LACASELLA, MANAGEMENT ANALYST DATE: APRIL 18, 2016 SUBJECT: APPROVE AMENDMENT TO LETTER AGREEMENT WITH MUNITEMPS FOR INTERIM ASSISTANT CITY CLERK SERVICES SUMMARY: MuniTemps has been providing interim Assistant City Clerk services to the City since October 2015 under a Letter Agreement signed by the City Manager. On January 5, 2016, the City Council approved an amendment to the Letter Agreement with MuniTemps increasing the total compensation of the agreement by an additional $25,000 to enable Staff to recruit for the newly created position of Chief Deputy City Clerk. Due to a variety of reasons the recruitment for the Chief Deputy City Clerk was delayed by over a month. Until this position is filled the City continues to need interim staffing services, but has reached the limit of the amended Letter Agreement’s compensation amount. This action approves an additional amendment to the Letter Agreement with MuniTemps, increasing the total compensation of the agreement by an additional $14,000 for a not-to-exceed amount of $64,000 for Interim Assistant City Clerk services. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1)Approve an amendment to the Letter Agreement with MuniTemps for Interim Assistant City Clerk services increasing the total compensation by an additional $14,000 for a not-to-exceed amount of $64,000. 2) Authorize the City Manager to execute the amendment, in a form acceptable to the City Attorney, on behalf of the City. DISCUSSION: MuniTemps is a staffing firm that specializes in providing temporary staffing to local government agencies. MuniTemps provides temporary staffing services to more cities than any other staffing firm in the State of California. Their client list includes a variety of cities and counties throughout the state. The firm has been providing interim Assistant City Clerk services to the City since October 2015 due to the unfortunate passing of the full-time Assistant City Clerk. During this time, Marie Macias has been serving as the APPROVED COUNCIL MEETING 04/18/2016 Amendment to Agreement for City Clerk Services April 18, 2016 Page 2 Interim Assistant City Clerk, providing much needed oversight of the City Clerk’s Office to ensure compliance with the Municipal Code and state law. The original letter agreement with MuniTemps was for $25,000. The City Council approved an amendment to the Letter Agreement increasing the total compensation of the agreement by an additional $25,000. This amendment was necessary in order to enable the City to complete the recruitment for the newly created position of Chief Deputy City Clerk. The recruitment for the position was expected to be completed by this time; however, due to delays, this position will not be filled until mid to late May. Until this position is filled, the City needs for Ms. Macias to continue in her role as interim Assistant City Clerk. Once the new Chief Deputy City Clerk has been appointed the City will terminate its agreement with MuniTemps. FISCAL IMPACT: There is sufficient funding available to cover the additional $14,000 through salary savings due to the vacant full- time Assistant City Clerk position. Upon the hire and training of the newly created position of the Chief Deputy City Clerk, the agreement will be terminated and remaining compensation will be saved. Butzlaff, ICMA-CM City Manager Attachments: 1) Amended Letter Agreement with MuniTemps ATTACHMENT 1 AMENDMENT TO LETTER AGREEMENT FOR INTERIM ASSISTANT CITY CLERK SERVICES This Amendment to the Letter Agreement with MuniTemps is made and entered into this 18th day of April, 2016, by and between the CITY OF AZUSA, a municipal corporation ("City") and MuniTemps ("Consultant") and amends that certain "Letter Agreement with MuniTemps" (the "Agreement") dated October 1, 2015 between the same parties. R E C I T A L S A. On or about October 1, 2015, City and Consultant entered into a “Letter Agreement” pursuant to which Consultant agreed to provide city clerk services (“Project”). B. City requires additional services that are outside the Consultant’s established compensation. C. City and Consultant desire to amend the Agreement to modify the compensation. A G R E E M E N T The Agreement is hereby amended as follows: 1. The compensation of this Agreement shall not exceed $64,000 (SIXTY-FOUR THOUSAND DOLLARS). The Consultant shall complete the Services within the term of this Agreement, and shall meet any other established schedules and deadlines. 2. Except as expressly provided herein, all other terms and conditions of the Agreement shall remain in full force and effect.
