HomeMy WebLinkAboutOrdinance No. 98-O11 ORDINANCE NO. 9 8-01 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE CITY ZONING MAP TO REFLECT THE RECLASSIFICATION OF PROPERTY LOCATED AT 125 EAST SIERRA MADRE AVENUE & 1410 AZUSA AND SAN GABRIEL CANYON ROAD (same property,two addresses on adjoining streets), 1430 AZUSA AND SAN GABRIEL CANYON ROAD,AND 1450 AZUSA AND SAN GABRIEL CANYON ROAD FROM C2 (Restricted Commercial) TO R-1-10,000 (Single Family Residential, 10,000 square foot lot sizes). THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Azusa determines and declares as follows: A. The Planning Commission for the City of Azusa held a duly noticed public hearing on May 27, 1998 regarding Zone Change Case Number Z-98-2, and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 98-23, recommending to the City Council the adoption of this ordinance. B. The City Council of the City of Azusa held a duly noticed public hearing on July 7, 1998,concerning this ordinance and fully and carefully considered all oral and written testimony offered therein prior to acting on this ordinance. C. This zone change would not result in any significant impacts on surrounding properties.The proposed zone change would be reflective and consistent with existing uses in this area of the City. Any development activity on these properties would be subject to review and approval by a City Official,Planning Commission,and/or City Council.Potential impacts under the proposed zoning designation would be less than that which might occur under the existing zoning and/or general plan designation. D. The amendment to the Azusa Municipal Code as set forth in this ordinance is consistent with the public necessity,convenience, general welfare,and good zoning practice and is necessary for the preservation of the public health,safety and general welfare. E. The amendment to the Zoning Map as set forth in this ordinance is consistent with and in conformance to the General Plan of the City of Azusa, and each of the elements thereof and furthers the intent and purpose of Chapter 88,ZONING,of the Azusa Municipal Code. F. In taking this action,the City Council has considered the effects of its decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the city's residents and available fiscal and environmental resources. SECTION 2. The Zoning Map of the City of Azusa is hereby amended to reflect the change in zoning for the property located at 125 East Sierra Madre Avenue& 1410 Azusa and San Gabriel Canyon Road (same property, two addresses on adjoining streets), 1430 Azusa and San Gabriel Canyon Road, and 1450 Azusa and San Gabriel Canyon Road from C2 (Restricted Commercial) to R-la(Single Family Residential, 10,000 square foot lot sizes). Page 1 of 2 Ordinance No. 98-011 Zone Change Case No. Z-98-2 SECTION 3. Pursuant to the State CEQA guidelines,a notice of exemption has been prepared. The proposed project is a change in the Zoning Designation by reducing the intensity of potential uses on the properties,from commercial uses to residential and institutional uses. Thereby reducing potential impacts to the environment. In addition for the properties at 125 East Sierra Madre Ave. & 1410 Azusa& San Gabriel Canyon Rd. (same property,two addresses on adjoining streets) and 1430 Azusa & San Gabriel Canyon Rd., an agreement further limiting the land uses allowed on that property has been entered into by the City and the landowner, which will also not have an impact on the environment. The permitted land uses would be consistent with the existing facilities, currently in place on the property. On the third property, 1450 Azusa & San Gabriel Canyon Road,the allowable land uses would be compatible with the existing residential development found to the east. SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published in compliance with Chapter 88, Article II, Division 5 of the Azusa Municipal Code.
