Pursuant to Public Resources Code Section 14581 (a)(4)(C), these funds shall be used for activities related to beverage container recycling or litter abatement. APPROVED COUNCIL MEETING 04/18/2016 Request to Adopt Resolution for CalRecycle Payment Programs and Related Authorizations April 18, 2016 Page 2 The City has received funds from this program since 2001 and such funds have gone towards eligible items such as maintenance of 20-yard roll off recycling bin, purchase of in-house recycling receptacles, advertisement and public information campaigns and personnel expenditures. For program eligibility, CalRecycle requires a City Council approved resolution to authorize the submittal of funding applications through their programs. The resolution will allow the City to apply to any and all payment programs offered by CalRecycle, including the Beverage Container Recycling City/County Payment Program, and would designate City staff to execute all documents necessary to implement and secure payments. FISCAL IMPACT: The City receives approximately $12,000 per year from CalRecycle through the Beverage Container Recycling City/County Payment Program. Butzlaff, ICMA-CM Management Analyst City Manager Attachments: 1) Resolution No. 2016-C29 ATTACHMENT 1 RESOLUTION NO. 2016-C29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AUTHORIZING SUBMITTAL OF APPLICATION TO THE DEPARTMENT OF RESOURCES RECYLCING AND RECOVERY (CALRECYCLE) FOR PAYMENT PROGRAMS AND RELATED AUTHORIZATIONS WHEREAS, pursuant to Public Resources Code sections 48000 et seq., 14581, and 42023.1(g)., the Department of Resources Recycling and Recovery (CalRecycle) has established various payment programs to make payments to qualifying jurisdictions; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle’s procedures for administering payment programs require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of the payment program. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa does hereby find, determine, and declare as follows: SECTION 1. The City of Azusa is hereby authorized to submit an application to CalRecycle for any and all payment programs offered. SECTION 2. The City Manager, or his/her designee, is hereby authorized as Signature Authority to execute all documents necessary to implement and secure payment. SECTION 3. This authorization is effective until rescinded by the Signature Authority or this governing body.
