The City Council of the City of Azusa
met in regular session at the above
' time and place.
Present at roll call: Councilmen: Jackson,
Hernandez, Seltzer, Memmesheirm r, Jones,
City Attorney Snidow, City Clerk m d City
Engineer. Absent: None
Each member present acknowledged receipt
of a written copy of the minutes of regular
meeting of May 5, 1952. The Mayor asked if
' there were any objections or corrections to
said minutes. There being none, the minutes
of May 59 1952 were approved as written.

It was unanimously agreed that Council meet
with the members of the Personnel Board on
Tuesday, June 24th, to discuss the proposed
Rules and.Regulations recommended by the
Personnel Board.
Mr. Jesse O'Malley tendered his resignation
as a member -of the Personnel Board.
Moved by Councilman Memmssheimer, seconded
by Councilman Jackson Council accept the
resignation of .Mr. O'Malley.

Mayor Jones asked for nominations from the
floor, to fill the vacancy caused by Mr. O'Malley's
resignation.
The Mayor gave the following names as
suggested nominees:

5, Bill Jensen
6. Tony Ortuno
Councilman Seltzer nominated Saul Winokur.
The Mayor asked if there were any other nominations.
There being none, it was moved by Councilman
Hernandez, seconded by Councilman Seltzer that
nominations be closed.

The "Suggested Changes" in the Civil Service
Ordinance, submitted by Mr. O'Malley, were

The matter of step raises for certain city
employees was presented. It was suggested
by Councilman Hernandez that this matter be

The matter of the amount of sales tax paid
the City by the Milton J. Wershow Company of
1233 S.Santa Fe Avenue, Los Angeles 21, Cal ifcrnia,
was offered. -
Moved by Councilman Memmesheimer, seconded by
Councilman Seltzer the City Attorney be in-
structed to -write M. J. Wershow Company request-
ing a photostatic copy of the sales tax report
submitted to the State, showing the itemization
of the figure $64,858.94 claimed as exempt
transactions on their report rendered the City.

' The Mayor announced that this is the time
and place fixed by this City Council for
hearing objections or protests on the pro-
posed work, or the extent of the assessment
district, or on the proposed grades under the
Resolution of Intention, Resolution No. 2602,
providing for certain grading and the con-
struction of certain curbs, -gutters and drive-
way aprons on Bayless Street and other streets.

The City Clerk presented the affidavit of publication
of Resolution of Intention No. 2602, published May let and
8th, 1952•
Moved by Councilman Memmesheimer, seconded by Councilman
Jackson this affidavit be approved and ordered placed on file.
Carried by the following vote of the Council:
Ayes: Councilmen: Jackson, Hernandez, Seltzer,
Memmesheimer, Jones.
Noes: None Absent: None

Estimate of each omission, alteration or
change in the proposed improvement.
City Engineer Brooks read the Report and
Estimate.
The Mayor requested the Clerk to read any
written protests which have been filed.
Mr. D. B. Burgett, 916 W. Hollyvale Street,
requested that his property (Lot 162, Tract
10660) be omitted from the assessment map as
his improvement has been completed.
Written protests were submitted by the follow-
ing:
John and Helen Wentzel, 1063 W. Bayless Street
James and Doris Beach, 925 f. Hollyvale Street
Paul L. Brattain, 345 N. Virginia Avenue
John R. Parr, 403 Virginia Avenue
Mr. Wentzel stated, in oral protest, that the
cost of the improvement was greater than re-
presented in the beginning.
Mr. Brattain stated that he was not against the
improvement but that he felt it placed an added
burden on his shoulders.
Mr. Parr stated that he did not see the petition
requesting the improvement, that his property
has 1911 Street Improvement Bonds against it,
and he has not been able to locate the person
holding the bonds and for this reason he was
unable to sell his property, that he could not
see how two improvement bonds could be placed
against the same piece of property.
The Mayor announced that the City Council will
now hear any oral protests or objections con-
cerning the work, extent of assessment district
or grades.
Mr. Elmer Roe, 1064 W. 4th Street, asked if the
figures quoted were an estimate. He also asked
If $3.50 per foot for curbs and gutters was the
estimated figure, offering the information that
"we get it done in Tracts for $1.25 per foot."
— There being no other persons present desiring
to be heard on the matter, Mayor Jones asked
City Engineer Brooks to advise the City Council
what per cent of the total area to be assessed
for the improvement is represented by written
protests or objections filed with the City Clerk.
City Engineer Brooks reported that written
protests and objections have been filed with the -
City Clerk by the owners of 3.1% of the total
area to be assessed for t be improvem9nt.
The City Clerk presented the affidavit of publication
of Resolution of Intention No. 2602, published May 1st and
8th, 1952•
Moved by Councilman Memesheimer, seconded by Councilman
Jackson this affidavit be approved and ordered placed on file.

RESOLUTIONL OF THE CITY
OF AZUSA, CALIFORNIA, MAKING FINDINGS AND
OVERRULING PROTESTS,AND,OBJECTIONS. (Bayless
Street)
WHEREAS, this City Council by its Resolution
No. 2602, adopted on the 7th day of April,
1952, declared its intention to order certain
grading and the construction of certain port -
land cement concrete curbs and gutters and
the paving of certain driveway aprons with
portland cement concrete and appurtenances
and appurtenant work under the Improvement Act
of 1911, Division 7 of the Streets and Highways
Code of the State of California, aid in sat d
resolution fixed the 19th day of May, 1952, at the
hour of 7:30 P.M. in the Council Chambers of this
City Council,,as the time and place for the hear-
ing before this City Council of protests and ob-
jections; and

WHEREAS, at the time and place fixed in said Resolution
No. 2602, a hearing was duly he]d by this City Council
at which all wrStten protests or objections were duly
presented and read and all persons desiring to be hs and
thereon were heard, and this City Council gave all
persons present an opportunity to be beard in respect
of any matter relating to the work proposed in said
Resolution No. 2602 or the boundaries of the assessment
district described therein, or in en y way relating to
the proceedings proposed by said Resolution No. 2602;
and
' WHEREAS, all persons desiring to appear and be heard
have been heard, and this City Council has taken
evidence relating to said proposed work, the boundaries
of the proposed assessment district, and is fully in-
formed in the premises;
NOW, THEE FORE.. the City Council of the City of Azusa,
California, DOES HEREBY FIND, RESOINE, DETERMINE AND
ORDER as follows:
Section 1. That protests or objections have not been
made by the owners of one-half of the area of the pro-
perty to be assessed for said proposed work.
Section 2. That all protests and objections are here-
by overruled and denied.
Section 3. That no changes are to be made in the
boundaries of the proposed assessment dig trict or in the
work proposed to be done, and the boundaries of tbs
assessment district are defined and established as the
boundaries described in the resolution of intention, to
wit: Resolution No. 2602, and the work proposed to be
done is likewise defined and established as the work
described in said Resolution No. 2602, and reference
is hereby made to said Resolution No. 2602 for a full
and complete description of said work aid of the assess-
ment district and for further particulars.
Section 4. That this resolution shall be entered upon
the minutes of this City Cowin; Ji.

The Planning Commission recommended that
Walter P. Miller be granted permission
to remodel and build on to the existing
structure at 813 W. Paramount Avenie making
the total size of the structure 915 sq. ft.
Moved by Councilman Memmesheimer , seconded
by Councilman Seltzer Council accept the
recommendation -of the Planning Commission.

The Planning Commission recommended that
Elmer Roe be given permission to erect a
dwelling containing 703 sq. ft. on Lot 86,

Councilman Jackson stated that in his opinion
this dwelling should contain 800 sq. ft.
of liveable space.

Mayor Jones Council accept the recommendation
of the.Planning Commission.
This motion failed to carry by the following

on Azusa Avenue.

regulating the speed limit on Azusa Avenue as
recommended by the Chairman of Police Department
and the Chief of Police.

City Engineer Brooks and Councilman Jackson
reported on the meeting with the County Planning
Commission relative to the proposed State High-
way Plan. Cities represented were Glendora,
Duarte, Arcadia and Azusa. All present were
opposed to the proposed plan.and requested
that 10th Street and Sierra Madre Avenue be
omitted from the Master Plan.
The County Planning Commission agreed to
take this matter under advisement.
The matter of replacing the culvert on the
east side of Azusa Avenue was introduced.

Councilman Hernandez the City Engineer be
instructed to prepare plans for the replace-
ment of the culvert on the east side of
Azusa Avenue.

the Mayor be authorized to publish the
proclamation.

Mayor Jones the -City Clerk be authorized
to accept a check from Wilma Lamers in the
amount of $104.66, dated May 14, 1952, in
payment of disputed account of sales tax due
the City from January 1, 1949 to June 30,
1950.
