SUBJECT: REQUEST TO ADOPT RESOLUTION NO. 2016-C21 IMPLEMENTING PAID SICK-
LEAVE FOR PART-TIME EMPLOYEES
SUMMARY:
On September 10, 2014, the Governor signed Assembly Bill (AB) 1522, Healthy Workplaces, Healthy
Families Act of 2014. This bill provides paid sick leave to unrepresented (i.e. part time) employees who
work for 30 or more days within a year and authorizes an employer to limit an employee’s use of paid
sick leave to 24 hours or 3 days in each year of employment. Unrepresented employees who work more
than 30 days within a year on a 4/10 schedule may accrue 3 days in each year. This action approves a
resolution implementing paid-sick leave for part-time employees as required by AB 1522 and rescinds
Resolution No. 14-C35 related to part-time employee’s terms and conditions of employment.
RECOMMENDATION:
Staff recommends that the City Council take the following action:
1)Adopt Resolution No. 2016-C21 implementing Paid Sick Leave for Part-Time Employees as
required by AB 1522 and rescind Resolution No. 14-C35 (Part Time Employees terms and
conditions of employment).
DISCUSSION:
On June 16, 2014, the City Council adopted Resolution No. 14-C35 approving Part Time Employees
terms and conditions of employment effective July 1, 2014. These terms and conditions allotted part
time employees particular employee-related benefits including Part Time Leave (PTL) which has been
used for sick leave purposes.

On September 10, 2014 the Governor signed Assembly Bill (AB) 1522 enacting the Healthy
Workplaces, Healthy Families Act of 2014 to provide paid sick leave to employees who work in
California for 30 or more days within a year and who are not covered by a valid collective bargaining
agreement. This law authorizes an employer to limit an employee's use of paid sick days to 24 hours or 3
days in each year of employment.
With the implementation of AB 1522, Resolution No. 14-C35 (Part Time Employees terms and
conditions) is no longer necessary and should be rescinded.
FISCAL IMPACT:
The financial impact of implementing AB 1522 is unknown at this time; however, any additional costs
would be limited to covering services performed by part-time, temporary, and seasonal staff during sick
leave absences.

RESOLUTION IMPLEMENTING PAID SICK LEAVE PURSUANT TO
AB 1522 FOR PART-TIME, TEMPORARY AND SEASONAL
EMPLOYEES AND RESCINDING RESOLUTION NO. 14-C35
WHEREAS, on June 16, 2014, the City Council adopted Resolution No. 14-C35
approving part time employees terms and conditions of employment effective July 1, 2014.
WHEREAS, on September 10, 2014, the Governor of the State of California signed the
Healthy Workplaces, Healthy Families Act of 2014 (AB 1522) providing paid sick leave for
covered employees effective July 1, 2015; and
WHEREAS, part-time, temporary, seasonal employees are not covered by an existing
collective bargaining agreement, benefits resolution nor any other benefits policy; and
WHEREAS, AB 1522 provides City employees who work 30 or more days a year are
entitled to paid sick leave to be accrued at a rate of no less than one hour for every 30 hours
worked; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa
hereby adopts the provisions under the Sick Leave Policy for Part-Time, Temporary and
Seasonal Employees
BE, IT FUTHER RESOLVED that the City Council of the City of Azusa does hereby
rescind Resolution No. 14-C35 approving part time employees terms and conditions of
employment effective July 1, 2014.
PASSED, APPROVED and ADOPTED this 7th day of March, 2016.
