HomeMy WebLinkAboutOrdinance No. 00-O5 ORDINANCE NO 00-05 AN ORDINANCE OF THE CITY COUNCIL OF_THE CITY OF AZUSA, CALIFORNIA,ADOPTING AND APPROVING THE AZUSA PACIFIC UNIVERSITY/AZUSA SQUARE SPECIFIC PLAN: CASE NO. SP-5 WHEREAS, the Azusa Pacific University/Azul S uare Specific Plan 5 (''Specific Plan") has been initiated an'mid prepared'on behalf of thet ty`of Azusa to facilitate a master plan to allow the phased development consisting of student housing, administrative Offices, classrooms, university related retail, and athletic fields on approximately 11.83 acres of land. The site is located at 575 - 647 East Foothill Boulevard. WHEREAS,required notice was mailed as set forth in affidavits on file at the Community Development Department not less than ten days prior to the date of the hearing in compliance with City Code section 88-125, 88-130, 88-135, and 88-140, and Government Code section 65090 and 95091. WHEREAS, the City prepared the Initial Study and Mitigated Negative Declaration in accordance with CEQA, the State CEQA Guidelines, and the City's CEQA implementing procedures, and that the City Council has reviewed and considered the Mitigated Negative Declaration and the comments received thereon. WHEREAS,the Applicant sponsored a community meeting on February 8, 2000 to solicit input regarding the Project Approvals and to disseminate information regarding the same. WHEREAS, the City published a notice of its intention to adopt the Mitigated Negative Declaration in compliance with Public Resources Code section 21092 in the San Gabriel Tribune on February 10, 2000, which notice also included a notice of the public hearing before the Planning Commission on March 1, 2000. WHEREAS,the City mailed notice of its intention to adopt the Mitigated Negative Declaration in compliance with Public Resources Code section 21092 on February 10, 2000, to the contiguous landowners and to all public entities entitled to notice under CEQA, which notice also included a notice of the public hearing before the Planning Commission on March 1, 2000. WHEREAS,the Planning Commission held a duly noticed public hearing on March 1, 2000, on the Initial Study and Mitigated Negative Declaration and on the Project Approvals, during which hearing testimony was received from nine residents living near the Project site in favor of the proposed Project; and written comments and testimony from two resident against the Initial Study and Mitigated Negative Declaration was submitted. WHEREAS, after receiving the aforementioned written comments and testimony, the Planning Commission closed the public hearing on March 1, 2000, and deliberated regarding the Initial Study and Mitigated Negative Declaration and the Project Approvals, and duly considered all information presented to it. WHEREAS, after due deliberation and consideration of the Initial Study and Mitigated Negative Declaration and the written and oral comments received, the Planning Commission voted unanimously to recommend that the City Council approve the Initial Study and Mitigated Negative Declaration, and further recommended that the City Council approve the Project Approvals. WHEREAS,the City again mailed a notice of its intention to adopt the Mitigated Negative Declaration to the contiguous landowners and to all public entities entitled to notice under CEQA, which notice also included a notice of the public hearing before the City Council on March 6, 2000. WHEREAS,the members of the City Council have been provided with copies of the Initial Study and Mitigated Negative Declaration and the comments received, and have fully reviewed the documents and comments, as well as the other information in the record of proceedings. WHEREAS,the Specific Plan implements the policies of the General Plan by ensuring that the type, amount, design, and pattern of all land uses in planning area serve to protect and enhance the character and image of Azusa as a desirable residential urban community. ORDINANCE NO. 00- SPECIFIC 0-SPECIFIC PLAN SP-5 PAGE 2 WHEREAS,the Specific Plan contains all the necessary elements required by section 65451 of the Government Code and Division 12 of the Azusa Municipal Code, and the Specific Plan was referred to all affected public agencies pursuant to sections 65453 and 65352 of the Government Code. WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Based on the entire record before the City Council of the City of Azusa ("Council',), all written and oral evidence presented, and all the staff reports provided, the Council finds the Specific Plan is consistent with the General Plan of the City of Azusa ("General Plan") and contains site specific standards, guidelines and regulations for implementing the Specific Plan in conformity with the City's General Plan, including its adopted goals and objectives. Additionally, adoption of the Azusa Pacific University/Azusa Square Specific Plan 5 will not obstruct the obtainment of many other goals and objectives contained in the City's General Plan. As a result, the Council hereby finds that the Specific Plan is consistent with the General Plan including all of the adopted elements thereof SECTION 2. Based on the entire record before the Commission and all written and oral evidence presented to the Commission,the Commission finds the Specific Plan is consistent with the General Plan of the City of Azusa and systematically implements the goals and objectives of the General Plan in the following ways: Land Use Element Primary Community-Wide Land Use Goal: Provide for an orderly pattern of future development and change throughout the City that will both be compatible with and beneficial to existing land uses and which will ensure residents of a desirable urban environment in which to live, work, shop and play. The proposed Specific Plan contains standards and guidelines that will lead to the orderly development of the site in a manner that will be compatible with the surrounding land uses. Circulation Element Objective: To develop a balanced system of circulation which incorporates motor vehicles,pedestrians, bicycles and other private and public transportation modes with greater safety and increased energy efficiency. The proposed Specific Plan promotes the use of alternative modes of transportation by: creating a safe pedestrian environment with wide sidewalks and tree lined streets; providing a mix of land uses within easy walking distance; and limiting the amount of parking to that which is necessary to serve the intended uses. Community Design Element Goals: 1. Provide guidelines for design treatments of public and private buildings which are aesthetic yet economically practical. 2. Promote community identity through the upgrading of existing landscaping, redesign of existing buildings and design treatments for new buildings which are in keeping with community character. The proposed Specific Plan contains design guidelines and standards that provide for the orderly development of the site. The Plan promotes design concepts that recall the San Gabriel foothill area's history and small town character of tree lined streets with low scale buildings facing onto the streets. SECTION 3: Based on the entire record before the Council, all written and oral evidence presented, and the findings made in the Ordinance, the Council hereby adopts and approves the Azusa Pacific University/Azusa Square Specific Plan 5 as set forth in Exhibit B subject to the revisions attached in Exhibit C. Sot',City Clerk r APPROVED AS TO FORM: City ttorney EXHIBIT C AZUSA PACIFIC UNIVERSITY/AZUSA SQUARE SPECIFIC PLAN 5 MODIFICATIONS As modified by the City Council on March 6, 2000 Chapter 4, Exhibit 4.1 "Development Standards" shall be modified as follows: EXHIBIT 4.1 DEVELOPMENT STANDARDS Development Standard Minimum Requirement 1. Maximum Building Height 4 stories or 60 feet 2. Minimum Front Yard Setback 10 feet 3. Minimum Side Yard Setback a. Street Side 5 feet b. Interior Side 5 feet 4. Minimum Distance Between 20 feet Buildings 5. Parking Standards: Use Minimum Required Number of Spaces: a. Student Dorm Room 0.6 spaces per dorm room b. Student Residential Unit 1 space per unit c. Commercial 1 space/675 s.f. of gross floor area d. Professional Office 1 space/300 s.f. of gross floor area e. Classrooms 1 space/3 students e. Athletic fields 1 space/3.3 bleacher seats Chapter 5, "Implementation" shall be modified as follows: 5. IMPLEMENTATION 5.3.2 Development Review/Precise Plan of Design Applications for each phase will be reviewed by the Development Review Board in accordance with Chapter 88, Article III, Division 12 and 13 of the Azusa Municipal Code, and approved by the Community Development Director and the City Manager and/or a designated member of the City Council ("Staff Reviewing Body")prior to the issuance of building permits. 1. Staff Level Review of Precise Plan of Design When the Community Development Director deems the Precise Plan of Design application complete, the application will be scheduled for review by the Development Review Board for a recommendation to the Staff Reviewing Body. Specific Plan 5 Exhibit C Page 2 Applications, such as a Conditional Use Permit or Tentative Tract Map application shall be scheduled for a public hearing with the Planning Commission. Such public hearing shall be noticed as required by the City of Azusa Municipal Code. The Staff Reviewing Body shall take action by either granting or denying approval of the Precise Plan of Design. The action of the Staff Reviewing Body shall be final unless appealed as prescribed below. 2. Findings for Approval The Staff Reviewing Body shall grant approval of a Precise Plan of Design if the following finding is made: The use is authorized by the Specific Plan, and is consistent with the General Plan, and is consistent with the standards on the mix of uses, design and protection of surrounding uses outlined in this Specific Plan. 3. Conditions of Approval The Staff Reviewing Body may impose such conditions as it deems necessary to ensure that the project will meet the development standards and the proposed intent of this Specific Plan. 4. Parking Demand Study and Management Plan A complete application for Precise Plan of Design for Phase III shall include a parking demand study. The parking demand study shall analyze actual demand for parking for all uses within the Specific Plan area. In the event that the demand for parking cannot be accommodated completely on-site, a parking management plan shall be prepared which includes measures to avoid spillover parking that could adversely affect adjacent properties. Parking management measures may include, but are not limited to,providing sufficient overflow parking on the APU West Campus site, increasing the availability of campus shuttles, restricting student and/or faculty use of existing parking facilities, and the strategic scheduling of University events so that major events do not occur simultaneously at the Specific Plan site and the APU West Campus Events Center. Once approved, the parking management plan shall be adopted by the Staff Reviewing Body as a condition of approval of the Precise Plan of Design for Phase III 5.4 FINANCING AND MAINTENANCE OF IMPROVEMENTS 5.4.1 Infrastructure Financing Installation of all improvements will be privately financed and will include: 1. Water and sewer facilities. Specific Plan 5 Exhibit C Page 3 2. Street improvements including sidewalk pavement, landscaping, lighting and signs. 3. Storm drain system. 4. Telephone, gas, electric and cable television facilities located within the public street rights-of-way. The City will conduct traffic studies at the Foothill, Alosta and Citrus corridors as part of the current General Plan update and at least once every three years. At Phase II and Phase III, the University shall pay such general traffic mitigation fees then in effect.
